    2. Consummated the marriage, being together
    3. You too truly want to spend your lives together. Convince a stranger to believe
    4. You must be lawful US citizen
    5. Your income exceeds 125% of poverty level of where you live
    6. You’ve not been convicted of certain crimes
    7. Your foreign spouse is of good moral character
    8. Your foreign spouse have not seriously violated US immigration laws
    9. Your foreign spouse has a valid passport for travel
    10. Your foreign spouse passes the medical

    Dear Mr Whal thank you for all you do. We have decided (we are 55 yr olds me British UK. He, my sponsor & military resident of America) have decided to go down the cr1 route rather than k1.
    2 questions if I may please,? 1. Can I marry him during a visit to him as British tourist in USA,? And once married, do I have to return to my country, UK. Alone, within 90 days? Or can I remain in USA with him, as his new wife, through CR1 process which is where we plan to settle forever - in his home in Az. Thank you. The main plus for CR1 I believe is that hopefully it will allow him to be by my side always, through the whole process (interview/medical/documents all within USA only). This is truly helpful. Thank you Sir.

      You can marry during a visit. You should respect the terms of the visa or visa waiver you traveled on. This normally means returning to home country, newly married or not.

    Great video! I have a question. If I marry my foreign fiancé in a different country such as Canada where my fiancé will be on a work assignment and is from the Philippines. Does my spouse have to go back to the Philippines for the spousal visa process?

      Your spouse can be interviewed at the consulate that handles processing for your spouses country of birth, country of citizenship or country of lawful residence. If you spouse is a resident of Canada then can be interviewed in Montreal.

    Hi sir! We had a proxy marriage in state of Montana last January 8,2022 and we already got a marriage certificate. We have a proof of consummated marriage.We were planning to file for USCIS for CR1. May I ask what should be the possible needed requirements? Thank you so much

      When I work with my clients the first step is to get to know the full details of their situation. Then based on that I prepare a personalized checklist from them of all the documents and evidence that based on my experience we want to put on the consular officers desk on the day of the interview to convince the officer of the couples bona fides.

    Hi Fred, have you heard anything about must having US-based income for the income requirements? I've been working/living in China (Chinese company) for the last several years (with a Chinese bride) so wondering if that could be a potential stumbling block.

    At what point during the application process do we need to show that we consummated the marriage? I’m a US citizen living in China and my Russian fiancé had to go back to Russia I’m February. We got married online in April and submitted the spousal visa paperwork in May. Do we need to arrange a trip to meet sometime during the document reviewing stages or can I fly out to meet her a week or two before her interview?

      The list of crimes that affect a spouse visa are very few. Primarily, any form of child abuse makes the US sponsor ineligible. Other crimes are not an issue.

    We have submitted all the documents to NVC and their status is showing like accepted.
    But our case is just below on financial aspect and they said the councilor officer will make decision on the time of interview regarding this. And secondly they asked for some addition documents like source of income.
    As they are showing all documents are accepted so we are documentary qualified. ?? Or still have to submit the asked documents again.

    Does it matter where we marry to apply for this visa? For example, I am a U.S. citizen and I marry my spouse in the UK who is already a UK citizen or green card holder. But we will be living in the USA. Does that matter? The location of marriage?

      A lawful marriage, regardless of venue is acceptable to US immigration.

    I'm an employee somewhere (in the US) and I'm making enough money to sponsor my wife for a CR1 visa, also I'm starting a small business on the side. When I'm applying for a CR1 visa for my wife, is it possible to go and live with my wife in her country and come back until she gets her Spouse visa? I'm not an expat, I just want to live with my wife while she's waiting to get her visa. My concern is that Immigration says I have left my current job that I have put on the affidavit of support.
    Is there ANY way that I could apply for a CR1 visa for my wife and go and live with her? Do they need to know that I am living with her after I apply for a CR1 visa for my spouse?

      You can certainly go to live with your spouse during the process. And while you are not an Ex-pat yet, once you move to a foreign country that is exactly what you become. Financial evidence is required about a year after applying then at the interview. So if you live outside the country, either you have enough cash assets, home equity, or stable income, or a CO-sponsor when the time comes to demonstrate eligibility.

    Hey visa coach, I have a question for you but because of my previous postings out of anger, I don’t expect you to reply but I will give it a shot. My k1 visa petition has started moving since my last posting and the ceac website now states that my case is ready. My lawyer’s secretary will work on my ds160 for my Filipino fiancée when she gets back from vacation. She said I could go ahead and pay the next set of fees required before the ds160 can be filed. The problem is that the website will not finish the process after I have entered the case number and invoice number that the nvc had given me. It just keeps going back to the beginning of the process where you enter the case number. I tried calling the nvc but they are closed due to inclement weather and will open back up on Monday. Have any of your clients experienced this issue as well? Once again I realize you might not feel like replying back to me due to my rather explosive previous postings and I understand your position if that is the case. I just wanted to try and see what you might say about the ceac website issue.

      The US consulate in Manila is a guest in the Philippines. As a guest they respect local laws. As Philippines does not recognize same sex marriage it is unlikely that the consulate will. Confirm by speaking with the consular officers directly, or hire an immigration attorney for advice and possibly to fight this policy.

