Old Man Arrested for Arson After Setting His Apartment Complex on Fire

- On December 21, 2021, at 8:50 a.m., officers with the Las Cruces Police Department responded to 765 Williams Street to assist the Las Cruces Fire Department with a raging residential blaze.
On arrival, officers were told that a "90-year-old man" lived in the apartment where the fire started, and it was unclear whether the man had made it out. Shortly thereafter, one of the property managers for the apartment complex arrived on scene and informed officers that the resident - Byron Anthony Hicks - was fine, and that he was standing outside watching the activity.

Mr. Hicks was ultimately taken into protective custody and transported to a local area hospital, where a nurse made contact with Mr. Hicks' wife - "who wanted nothing to with him." A hospital psychiatric evaluation concluded that Mr. Hicks's delusions were the result of substance abuse rather than the result of another mental illness, and Mr. Hicks was arrested and charged with arson.
On February 11, 2022, all charges against Mr. Hicks in the Las Cruces Magistrate Court were dismissed without prejudice, however Doña Ana County District Attorney's office spokesperson Roxanne Garcia-McElmell informed Real World Police that Mr. Hicks is the subject of an active grand jury investigation. If the grand jury finds probable cause that Mr. Hicks committed one or more crimes, he will face prosecution in New Mexico District Court, a higher court than the magistrate court where Mr. Hicks was initially charged.

This is what scares me about living in an apartment complex. I want to feel safe, but I’m depending on others not to do anything stupid or be nuts.
No offense but that’s life. Literally any day on any minute something from someone else’s stupidity or just a freak accident could be the end. Can’t live your life in fear every minute. Cooking fires from accidents could burn it down, it’s happened, people aren’t 100% accurate or perfect and sometimes catastrophes happen from something that started as a minor oversight. Its simply life for better or worse.

@@earthing3696 hey I don’t live my life in fear everyday. What happens, happens. I deal with the situation and move ahead. If I didn’t live that way, I wouldn’t be able to live. I wouldn’t be able to live in a mental prison like that. Then again don’t take it from me, I’m also an adrenaline junkie and a massive risk taker so maybe I’m not one to talk towards this particular crowd. But hey my life, I’m making the best of it. I’ve been through some pretty rough tragedies like anyone else and currently facing two more awful situations and you know I how deal with them? Humor. People think it’s callous of me to deal with problems like but hey again it works for me and makes it so I can live life. You’ll have to forgive me if my views seem a bit unorthodox, but, and I can’t state this enough, it’s what works for me.

hearing the banter between the officers and nurses was so calming. i feel like those moments are probably the best part of their day after all of the serious stuff they deal with.
The nurses were really funny too.
The interactions between the cops, fire fighters & civilians are so wholesome for some reason. Definitely the coolest interactions i've seen between cops and others.
It's so sad to see someone's mind fade that far, to the point where he's oblivious to putting others in danger.

As a seasoned ER RN. This is mostly how we operate, often on a first name basis with fire/ police. We have to work together for the benefit of the patients. Thank you all first responders for what you do! We all love what we do!!

Please everyone check in on your parents, grandparents, and elderly. Sometimes all they need is someone to talk to to keep them happy and from going off the walls. The older we get the less friends and contacts we have, which makes living a lot harder.

The guy clearly elderly and appear to be suffering some sort of illness in his brain. He obviously needs help, because of this illness he quite literally has no control over himself or even knows what he doing. Imagine this was your grandpa or grandma who suffers detmina or some other illness where sytdoms include aggression or confusion.
Yes if you loved ones died many people would take their anger out the easist scape goat mainly being blinded by emtions of losing said loved ones. Thats why victims or people related to the victims are never on a jury panel due to the bias they possibly hold in the case.

A 90 year old man suffering with dementia isn’t the same as an arsonist. Having gone through it with both my grandpa and my dad ….you can’t be sure he is telling you the truth as it could have easily been accidental but his perception and memory of what actually happened blended with something he saw in a movie 20-30 years ago. I’d wait till the investigation was concluded before I accepted his word but wether he did it intentionally or not he needs to be in a state run assisted living home.

