    If you are going to make changes--construction/destruction to anything on a property line then it is YOU you gets the survey BEFORE work starts.

    The right thing to do is to get a survey done BEFORE you start ripping apart fences on property lines. Not tear it down first, then tell the neighbor to pay for a surveyor.

    She knew that was his fence. She's too smart not to know. No one in their right mind is going to spend $10k on a fence without knowing where they can build it. She was hoping to just put up a nicer looking fence and he wouldn't say anything.

      JM asked the defendant to provide examples of the plaintiff's previous actions that made her felt that he was creepy. She didn't volunteer the information about the "love letter" out of thin air. And yes, a neighbor keeping track of when you leave your home and coming home IS creepy.

    As a surveyor….for the love of god get a survey. New home? Survey. New neighbor moving in? Present them a copy of the survey. Any hint whatsoever of a neighbor getting antsy about a property line….get a survey.
    And I’m not saying this to drum up business for the profession. I can write a book of all the crazy shit ppl do and how absolutely positively INSANE ppl get over a boundary line. I’m a 5’4, 120lb Native American woman and I’ve been shot TWICE with rock salt from a shotgun because some crazy ass farmer erroneously thought he owned the entire countryside 🙄🙄🙄

    Many times the value of a property is by square feet. So even the slightest amount of encroachment can ruin someone's property value....which affects taxes, mortgage rates and everything else.

      Not only that but in many jurisdictions a fence or even a widened paved driveway placement that is past the original property boundary and left in place for several years without any complaints / objections it can become the new legal property line regardless of the what the original survey shows. In my county the time period is 12 years.

      @@pmabroukshe wasn’t, idk if we watched the same case but it seems like the defendant has a past incident with the plaintiff to which she involved the cops because he made her uncomfortable. They stop speaking for 4-5 years and you know the rest, she wasn’t butchering his name for feeling like this case was deeply rooted.

      No she didn't. The idiots removed a fence where she was unsure who it belonged to. She was cheap. Unless you're 100% sure who it belongs to you talk to your neighbor, if there's a dispute you get a survey done. They didn't feel like paying for a survey and now they have to pay him two grand.

    I had a neighbor try to bully me over a fence, I had the original survey of the property which she said was too old and therefore invalid - hello, land does not change over years so the boundries will forever be the same. Why should the plaintiff have to pay for the survey. When you build a fence, you place it in your side of the property line and it is part of your property

      False. In CA the ground shifts and property line can change over time. I had a nasty neighbor demand we get a survey because she wanted to expand her driveway because she needed extra parking.
      I refused because I aint paying for shit. Will, they decided to pay for it hoping to get more land, but it turns out, the fence was encroaching 2 ft into my land. Lmfao.
      I told them we can leave it the way it, or they must be to have a new fence put up. I have a copy of the survey and framed it on my side of the wall. Yes I am that petty. They see it everytime the pull up to park on the curb.

    You couldn't put up a fence until you had a new survey done in my old town and the fence had to be so many feet from the property line. It may not seem like much of an issue to some but when you go to sell your home - the buyers may have an issue if the neighbor's fence is encroaching on their yard.

      I don't know who I believe at this point but I'm kind of interested if the picture she took of the check has a time stamp because if it was taken recently then we know it's fake. But yeah I see what you're saying and I think it's definitely possible he wrote the letter.

    She's very smart, but too cheap to get someone to review the survey. She could've gone to the city zoning department for free or paid an expert $50 and they would've told her that the thick black line with the letter F means the fence is on his property.

    I know zoning laws can very from city to city. In my city, you can't put a fence on a property line. The post holes and the cement holding the posts in place must be on your property. That way, the fence itself is most likely three inches or so inside your property. When in doubt, get the property surveyed before you do anything.

      In most areas of Australia the cost of a fence is shared equally, if you can't come to an agreement it is decided at a tribunal.

      @@mickm6309 In the US, you're supposed to get a property survey before you put up a fence, building, shed or even landscaping. A lot of problems arise when one party assumes that their property lines are somewhere where they are not.

