After 4 years of treating my case is ready for trial next month and Defense recently contacted my attorney wanting to negotiate a settlement. They made an offer 2 years ago but my injuries are severe for the amount of compensation they offered. Try to have patience get treatment and great legal counsel for a more positive outcome..Good Luck

I was in an accident August of last year. The other person ran a red light and I t-boned her at 50mph totalling my car. It messed up my spinal cord stimulator and I had to have surgery to replace it. I also got a herniated disc in my cervical spine requiring surgery. There are multiple other spinal disc bulges. I'm still waiting to hear from her insurance Co. I've learned I just have to be patient.
Report the slow insurance company for bad faith to the insurance commissioner.
It shouldn't take so long if theres video proof and injuries to my lower back and neck so inresponsible that the state of texas allows this insurances and lawyers to play games with the people who needs a new car and payment for pain and suffering we should all complain to change this methods of the insurance companies who are fault
My strategy is to wait 90 days after the crash (or retaining the case), and then filing suit. There are too many companies that have first-line adjusters with no authority other than a few thousand dollars.

I had a car accident since Sep/28/2022. I lost the car because I can't go to any jobs and pay my bills, so my car was took from the dealership. I change 2 attorneys because I ended up my medical treatment in 2 months. And now I have another attorney since February and file a Lawsuit. The case was evaluated it and says that I don't have the fault. My attorney is saying that is gonna take too long because the other insurance company didn't want to answer the Lawsuit. I'm loosing jobs oportunities just because I have no car to move on and money to spent on uber or lyft. How long more did I need to wait???
I was rear-ended by an 18 wheeler 4 year's ago, my back was broken in 2 places and I went through 2 injections in my neck under anesthesia and a spinal fusion surgery earlier this year. I had to push my lawyer on everything, and I got the medical treatment as fast as I could get the lawyer to put the money up. I have been suffering with moderately severe back pain and the pain is still a major factor in my everyday life. I'm still hurting but in the interest of getting my finances in order to and pay some out of pocket expenses. I asked my Dr to release me but reintegrated the back pain was still an issue, but he said I was probably going to be as good as I can get. I've been calling My lawyer who will not answer or return my phone calls and they told me that I needed to get a loan for my treatment but it was at 30%> it's been 4 year's and I just need to settle this and get on with my life. I don't want to do it that would harm or jeopardize my case, or relationship with the lawfirms, but I don't know what I should do next.
David, I'm sorry you've gone through all of this. As far as 4 years - yes, these cases can take that long. But as far as your lawyer not responding - that surprises me and it's poor service. I would continue to reach out to her or him and express respectfully that you really need their guidance. Since you have a lawyer already, not much more i can say on the topic. 9 years & counting. Attorney got one of the settlements back in 2018, I didn’t see a penny of it. Was told he got paid first and medical bills… sad thing is called my dr yesterday and bills weren’t paid. Have asked for a statement of charges over and over again and he hasn’t produced it. I was involved in a car accident in Nov 2019, so far I received an offer which was a little over £3K in March 2020, following my rejection of that offer the insurance company hasn’t come back to me with another offer because we are pursuing the medical side at the moment. I got in accident in October of 2022, i got a back injury bulging disc went to treatment had a MRI done. I had to stop treatment due to having to get a new job and my new schedule was conflicted . I closed my case April 6 2023. I just received a letter 4/28/23 that my attorney dropped my case due to lack of coverage. I don't know what to do at this point moving forward. I'm located Jacksonville Florida.

I just got into an accident last night and I was making a right at a light and the traffic was pretty backed up. All of a sudden a huge truck smacked me in the back and caused my car to get slammed forward like 4 feet hitting the car in front of me and then that car tapping the car in front of them. My body is sore and I think I should go to the doctors office to get checked. What would happen in this situation since the guy who hit me was clearly at fault for the whole incident. Don’t want my rates to go up and I need to get my case resolved to solve my car damages since it was an already old car on its way out.
Morning. Forget about your rates - focus on your health. Report the claim to their insurance and your own and let the process play out. If you find you're in real pain let me know and I can recommend an attorney.
If a hosptial put a lien on a medical bill does this mean the money goes straight to them when a check is written from insurance co? or do I pay after I get the check? So example. Hospital bill is $10k , Do they get the money from the insurance right away?
Well, here in Illinois, my experience is that they'll often cut the check directly to the medical provider. Though I've seen many times where we've paid liens out of settlement proceeds.

New York is a "No Fault" state, so you can have your own insurance carrier cover the bills. Not every state is "No Fault" however.