The point Al-1279 is making is that the man is clearly suffering from an illness that affects his thought processes. Dementia destroys the brain. Mental illness can completely disrupt thought processes and also damage the brain.
Al-1279 is just explaining the reasoning behind why or how this man may have lit his apartment on fire. The fact that the old man did this does not necessarily mean he's a bad person, or a deliberate arsonist, or someone who enjoys causing chaos. Rather, this man is clearly confused and suffering from illness, and his awareness of his surroundings and actions may be severely impaired.
That doesn't mean damage wasn't caused as a result of this man's actions; it certainly was. But it's critical that we consider the circumstances of these situations when deciding on an appropriate course of action. Is the man a deliberate arsonist? He may require rehabilitation via discipline (i.e. the justice system). Or is the man suffering from dementia? The more appropriate approach would then be rehabilitation via medical care and supervision in a assisted living facility.

Poor guy, hope he gets the help he needs. Despite the incident, I love the teamwork of both departments of the FD and PD on this incident. Seems they have a great relationship with each other. We need more inner agency cooperation between emergency services across the states. It really makes a difference and tasks run much smoothly

I honestly think that most Police, Fire, and EMS get along very well. They work with each other in lots of different kinds of incidents like car wrecks with injuries or entrapment. There is bound to be someplace where politics or some personal grudge has gotten in the way, but I think that is not the norm.

As someone who lives in an apartment, this is one of my biggest nightmares. Especially living in a state that literally has no tenant protections. If my apartment burned down, I’d still be expected to pay rent while they repair it. It’s total BS. You’d have to take it to court if you withhold rent.
I actually had this happen after a hurricane destroyed my apartment in college. They refused to break my lease and still required us to pay rent. I ended up contacting a lawyer, and about three weeks later they got one of their sister complexes to give us a room while they repaired the original one. Never was compensated for the time that I was couch surfing because of nowhere to stay, but FEMA ended up paying us out in the end (so it all worked out).
The teamwork between PD & FD was phenomenal on this one.
These are the happiest people I’ve ever seen. Even the guy who owns the burning apartment complex is having a good time.

At this day and age, I should not be allowed to put a guy in jail at 90 years old if no one died. This man needed a nursing home around 6 years ago.
While dementia may be the cause, I've seen low blood sugar and even urinary tract infections cause similar confusion.

The hospital did suspect UTI and were going to test and treat him for that.

It's actually really cool to see all this mundane chit-chat behind the scenes. To see the police and fire and nurses just being normal folks with normal jobs and dealing with all this insanity. And I know the old guy did a horrible thing, but it's hard not to feel some sympathy for him.

I work in a hospital and the ending part is common in the ER. Psychic patients really make ER staffs job extra difficult.

Vietnam vets got treated pretty bad in the 70s and 80s, but we have done a lot for them since. I have the up most respect for our vets, but their 4 to 8 years of services doesn't entitle them to a paycheck for life. Free medical and education alone is a lot. It wasn't till Vietnam that veterans felt like the government owned them something beyond their years of service that they knew what they were signing up for. Before that they went out and started families and got jobs. I know there was mental health issues and many kids back then felt the wrath of it. The reality is the Boomers had it easier growing up than the Silent and Greatest generation and as a result they just couldn't mentally handle war the same way. I really don't think kids today could handle it at all.

My grandma is 93 years old still lives at home by herself and refuses to move in with anyone or a retirement home. She still DRIVES if you can believe that, it's kind of nuts, but what are you going to do? My mom lives close by so she's always checking in on her and even stays over the night a few times for when she has a lot to do like doctors appointments etc. Her mind is all there but she will occasionally fall. @@joshuazatarain7967

I just started watching this…I don’t know if I’ll be able to finish this. I live in a condominium complex and the guy who lives below me started his kitchen on fire, completely destroying his unit and causing major damage to my unit (the fire came up into my kitchen and then through the roof of the building) and causing smoke and water damage to 4 other units as well. It took 8 months, but I’m back in my condo, but dude still lives below me. The trauma a fire can cause is no joke. I’d take all the other trauma I’ve been through in life over dealing with another fire, especially when it’s preventable.

See, there’s the difference between the police officers saying, “He’s out of it,” and the nurse, “Aw, he’s special.” They’re all showing incredible compassion for someone who destroyed property intentionally and could have caused death and injury, but it’s a different level of respect and understanding that illness can happen to anyone.
If he had damaged my apartment, causing me to lose my home, demented old man or not, I would beat his ass.

