I had a talk with my employer because, as a single mom, no one was keeping my daughter's call from me when she got home from school. I explained that if something happened to her and I couldn't be reached, or if I was told not to answer her, I would be filing a lawsuit. Never missed a call from my daughter again and I made sure she didn't abuse calling me at work.
"No, I don't need you to show me your contract."
Then we're done here.

That's the law if your on call. You are limiting your personal life, EX. no alcohol, no traveling over a certain distance away from work location, having to maintain access to a vehicle, possible connectivity requirements, and depending on the business having a clean suit available to meet with clients. Just in order to be able to immediately respond to the company's "Call"
And as it’s over your contracted hours, it should be paid at time and a half
and yet the same cellphone policy doesn't seem to apply to leadership... funny how that works out
Same policy applied 180 degrees around. There are penalties if a worker allows work to intrude too much into rest or family time.

If I had had this mindset earlier in life, things would have been different.

I’d be leaving it in the drawer for the desk at work. Seeing how they are not paying me off the clock. I never answered my phone when I was in work. So they definitely don’t have hope for me to take their call when I’m off the clock
And then there is me that ships like 15 cell phones a week to new employees

The real reason they don't want you to have your phone out is because they're averse to audio recording such as when they want to deny having said something to you or they don't want to deal with bullying so they make it harder for you to collect evidence.
I worked on a TV show running a writers room, and first day the honcho told me “put your cell phone away while in the room. No iPads either.” I said, “the last person who tole me to put down the phone with effect was my mother. She passed ten years ago. Anything else?”
“Tole” you? With that level of education, McDonalds is better for you. In fact, McDonalds is too good for you. Maybe they still hire grave diggers?

This is a problem with feminism and women’s struggle to both provide family and work!
It’s more to standing up for yourself than being a woman, these big companies think that they own you and they expect for you to be on their beck and call 24/7. I believe that the mobile (cell) phone was the worst thing ever invented for the workers. As their employers think they have the right to contact you round the clock. They have forgotten that they only pay you for a fix amount of time
If you’re salaried, your contract probably has a clause for occasional prolonged or irregular work hours.
Not for that kind of work. Salaried doesn't mean no overtime and they can contact you at any time. In this scenario the contract stated "9-5". That's the schedule, salaried or not.
If your boss can tell you “No phones allowed out.” then you aren’t in enough control of your work product to be an exempt employee.
@@QuiteComtrarythis. Even if such a clause was in the contract I’m not sure it would hold up in court. While it varies from jurisdiction to jurisdiction, you often can’t sign certain rights away. Salaried doesn’t mean exempt.
Salaried doesnt mean the boss owns you 24 hours a day. Repeat after me: I am an employee not a slave.
@@Sonnabend00 it really doesn’t. And the more of us that stick to our guns, the harder it is for them to pull this crap. And with a lot of Gen. Zers unwilling to play these games we’ve got some of the best odds we’ve had in a while at creating a more balanced power dynamic between employees and employers. I have been salaried for a number of years in my career but I didn’t work uncompensated OT. To be fair, part of it was some of that time was spent at a company that understood the law and adhered to it. But I’ve definitely pushed back. The criteria for being exempt extends well beyond simply receiving a salary.
