Congratulations Alfred for your I-140 approval !!!. I'm using Colombo&Hurd law firm too and my I-140 form was received by USCIS last November 23rd. Now, waiting for the USCIS response, in my case we prepared all my case from Argentina, so after the I-140 approval, I'm going to enter the consular process. I'm STEM Project Manager with 16 years of experience, my endeavor was about promoting the Solar Energy with PV systems in underserved areas, e.g. Florida state. Wow ... he has won against the odds of part 6 of the policy manual. The chance of me giving up on the EB2 process as a teacher after reading that part of the manual would be 98%!

HI Oscar. I have a question. Can i apply for change of status while I am on visit visa in USA? Is there a min period I must stay in USA before applying (Like 3 months) ? Also once I file the ptition, will I get a work permit while waiting for the petition approval?
Hi Aneek, a lot of stuff in your question. The short answer is yes, you can do that and there is a 90 day rule before you submit the I-140..you can google it and read more about it. Regarding the permit, you can only request it once you submit your adjustment of status and it takes time (variable) to receive it. My 2 cents: consult a lawyer if you are going to attempt something as complicated and risky as this.

Hi Oscar, I've mailed my I140 NIW but found the dates of one of the old work experience was off by 2 months on the employment letter versus on my resume. Is it a big problem? That experience was 8 years ago and unrelated to the NIW petition field.
Probably not a problem as it may not even be detected at all. At most, if the officer realizes (unlikely) they will ask about it in an RFE and you'd have to clarify it

@@suirujiang5198 if you requested electronic notification it could happen within 24 hours. Otherwise the letter typically takes a couple of weeks , of course it would be more if you are abroad

If they cashed your money it means they accepted your petition, so now it is just a matter of time they will give you the receipt number. congrats on this first step
Is a post-secondary teacher in a business school considered part of the STEMM fields and eligible for the National Interest Waiver (NIW)?
STEM=science, technology, engineering , math. It's you who have to analyze the NIW requirements and figure if you can meet them

I would say in your case be careful with how you execute your plan, if you want to do adjustment of status read about the 90 day rule first!

Hi, I am here as a language school student, but I get retired as a math HS teacher in my home country, I got my master’s degree on math as well (3,5 GPA) can I apply for NIW if I would have nice endeavor?
Many people can apply if they meet the criteria and can put together a winning endeavor

Hi! I did not prepare his petition so I cannot clarify that. Maybe if he sees the comment he replies, but cannot guarantee that. You are right about teaching though, it's really hard to get an approval, but if your endeavor goes beyond your classroom/school and especially if it has to do with STEM , then you may convince them

Would have been helpful for the teacher audience on your channel as many teachers have failed applying for EB2 NIW. OK I will try posting here to ask Mr Alfred, and I hope he responds.
@@hjgovi in the video he does hint thtat his endeavor is something like: promoting STEM education with a specific group, underepresented populations like Latinos. So it is clear he did state he intends to work in education. The teaching job by itself is not enough to qualify but if your endeavor is framed around STEM and goes beyond the classroom and school where you are, it may rise to the level of "broader impacts"

(not his fault or your fault 😅) I am guessing STEM coaching via his online STEM network who meets on a monthly basis....anyhow, hopefully another teacher gets approval 🙏 as you said, we just need to be more creative.. Yes, it's possible
Yes! This is my 5th SY as J1 and got approved. I have my EAD that I used already so I am not a J1 anymore.

Hi Alfred, so are you still filing for your waiver, I mean the 2- year home requirement?
Hi Evangeline, Alfred says in the video that he was on an H visa when he applied for a green card. He was on J visa before that. If you are on a J visa subject to the 2-year rule, you must obtain a waiver before applying for the green card, or otherwise spend 2 years in your home country before applying.
@@OscarsGreenCard Im just arrived here in USVI under J1 visa and subject for 212 Home Rule. So maybe I am not yet qualified for the NIW application I need to finish the program 3-5 years and spend 2 yrs before apply for EB2 NIW? Thanks
@@arnoldpangilinanpeteacherp755 if you are subject to the 2 years rule you have to either go home for 2 years before re-entering or obtain a waiver for the 2 year rule before trying to adjust status. In case of doubt, contact a lawyer

Hi Oscar, I'm from Canada and I applied to the EB2 NIW, they reviewed my file and they told me that I'm lacking a "Valid Labor Certification". I included the form 9089 in duplicate with N/As where required. But it seems that I need to get a job first, in order for the USCIS to deliver me the green card. Can you help me? No, you don't need a job first. It's either there's a problem with how you filled out the application or the officer made a mistake.

Just wanted to clarify this because there's no explicit statement in your youtube videos about this. Also, the USCIS website states that "You may pay your filing fee and biometric services fee, if applicable, with a credit card issued by a U.S. bank. There is no additional cost to file by credit card. We cannot accept a credit card issued by a foreign bank."