It isn’t going to change his behavior or the demons in his head. Maybe his daughter who pays for him to live alone instead of getting him into a home should be at the end of your beating.
You illustrate my point perfectly. Everyone forgets that they could be that man some day. Illness doesn’t discriminate and you don’t have control over it. I hope someone who depends on you never finds themselves in this man’s situation.

he's crazy, it's different from being evil. his mind doesn't work anymore, he needs compassion. he needs to be in a nursing home. you don't expect a child to take care of themselves as much as you can't expect a mentally declining elderly person to take care of themselves.

Absolute kudos to the Officer who suspected a possible UTI.
Anyone taking care of a senior who notices a rapid onset 'dementia' personality shift, take note, it may be as simple as a UTI, it can affect seniors mentally, where nothing more than antibiotics is needed! Unfortunately, this seems to not be the case with this gentleman.
I know what you mean. My elderly mother had a UTI, and she acted really wacky. We learned from the dr, that UTI's are common in seniors. They can cause temporary changes in behavior and speech.
He was suffering from drug abuse not mental Illness, or dementia or any of that. That’s why they charged him. Says everything in the description.

TIA’s are less likely to cause an unusual change in behaviour, since they usually cause temporary stroke symptoms. Urinary tract infections can definitely cause abnormal behaviour in elderly people. I’m a Paramedic & I’ve seen quite a few elderly people affected. There was one woman in particular who was just heartbreaking. She was so well dressed, well groomed & well spoken but she was trying to pinch me, bite me & kick me as I brought her into the hospital. I think if she had any idea how she was behaving, she’d have been absolutely horrified.

Without knowing all the details of the resident’s medical history, calling him “a weirdo” is a bit harsh. You never know what’s going on in someone’s life that causes them to do the things they do especially with the elderly.
It sounds like he's a Vietnam veteran. They also mentioned that he has bruises. I'm thinking that may be a ptsd trigger. I think it took him right back there. He set the fire as a signal fire for extraction.

This happens quite often. Old person lives alone without much contact with people, their mind fades until they're completley senile, people only find out when something like this happens.

@@HTV315 He's 73 and was in a drug induced episode. In his mugshot he's got pick marks all over his face as a result of said drug use. His mind is gone from taking meth. Not because of his age.

If you look up Las Cruces Apartment Arson, you'll find in an affidavit that medical professionals evaluated him, and it did not appear to be a psychological problem but instead a drug induced episode. He had no apparent injuries "as if he'd been in a fight." The cops might have said it looked as if he had on scene, but after thorough evaluation (because he was a danger to himself and others), the hospital didn't treat him for any - noting that "Mr. Hicks delusions were the result of substance abuse rather than the result of another mental illness. "
That's how I know. I also know from seeing it first-hand. And it's sad.

I appreciate how sensitive all the responders were. I've been in a few ERs, and I do appreciate nurses, but those officers and fire people were very gentle.
When I was 15 me and a friend of mine skipped school one day and we were walking around our neighborhood. We saw an older man setting a house on fire. The house had 6 or 7 apartments in it . We were able to wake everyone up and get them out of the house and then we caught the guy down the street and held him until police got there. The news wanted to put me and my friend on tv and interview us as heros but we didn’t want our parents to see us on the news because we had skipped school . So the news even said on tv that 2 young men who didn’t want to be named saved a lot of people that day. I never did tell my parents that it was me and my friend Jeff .

Soo.. in the grand scheme, it’s a BLESSING you and Jeff skipped school that day. Call it divine intervention? If the same happened to my child, skipping school vs right place at right time and saving lives… I’d be a the proudest Mom around.

Wrong! Had he not skipped class that day he would have learned the cure for cancer saving millions of lives! Instead he chose to skip class and in his tiny little life he only managed to save a few suckers and deadbeats living in some old, disgusting, run down apartments. I fully care for and support my mom who has dementia and gets very paranoid. It’s just like any other medical issue as we get older. Some people have bad knees, backs, hearts, cancer, etc. and others may suffer from more mental disorders. They are not “weirdo’s”. I think it’s clear this older gentleman is suffering from some form of mental issues and hopefully someone will get him help. (Jail, getting arrested, etc. are *not* help in this case).
It wasn’t mental issues read the description, it was substance abuse that caused the delusions.

And it's likely the SA happened because he was abandoned. This is why I get angry when I hear of a family abandoning someone, be it a kid, the elderly, or even an adult (if no good reason for doing so).