Well the most important thing I think for you to do would be to file a claim with your insurance right away. Because what happens is if they can't get a hold of this guy and they can't verify what happened in the accident they may actually deny your claim. You will have had to file a claim with your own insurance to get your damage covered.
When there is an liability denial stating claimant is at fault. So, does insurance send any correspondence to claimant regarding liability denial?
If I understand the question, then yes, normally, if you're claim is denied, the insurance company would send you a denial letter.

It's not uncommon for cases to take that long. But yes, I agree - if you're not satisfied with their offer, file suit!
2 years now .. when I did my case a few years ago took about 14 months
My girlfriend was involved in a car accident a couple weeks ago, it was at a 4 way stop/intersection and she was almost across the intersection when the other driver was speeding hit her, sending her in the lane perpendicular to her. Hi, it's really impossible to say at this point and covid-19 messed up very badly. It could be resolved in 6 and 9 months or frankly it could take years. I'm really not in a position to be able to estimate without knowing a lot more information.
Just got in a crash while riding uber home from hospital me and my pregnant wife both got minor injuries like back pain and whiplash but the real danger is she's pregnant with twin and doctor said they're not sure yet if this accident will cause any further complications. I'm dealing with auto owners insurance covering a co.
My car was parked, the other driver reversed and hit it. 3 employees and me saw it. I stopped the owner. We exchanged papers and I took photos. On the following day I texted the guy. He replied "send me the estimate, but more likely im going through the insurance as that is why I pay them for". Suddenly, I received an estimate from his insurance company. His insurance company totaled my car and no one contacted me. Days later the bodyshop reached out to me. Now my car is at the bodyshop and storage fees are piling up. Adjuster isn't moving this case.
Hmmm. I would document in writing via fax to the insurance company what's going on for starters. ASAP. Tell them the situation. What constitutes a 'total loss' may be dependent on what your state law says. So I can't really comment on that part. But I would act asap to get the insurance company to act. If they don't respond in 24 hours, call and get the adjuster's manager's name and go to her/him.
someone i knows rights under the fair claims settlement Practices regulation act are being violated, here's the details: a man drunk drove through fence taking out the fence plumbing and damging 10 30ft trees as well as a telephone pole, they deny the extent of the damage and are maintaining that the fence is 5ft tall when the fence is 6ft tall, the person now has documentation of them denying the height of the fence height and insurance company refuses to adjust claim to include actual height of the fence its been three months of back and fourth with insurance company, is this case for negligence and purgery? my friend cant afford a lawyer or to fix the damages how should my friend proceed?

Sounds like typical ins co b.s. Try going above the adjuster's head to the manager. That might be an option.
I got an into a multiple collision, 5 cars one of it is a comercial truck. I was the forth it hit me from the rear and pushed me forward and hit the car in front of me. Collision center told me my car is a total loss, I have a gap insurance, honda is just waiting for the report of the adjuster so i can file my claim with honda and start getting a new car, bcuz the rental car my insurance gave me is too low and old that makes my back and neck pains worst. I am having treatment with a Chiro. How long will the insurance give their report,so i can file with my gap insurance...?

Morning Tyron, it's really impossible for me to say. It depends how long it takes the ins co to review the demand package and to negotiate a settlement (if that even happens). Then once settled will have to resolve all medical bills and health ins liens theoretically before you can get your check.
I got rear ended back in July 2020. Did all the medical items needed that my lawyer asked for. I get a call from lawyer to sign the insurance release and distribute to me for personal injury. He said he waiting on the uid negotiations. I can't find any answer on when I will receive my money???

A tow truck driver dropped a car at a pump in gas station , left it in neutral, as the car was rolling back the driver tried to go around but a car was in the way , he still had his fork down and reversed into me as i was turning around a pump , he jumps out to stop the car rolling cause it was about to hit me as well . Hi. If there were no injuries it would be difficult to find a lawyer to get involved unless you wanted to pay her or him on an hourly basis. You may have to file a lawsuit on your own. Go to your County Clerk's website and research how to file a small claims lawsuit ....

My treatment went for 3 months. I'm still in pain. 3 mm herniated disc. My attorney says they will submit the medical bills to the insurance. My treatment ended in October.. still no update other than "we are still gathering" medical bills.

@@LawFull it's what I was thinking. Last contact I had with the attorney office was April 6. They told me the same thing they told me back a few months prior. "They're gathering medical receipts". I had a MRI done, and 3 months therapy. That's only 2 different offices. Will give them a call this week. I believe the other parties insurance is Mercury. So I think from what I've heard is they like to prolong it as much as possible.