    I have a question. My wife and I got married online. We have a marriage license from the state of Utah. I have also went and visited and consummated the marriage. We have an abundance of pictures to prove we are together. I have gathered all documents. I have sent the ROM to Philippines consulate in San Francisco. Filipino visa has a copy of our marriage license. But says we have to wait and get a marriage contract from PSA after ROM is filed? Is that true? I have heard it could take a year before it’s available from PSA. Wish I had known about you before hiring them.

      To be successful US immigration must be convinced that your relationship is "bona fide" not a sham for immigration purposes. The closer your case follows cultural norms and expectations the more likely the visa will be granted.

      Yes, you can apply for a spouse visa. By the time it is granted your marriage will be well over 2 years old, so the visa that will be issued is the IR1

      An Alien Spouse who marries an American and is a lawful permanent resident in the USA (still married to the same American) is eligible to apply for US citizenship. If Citizenship is granted, the alien becomes a US citizen and can apply for a US passport.

    My partner is visiting me on an ESTA and just proposed to me on my birthday. Can my fiance marry me while he is visiting USA on his ESTA? He still plans to leave at the end of his ESTA and go back to his home country, and we will then file for a CR1 VISA while he is back in Iceland. He will take those 2 years to focus on settling his personal belongings and working. Would this be legal and successful? Or, do we need to marry out of the country and THEN file for a CR1 VISA? We had no intent to marry upon his visit, but we don't want to seem shady to the government...

      Your plans are fine. He can certainly marry you in USA during his visit. The "key" issue is that he does not plan to overstay, instead he plans to leave and then apply for the CR1 visa. Me and my wife Joyce did exactly that. We came to USA for the holidays, invited my family to meet us in Las Vegas, we got married, celebrated with them, then after the honeymoon returned to Hong Kong, and eventually applied for the spouse visa.     Please overlook my weird username visa coach. I’m not here for myself but for a friend who doesn’t have a CZcams account. This question is referring to the k1 visa process so it’s different than the subject of this video. Here is the question, does the Manila embassy in the Philippines contact the petitioner as well as the beneficiary to schedule the interview for the k1 visa process or do either of them have to schedule the interview for themselves? My friend that I spoke of is receiving conflicting information from other sources and he is confused about this. Also he told me that the Manila embassy does not have his fiancée email or phone number because the initial paperwork did not request it. But he just recently received an email from the nvc that his k1 application is being sent to the Manila embassy and he wants to find out this information before things start rolling. Any information you can give me to pass to him will be appreciated visa coach. And again I apologize for my weird username.

      The petitioner and/or beneficiary for fiance visa schedule the interview. The consulate might contact them via email, but often the NVC letter is the only notice they get. If your friend needs help, ask her/him to hire professional assistance, such as that which is provided by me.

    👆👆I truly feel like being single now, is actually a sign that we are choosing to do the work. Rather than get in a relationship broken and toxic expecting others to love the parts of us, that we don't even love.
    Being single for me is intentional and the struggle is fighting my default of thinking I need to be in relationship or something is wrong . I've never been so happy with myself in my entire life as I've been these last 2.5 years of my single season, Wasn't funny when i saw all her text messages and logs, thanks to savvy pentsters for shedding light to what wasn't cleared at first

    Hey visa coach, I'm going to ask this as politely as I can. Are you still working with k1 visas or have you completely decided to kick k1 visa applicants to the back burner? I am asking you this because your last couple of videos have been all about helping with spousel visas and for those who are already married. But it honestly appears that you have totally forgotten about and disregarded the k1 visa applicants. Again I am trying my best to be polite with you about this due to the fact that most embassies and most immigration agencies have totally stopped working with k1 visas because of the covid epidemic. Just remember visa coach, we didn't cause the covid epidemic and we didn't ask for it to happen. I personally have not used your services as I already have a lawyer but my point is that I seriously think that if you don't intend to make any more videos about k1 visas or even help them, then the least you can do is to announce that you are no longer working with k1 visa applications so they won't waste their time considering you or watching your videos. You are not the only immigration person I have replied to about this issue on CZcams. I am just trying to politely ask you to tell k1 visa applicants that you are no longer able to help them if that is the case.

And you say not to read too much into your recent postings about spouse visas. What are people supposed to think when this is all you have been talking about for the past few months Fred?? You have said nothing about k1 visas for several months now. How about at least act like you care and start doing some postings on the k1 visa process and try and get some updates. Is this too much to ask for you?? K1 visa applicants are getting screwed right now and it would be nice if you post some stuff to show that you give a crap. You stated that fiancée visas are alive and well. At this point I will strongly disagree with you about that.

      I note that you have hired a lawyer to guide you. That means you are actively financially supporting a competitor, and at the same whining that I do not provide you personally enough free advice. Wow !!

      @@Visacoach I will first say that my fiancee and I are having problems and there is a possibility that I will be calling the process off very shortly. 2nd, counting my lawyer, I personally don't think any of you k1 visa people are worth anything. I have been getting more advice from visajourney than my lawyer and you combined. But again I will probably be calling off my engagement very soon because my fiancee is playing games and I will not go through with that. So I will not be engaging any more advice from anyone. But say what you want about me. I have noticed that it took me and others to get on you about the k1 visa process to make you finally do another video. So you are not exactly in a position to be putting anyone down either visa coach. But I have said what I wanted and I'm done with you so have a good day and continue with your games with someone else. I'm not playing them anymore and you don't need to reply back.
