Saying "mentally retarded" just to avoid a response that you know is coming is immature. For a layman without all the tools of a mujtahid, it cant be made 'clear' to him the evidences. As an example, he doesnt know arabic, so when someone tells him this word in the hadith means (x) and another mujtahid says no it means (y) in this context, the layman cant identify which to go with since he didnt learn the language. He is doing taqlid on this very basic point. Then he is doing taqlid on the gradings of hadith etc... hence it still isnt possible for a layman. Secondly in this shamsi didnt even mention what you are describing hence he is held responsible for making people confused and giving incomplete information as you even stated.