You are definitely going to want to wait to settle that case. There's no way to know how much the case is worth until all the medical treatment is done and you're fully recovered. Hello, my teenager with DL and 2 passenger got in a hit and run accident not at-fault because he run a stop sign to main intersection. The other drive took off but left the vehicle at the scene. Hi, you can accept it, or you can use your own insurance to cover the damage (but then you have to pay your deductible) and let them go after the other side for reimbursement. Or, if you want to go through the aggravation, you can file a lawsuit against the other guy.

Well technically you don't need a lawyer. But I almost always recommend if you've suffered injuries to use a lawyer. And yes, cases can take years and years. It's extremely frustrating I understand. Sorry you're going through this....

Hi got a question. Several months ago I was in a auto accident. Spend 7 days at the trauma center. With a lot of fracture bone and collapse lung. I also spend 15 days at a rehabilitation. My question is I have a neck brace attached with a body brace. I am wearing it since the accident not able to move the neck. Recently on my follow up with the neurosurgeon,he mentioned.Why am I still wearing the brace ,I said because Iam in a lot of pain on my neck. He didn’t seem happy. He scheduled a second cat scan and MRI . Should I find another doctor? Thank you
Hey JC, that is hard for me to answer. Sounds like you reported pain and he/she is responding with testing - which to me sounds appropriate. But that's just me.... Hi, 1 month - I wouldn't be worried. They're not ripping you off. 3 months I'd definitely check in. This is a super long and slow process. But if you're really concerned, send an email to the lawyer saying I know you're busy, but I could really use a quick update.....
Exactly. You can always call your lawyer's office to ask for an update. As a rule, if I haven't had any activity on a case, I send out a "no action letter." It basically says that I know you haven't heard from me in a few months, but this is normal and you should not be concerned.

I was rear ended May 24th 2019 and after back and forth with the insurance adjuster my Attorney sent a letter requesting that the adjuster be removed from my case so then he gets a call from an Attorney after filing a lawsuit so after interrogatories,depositions and even a video recorded statement from the surgeon who performed my back surgery and we had mediation December 10th 2021which didn't get resolved..now here in 2022 my Attorney gets a call from a new Attorney for the insurance say the other Attorney got fired and he is now working on the case...is it strange that the Attorney got fired and we are going on 3 years on my case?

A tow Truck hit a bunch of parked cars outside our home. It turns out the tow truck driver and the truck are uninsured. He caused damages to over 5 cars and two homes. How can we go about this after filing the claim? Will we have to resort to a civil suit?
Wow. This guy is an idiot. A tow truck being uninsured. Unbelievable. First turn to your own insurance. Hopefully you have collision/comprehensive coverage. If not, then yes, filing suit against the guy is the only other option unfortunately. Sadly about 2 months ago a moron in a 2000 chevy tahoe hit my gf head on she was ok her car is drive able but front is messed up she has the whole thing on video & his insurance is admitting fault but just waiting for his side but the clown is avoiding it sadly on the same day her contract with state farm went out so I put her on my insurance a couple days later so idk what to do. Hi, push the issue with the other insurance company. Go above the adjuster's head if need be. Document everything you do with them.....
Question : my car was parked in a parking lot and an accident involving 2 cars happened on the Main Street and one of the cars jumped over the sidewalk and hit my parking car .. the car which hit my car is insured but the other is not .. when I called the insurance company of the the car that hit me they said we don’t take responsibility for the accident because the uninsured car caused it .. what can I do

@@classicalgoat2504 Sorry to hear that. Well, 1. go ahead and file a claim with the 2d car - just to cover your bases 2. You may have to file suit against the driver of car #1 - check what the small claims laws are inyour state. Here in IL if your claim is under $10k you file in small claims court. It's made for people to represent themselves.

@@classicalgoat2504 If you got that denial, then you'll need to file a lawsuit in small claims court against the driver of car #1. Not much else you can do unfortunately I'm sorry to say.

Have several ruptured discs from my lumbar to back of my neck...
I even had to stop my therapy short too due to financials and been struggling ever since..
I know that the party’s insurance was from a business then was changed after the accident so I’m not sure if that has something to do with the amount of time..????