      Though, we can still have crazy fencing wars in Aus. Many years ago, I bought an old house with existing fencing. On one side, there were THREE fences! On my side was a 6 ft wooden fence. Then, one inch away is a 4 ft rotten timber posts and torn rusty chain link fence. Next to that was a nice 6 ft metal panel fence. I was puzzled, but, oh well. My 6 ft timber fence was also rotten and falling down. We had young children, so the first thing we did was start to remove these hazards. I knew the 4 ft middle fence had to be the original boundary fence. I called the local council and received permission to remove the boundary fence as the posts were on my land, AND it was a legitimate hazard. We then put up a new 6 ft wooden fence on the unfenced part of our property. Our neighbours were furious. Now, I thought there would be a problem with them, which is why I contacted the local council. I introduced myself shortly after we moved in, and I was told the story of the fences. Well, 10 years previously, they wanted to replace the boundary fence with the metal fence. The previous owners of my house refused to go half. A big fight ensued, and the neighbours lost. They then built the new fence beside the property line and left the old fence in place. The previous owners of my place then built a 6 ft wooden ' Spite' fence on their side of the boundary fence! SMH. The neighbours then told me that as I now own the house.... I owe them for half the cost of their 10 year old fence. I said NO and left shortly after. About 2 weeks later, I received a letter from a solicitor demanding the money. I call, said NO, end of the matter. Nope. After removing the two rotten fences, we did not put up another fence along that side. I was not going to waste money and labour building another 'Spite' fence! The neighbours were furious because.... we were stealing and having the use of their land! They were referring to the 4 inch wide strip of land between the metal fence posts. WTF. Long story short, they went to court and got an injunction against me to prevent me from..."building any structures on their property." The 4 inches! I laughed when I received the letter. Not a problem. I planted a garden. 🌻 This happened a little over 39 years ago, and I still chuckle about it sometimes.

    People don't put fences on a property line, because the neighbor could come along and say they don't want it and rip it out. When you put in a fence you put it on your own property by just a little to avoid this

    My elderly neighbor who was Iranian would leave love notes on my door and it really freaked me out. He asked many women in my building to marry him. He was a strange man and I did my best to avoid him. Some old men are just downright unhinged.

    Whether or not the letter/cheque incident was true, it was 4 years before the fence and has nothing to do with the current legal issue.
    And it was interesting to see how she kept interrupting her father when he tried to speak. I think she's used to getting her own way most of the time (only child?), and thought that would be the case this time also.

    These idiots could’ve simply built their damn fence on their own property on the inside of their property, and never once touch that guy’s fence at all and none of this would’ve happened
    With my background in construction, we often just put the polls up and run a string and that’s what we think is the boundary line the best we can figure
    More than once in a while, somebody who’s buying a lot comes over and moves our stuff around 6 inches or a foot either way, trying to give them selves more property so when we put the fencing, we think we’re right down the boundary line but we’re literally stealing a foot and a half from somebody else because someone messed around with our stuff
    So yeah, sometimes you find out these lines rough but not generally very much one way or the other
    Plus after so much time there’s a concept of abandonment
    This would be a cottage industry they were going around, rebuilding all these fences in order to get your 6 inches
    But if they would’ve just built a brick, whatever they wanted to order a new fence or whatever they wanted to on the inside of their property and put four or 6 inches between that and his fence, there’d be no problem and no reason to ever have a problem because he didn’t give a shit what you did on your property he just didn’t want you touching the fucking fence

      Winging it where you "think" the boundary line is not the way to go and can cause a neighbor to get upset rightfully so in some jurisdictions. In the county where I live after a fence or paved driveway has been in place for 12 years or longer with no complaints that becomes the new legal boundary line regardless of what the original survey shows. For homes on a very small lot in a subdivision a foot and half boundary movement is a lot to lose (or gain).

    Yes, the defendants were wrong to rip down the fence without doing a survey & as they are doing the construction, the onus is on them to do the survey & pay for it.
    However. I do not see the point of the lawsuit at all, because the defendant was going to put back up a fence anyway. So what is the point of suing for a fence when the defendant was going to erect one?
    And I am sure that the one they were going to erect was going to be better & more expensive than the $2000 one the plaintiff choose.
    But...that is what happens when you live around miserable older people.

    If someone constructs a fence or building, they are squatting. It can render loss of footage because of the setback of 15 feet from the property line.. I had this happen where a neighbor built a chimney on my side and they said I could knock it down.
