- The plaintiff hosted a wine and paint party at the defendant’s house. He claims the defendant wouldn’t pay him because he refused to strip for her and her friends, so he’s suing for the remainder owed. The defendant argued the plaintiff showed up late and didn’t even bring enough paint with him, so she doesn’t think she owes him.

I'm fairly sure he said 35/person (when he provides everything) is his usual, but he did this as a special since there were so many and the lady bought the easels - he just provided paint. I may have misunderstood.

Common sense tells me that he had an initial fee that had to be met and then each person who painted had to be another $10.
The fact that he mentioned, and he seemed very believable, that he charge $35 a person when it was done in his studio is testimony enough for me. I think the judge was wrong. She didn’t use common sense.
I think if she would’ve asked him are you willing to do this for $10 a person he would’ve said no way. It’s not worth my time. My expertise. My artistic ability. To me that’s common sense.

It seems more than fair considering she provided the canvases. Easels are reusable. Canvases are not. Unless she lived further away and it’ll cost in gas money, it seemed reasonable

She seems like she was acting like he should do whatever she wanted. Also, $200 is ridiculous for someone to come to your house & teach & bring paint. She doesn't care about his time, it's a shame that the contract wasn't clear. I think that people trust people that they think have money , but rich people are often the stingiest people. I can guarantee that that guy wants nothing to do with future business with this woman. Hopefully, other vendors will stay clear of her.

Having a sip and paint private parties are so expensive. It's not possible to get it for $10/ person and ask him to bring everything, that sounds crazy to me. The guy won't be making any money!

According to the defendant she brought everything, he only supplied the paint and the location (and the easels which wouldn't cost him anything as he would already have them) and he didn't dispute that, so I'm guessing she wasn't lying.

That's crazy. Why would he take $200 to host a sip and paint for 20 (+) people but he charges $35 per person in his own establishment? I know that only 12 guests painted, but it's difficult to get ADULTS to behave in a large setting. Then he had to travel there, that's gas and toll(?), he has to set up at her venue, even if it only takes 15 minutes and then she wasn't even there and he was welcoming her guests in. $320 is $100 less than the $420 she would have paid if they went to his establishment. smh

Yes and no. 200 in deposit whether its 1 girl or 20 it is still 200. As you can see, there were only 12 girls and he still made 200 so you are wrong and dont understand the terms of that contract.
Its not 10 dollars per girl. Now where she got him was after that, the price should be higher for individually priced guests versus a bulk or group setting and that is where he should have gone to 20 or back to his 35 dollars.
All she had done is guarantee that he will not make less than 200 dollars based on a group pricing and if only 1 girl wanted to paint, she would still have to pay him 200!
So multi-million dollar house, hired strippers for a party, bought 70 canvases for 20 people, he gave her a painting, and then screwed the guy out of his 120. In spite of all her husband's money, she is a very poor person. She should have tipped him 500 that he didn't go to the police for sexual harassment.

I have an interesting little story about contracts. I used to own a very small general store. I hired a young man who was just starting his handyman business to do a couple of basic things, painting, some minor woodworking, and installing a couple of lights. The light installation was nothing more than screwing lights to a wall. No electrical work involved. We had to wait for the lights to come in, but everything else was done. When the lights came in, two weeks after all the work was done, I called the contractor. He came down, did the work, and then asked to be paid. I told him, let's look at the contract. And I had already paid for the light installation in the contract. He agreed with me, installed the lights, and that was that. Had we not had a contract, he could have walked away without installing the lights.
After that, I explain to him how important it was for him to have a contract for every single job. I also told him that if somebody wants more work, have a separate form called a change order so that you and the customer are clear the scope of the work and what you'll be paid.

I've gone to these painting parties. They are expensive. It's not a party for strippers!! That's not the right setting for that. It's tacky. It's more mellow and the artists go around helping the guests plus it's weird for people not to paint because that's the whole purpose and there is nothing else to do.

The male artist at 190lbs would be able to vacate a room of 150 lb partaking Karans; he may be uncomfortable but he is relatively assured an exit if need be. The role reversal of a attractive woman artist surrounded by out of shape 230 lb intoxicated men; getting frisky is very dangerous for the female artist. It may not be fair, but a women artist is much more at risk than a male arrest. So no, it is not the same; legally it should be the same, but realistically it is not.

First she said she wanted someone good looking instead of a female because she was having a girl's night and then later on she commented about how the strippers were better looking than him. She's trash. He wasn't thinking straight with all the strippers and asking him to take his shirt off, etc. That's not how those paint parties usually go. They aren't supposed to be wild.

go online and see what a Paint party normally costs. Sure she might have supplies some of the stuff - and even if she provided EVERYTHING it wouldn't be 10 bucks a person. This guy is a professional artist - experts cost money. I'm surprised he didin't bring any of his other contracts with him - or if he didn't have one - then an affidavit from someone who hired him previously to prove what he normally charges.

$10 per person doesn't equate to $200 judge. He even said he adjusted his invoice for those who were ACTUALLY painting. This guy has no business sense. Way undervalued. The whole per person method is absurd. Just quote a flat rate base on her scope. It should have been about 1,000 for the day. Weather 15-20 show up is irrelevant.
The only way $200 would be reasonable is if she provided ALL the supplies. He likely brought $100 of just paint. That’s only $25 an hour for a four hour party which is too low. He needs a contract.
Truthfully the $320 he was expecting is too low. Those strippers made way more than that and likely only put in an hours worth of work.
She’s one of those, “give me a deal and I’ll use you in the future” types. You could hear it at the interview with Doug. Those deals generally don’t work out because folks get entitled and try to negotiate down from the bargain basement price as opposed to the market price. Also, you are not dressing me in a costume like I am a toy dog, touching me, or asking me to strip either. That’s all foul and inappropriate.
Considering he gave her the painting she begged for, I would have just paid the invoice, considered it a tip to cover the misunderstanding and not used him again. I’m not having a vendor take me to court over $120. My time is worth more than that. Even asking to split the difference and settling for $60 would have made more sense.