Well I'm not sure your lawyer would like it. You could document in writing a fax to him or her inquiring about the status of the case and indicating it's been taking a long time. But I really would not recommend that. I would just get on the phone and express your frustration and try to nail them down on exactly where they are on the case and how long it's going to take until this case goes to trial. There must be a trial date set at this point.
It looks like the last comment on this was 3years ago. I hope you will see mine here. I was in a car accident 2 years ago and was very injured.. not broken bones, I didnt visit the ER, but I say I was very injured because I was in a LOT of pain for a long time. The first lawyer dropped my case. It was a hit and run.. the lawyer I think, didnt see much hope. As soon as he dropped me, the other party came back on the scene, saying the accident was my fault, tho they ran into me. I had a 2nd lawyer slam dunk it in my favor quickly. The treatments were painful and ineffective to my healing. I have a herniated disk in my neck. So, chiro is the last thing good for it.. phys therapy didnt help much either. It seemed the timeline was endless.. no one could tell me how much I needed to do before a settlement would come. This financially injured me very badly. My car took 6 months to be repaired. So this 2nd lawyer dropped me also. Leaving me to swim in my own despair and deal with the aftermath on my own. The other insurance company was delighted that the lawyer had dropped me. I signed, to get the $2k they offered me. They said that is all I am going to get.I didnt know I was signing away my rights to get more treatment. I had massage therapy, which they paid some of but not all, leaving the therapist angry with me. They did tell me there is still $2800 set aside for my bills. Question is.. what happens to that money if no one claims it for my medical bills? in June it will be 2 years since that accident. Currently I had another person run into me.. am I some sort of magnet? this just happened on 1st. My neck is hurting all over again. I contacted one lawyer who said the insurance would argue that I have an "old injury". Well, yeah, dont we all? but this was re-injured. I do have a lawyer, but they keep saying that allstate hasnt "acknowledged" the claim yet.. ugh
Hi - very sorry you're dealing with all of this. So you do have a lawyer? What is she/he saying? Allstate was always a very difficult ins co to deal with. Your current lawyer really is the best resource for info on this and any other topic related to your case. As far as your medical bills though, I've never had that situation before to be honest. @@LawFull So far, I havent even spoken to my lawyer, only the assistant. She is very good at answering without answering. I get the same run around every time I call, "I dont know" is the main answer with lots of words around it. I have struggled to get the medical help I need thru their lil group.. the imaging was done, the lackluster front desk lady didnt seem to like me much so she didnt send my records to the pain management group, I had to call both to get them to connect. Its been a big do nothing situation. All the while I am behind on bills, its been very hard for me. I got another car, cuz without it, I am not going to survive.. thats another bill for me to pay when I am already down. Allstate hasnt "acknowledged" yet..

Hello I just need some advise on an accident I was involved in an accident on May 2 2021. The other vehicle t-boned me causing my children and I to spin around almost hitting a utility pole. My veichle is totaled my airbags deployed. Also i filed a claim and my adjuster has been great so far paying off my veichle and since I hadlve gap insurance they will cover the rest. I have full coverage on my veichle and I have to return the rental. I just don't know where to go from here . Also we were taken by ambulance to as well. My adjuster just got in touch with the other insurance agency but my totaled cost for damage was is $15,000 so could you please give me some advise on the next steps to get in getting me another viechle. I would be greatly appreciated.

Hi, well if you have suffered injuries I think the best thing that I can do for you is put you in touch with a local attorney. Let the attorney take it from there. But wow is it fortunate had all the insurance that you had to cover your property damage so far.

@@k-unique8356 I've never heard of Go Auto - but it doesn't sound good. Sounds like a sub standard insurance company which is not good. I would start documenting your lost earnings and I would also start confirming every communication with them in writing by email or fax if possible. Confirm you're waiting for them, you've lost $1,000 in lost wages b/c your car hasn't been etc. And you'll be making a claim for lost wages.....

What can i do when an insurance company tries to pay me less on an estimate?
Do you need their trying to pay you less money than the appraisal or estimate for repairs calls for? If so that's an unusual situation that I'm not familiar with. What is their justification for doing this?

Hi - I'm not entirely sure what your question is. But if your attorney is going to take your case all the way to trial, I would say they're on your side because a lot of lawyers wouldn't do that. What has happened since you posted this? Any conversation with your lawyer?

question simply for a subjective response: do you think it's fair how the system works regarding policy limits?
i honestly think something needs to be done to change it.
example:
if your client has $500,000 in med bills and possibly lost everything he/she had in their life.
but the policy limit was $50,000 so breaching that $50,000 will still be difficult to do. is that fair? the other person is at fault and ruined your client's life. i believe your client deserves happiness. that cannot be obtained if they only recieve $50,000. i know money doesn't grow on trees, but some sort of justice MUST be served here.
No I think it's lousy. There is only 1 way to protect yourself and I tell people over and over and over again - get as much uninsured and underinsured motorist coverage as possible. That's the only thing you can do....
