I have resigned on the notice of 7 days so company is asking for 23 days of recovery amount but they are not calculating on basic salary but they are asking me to pay the monthly payable amount whatever I receive in hand ... Is it valid?

In your case, there is a term called Notice period Buy out OR Buy out notice period. This is actually done by the company that you are about to join. If they want you asap then they will have to pay the remaining notice pay amount to your current company to buy you out from that company.

1. My notice period is 90 days and am ready to serve full notice period .But employer is giving an early relieve from company . How can I ask for Remaining notice period salary payment and how to approach legally if HR is denying to pay.
2. I am eligible for gratuity at end of actual notice period and am willing to serve full notice ,However company is giving early relieve to avoid gratuity . Can I still demand for gratuity as am eligible had I served full notice period. If Hr is denying for this how to approach legally or professionaly .

Hi, If your employer is giving an early relieving to you then they should pay u the remaining amount of ur notice period. And same goes with the Gratuity amount. Speak to ur HR on the same but still if they don't budge. Then u can take a legal action against them by approaching a labour law lawyer. In this regards I find www.kaanoon.com/india-labour-law

I was working in bpo and I got offer from different company. I resigned and my notice period is 2 months(60days). I resigned on 20th April 2023 and my last working day as per system was 18th June 2023. And the other company had offered me to join from 31st May. So I left the company without serving the full notice period(worked till 30th in bpo company). And I am ready to pay the recovery amount.
Sir I need your suggestion can I change my last working day to 30th may and not 18th June bcos I joined different company on 31st may. Is there possibility to change the last working day?
There nothing much you can do but atleast you can speak to your HR and your reporting manager. If they agree then it may happen.

Hi sir, i was working at a private school as teacher. The management don't want me to leave and i was ready to serve the notice period of 90 days as mentioned in my confirmation letter but after mentioning about my resignation principal started harassing me and insulting me in front of other staffs and even removed me from official watsap group and i really don't want to serve the notice period anymore and i did sent them my notice period throught mail and they declined it and said they are gonna sue me and i have to pay 3 months salary and compensation for loss and damages etc. I don't want their experience certificate and all but need peace of mind..is it ok if i tell them to sue me and face the consequences? They cant do that, since u have allready given ur resignation and was ready to serve the notice. But due to bad behaviour u r not able to. If they still harass u. U should file a complaint with the labour court.

Both are different but some companies only give relieving letter which will have a title of relieving cum experience letter. In your case if you are only getting relieving then u should must ask the HR to put the title as mentioned.

Notice per recovery does exist. But if they have terminated you then they shouldn't be asking for any notice period recovery amount.

The notice pay deduction has to be done on the basis of your company's terms & conditions of Employment & this is only the basic one and not gross.+HRA). Look for a clause in the appointment letter issued by the company at the time of joining and then do as mentioned there.

Since ur reason is genuine, you should try serving the notice period else try to buy out ur notice period after consulting ur HR. Notice pay recovery is only asked when u have left the company without serving ur notice period.
