    But Alan, could you please speak to the implications of the presidential records at? Because comparing Trump to Biden and Pence is not entirely accurate because the latter two had no right to take records. And Biden did so when he was vice president and in the Senate, and he oversaw the movement of these documents from location to location to location, so he clearly knew they existed. That situation is entirely different than what we're talkin about at Mar-A-Lago

    If there happens to be a good lawyer judge ect, that happens to read this. I have a question about due process, in reguards to Trump. Nothing in depth, just In this Polarized time, Can Trump legally be judged by a jury of his peers? I ask because the jury is supposed tobe unbias, which is impossible, and to have not already made their mind up on guilt or innocense which again, seems impossible.

    Up to: 02:23 Allan has a better mind than that - it deserves additional comment. He knows the difference between fabricating a story for an agenda (more on that) and intending harm to the Dersh personally. And he should point out that this perspective is itself untenable. That it justifies any action and harm - personal or otherwise. So that is the first point - that the level of harm still matters. And he should also say, are they sitting there going, "poor Dersh - he got in the way of war-rules of politics!"? Maybe. Which is the innermost crux of the matter - is this behavior of "war rules" justification for committing a harm against a person? I think the answer is that this is in fact a well-accepted legally tolerated risk. And that "lying" is a "tradition" (currently) upheld by a solid 50% of the population.
    IMO based on the current structure of legal Reality, as far as malice is concerned, Dersh did just get in the way. And the case he is bringing is not about election interference or something like that - it's a defamation case. And - it doesn't meet that standard. I'll bet he loses the appeal.
    I'm going to extend and expand this since its for my research in legal philosophy, but it may apply:
    In the event that there is pecuniary business interest driving (a presumptively corrupt) "desire" to slander or gaslight a victim, even to criminalize him in spite of no crime and no law ("positive law") that permits it - does this remove *liability* for defamation. Obviously not.
    A couple of arguments here -
    First - a case is raised based on the severity of harm inflicted on the plaintiff. How seriously was the plaintiff injured?
    Second, is there another legal theory that takes precedence, or can or should take precedence other than "Defamation"?
    As to level of injury, was it petty? As this defense might argue? If it was petty as in Dersh's case (i mean - come-on, pull 'em up!) is there a social need for exemplary sanction (above and beyond actual damages?) As a kind of guiding stick to news outlets to not tolerate, excuse, or defend such actions (other than to contest the amount of "punishment" it deserves.)
    As to an alternative legal theory, is the practice positively permitted? Or is it even in part or whole in distinct violation of law?
    If it falls into the middle ground between these, is it still untenable, unsupportable, or outrageous?
    Does it "conspire" to create other harms for the plaintiff until corrected? (Does it result in other harms? Even abstract ones like denial of constitutional rights, or even imprisonment?)
    Ultimately the Supremes may clarify "Malice" by inclusion of some idea of foreknowledge of outcome by parameters like those I have shown here. Which does not eliminate the innate "mind reading" requirement, but would extend how it might be defined.
    Last word: Until AGI can produce a probabilistic script of the thoughts during the commission of the crime by the accused (which is not impossible in my experience,) the interplay of the alternative theories may be "incorporable" as at least a parallel solution or theory. Especially since meeting the element of Malice even if proven or admitted, seems arbitrarily binary, which these ideas would also amend. Thus the "reasonability" rule of negligence and strict liability should rise to an entirely sufficient level for the plaintiff - still based on the actual harm done, and reasonably assessed.

    In the past week AD has done one specific thing that he cannot justify. He appeared with Alec Jones on his show. He knows exactly who Alec Jones and the nature of his supporters. He knows exactly the lies and false conspiracies he has promoted. He cannot defend his appearance on the basis of integrity of the system or the constitution or that if he did not appear his message or analysis would not be heard. The only reason he attended was because of his own ego and inability to resist any chance for publicity.
