- In a big setback for Delhi Chief Minister Arvind Kejriwal, the Delhi High Court on Friday paused a lower court's order granting him bail in a money laundering case linked to the now scrapped excise policy. The Enforcement Directorate (ED) had challenged the trial court's bail order.
The Delhi High Court has reserved its order after hearing both sides. The Delhi Chief Minister will remain in Tihar jail for now.

I'm curious about the conviction rate of the Enforcement Directorate (ED) in the top 20 cases they've initiated over the past five years. I haven't seen any politicians accused by the ED who have been convicted and jailed. Why does it take so long for the ED to file chargesheets against the culprits?

The Enforcement Directorate (ED) deals with cases of economic importance. However, if we categorize the cases into subsets such as economic offenses, bank frauds, money laundering, etc., the percentage of cases in each subset differs. For instance, if we focus on a specific subset, such as money laundering, the rates can further vary depending on which stage of the case we use as a denominator.
The stages include the number of
- complaints made to ED
- chargesheets filed by ED (which can be different from complaints as multiple complaints can lead to a single chargesheet and vice versa)
- arrests made by ED (which is much lower than the number of chargesheets)
- total cases including incomplete cases languishing in various courts (even if the trail court clears/penalises the party, the party that doesn't accept the verdict can continue to challenge it in the same or higher courts)
- completed cases (punishments/acquittals with no further challenges)
If we consider the completed cases, their conviction rate is above 95%. However, when based on complaints made or charges filed, the conviction rate is less than 5%. The significant difference in the choice of denominators is often exploited by interested parties.
It's essential and crucial to remind ourself that this pattern is universal and not specific to any particular group or a particular country. When politicians are the aggrieved party, they move up the stage ladder, very slowly and this pattern is also universal. The concept of swift justice in civil cases, is a legal, practical, and theoretical impossibility.

It's better to Kejriwal to stay in court till the final judgment is pronounced since he has no individual portfolio in the government though he is the CM of Delhi. Moreover, it is inferred that he is not fully co-operate with the investigating agencies and also not informed his password pertaining to his 170 iPhones and his Laptop. So we come to the conclusion that he is hiding the facts and so staying in jail must so as to protect the evidences.
In chara ghotala Lalu was jailed for years. Partha Chatterjee has been arrested for years. Why should Kejriwal be mollycoddled??
