    I have learning difficulties and was on DLA from the age of 9 and had a life time award and went to special schools and now asked to change over to PIP and fail the assessment and last Monday had a tribunal and they failed me to... but you know what I’m not giving up 11 months I have been though hell , they can’t do this to people who honestly need it so I’m going to apply to upper court .. DWP can’t treat people with learning difficulties and mental health problems .. hope everyone gets what they deserve

    If I could give a tip to anyone who applies for PIP remember they extenuate or focus on the positives, for example if you say I can stand for 5 to 10 minutes they will say “can stand for 10 minutes with no problem”. If you say I have major problems with showering or bathing they will say minor problem keeping clean. If that makes sense. You need to do the same. Don’t give the assessor the opportunity to elaborate on the positives.

    The same happened to me. I had no points from Capita. I asked for a reconsideration and sent a doctors a letter and relatives testimony letter that I used for ESA and got awarded basic PIP which I didn't think I would get. I only wanted lower mobility .The interviewers are useless. You can get it reconsidered with more evidence or go to appeal. I won an appeal once. Depends on the decision maker you get or the Judge. Some are better than others

    most of the people on these panels making the decisions have absolutely no clue what actually people suffer from.
    I've been diagnosed with Anxiety/Panic Disorder, Depression as well as Agoraphobia and my day to life is 100% effected yet that's me now having to look forward to my 2 appeal, the system is all to hell and certainly needs to be looked at as genuine claims get refused.

    I know your vlog was created some time ago but I wanted to pick up on the point you made about them being nice to you. I was told when I went for the meeting that it was important that I finish the interview\assessment. Although I was in a total panic attack and crying I finished it so I would get my benefit but when they refused me, one of the negatives mentioned was that I was well enough to finish the interview. I think that was a horrible thing to do to someone, they put me under immense pressure to finish but when I did they marked me down. I hoped you appealed x

    i got my pip letter last week and i`m fuming. i got zero points for every single question. the assessor has lied and made up comments that were not discussed. i am in the process of mandatory reconsideration and also making an official complaint re the assessor for her misleading lies. i have a written report about the assessors notes and it unbelievable what she has written down, i will also be asking the assessment bodies to compare her notes and recommendations with the recording of the assessment. its disgraceful that people like that work for pip, i`m gutted and its sent me spiralling into a darker place than i was before.

      Darren it happened to me. I was on DLA with a indefinite award for years. I was assessed for PIP, by a Paramedic. I got 4 points only. I asked for the report, some parts of what she put down were lies. I had to go through the appeal process, which took 12 months. The stress got to me. I had help with my appeal from the Law Centre. No Dwp representative was at my appeal. I had a great Judge, Doctor, and Disability lady. I was awarded standard Care and mobility. They had to give me back pay which was £6000. But I bloody struggled for that 12 months. As a Celiac, and having to buy special food was expensive on just a fortnightly ESA Payment, not to mention Chiropractor appointments for my Neck and lower back arthritis, which are expensive. What I didn't get about the report was at the end the accessor stated that my condition will only get worse over time so would recommend a " light Touch Review ' light Touch Reviews are for claimants who's condition is not likely to get better, so why only 4 bloody points. You need to fight for what is rightfully yours, it seems a lot of people are getting 0 points. It's disgraceful. I think the DWP , think that we won't appeal as it is to stressful for the claimant. Get help Darren. I've just filled in my PIP Review Form, and dreading the outcome. It's a waiting game. The things we have to go through when you have health issues is so dam depressing. But I will appeal again if I have to. I have the best support network organisation who will help me. All the best.

    If you have the medical records to prove your conditions then do appeal. They look at my son aand because he can move his arms and legs he is ok. That is far, far from the truth. It has been a uphill struggle. I know I have had to fight for my son his whole life to the point where I could bang my head against the wall. If you truly believe you have a disability then do not give up...that is what they want you to do. If you fail after an appeal then I am not sure but do get the medical evidence to back you up.

  • @Mike--Oxmall

    Dont take this the wrong way but I know exactly what your problem was, it was because of what you said. You need to be completely negative and rack up those points. You also need to study the marking criteria which you can look up, make each of your answers fit to those points each time. For example if they ask are you able to cook food for yourself you could answer something like "no Im too afraid to cook for myself because of my depression I just cant stop thinking about killing myself, once I burned myself pretty badly on my leg and almost burnt the house down, I might try it again, my mum has to bring me food and im not allowed near the kitchen."
    Did you see how I handled that? I told them my issue with cooking, my difficulty and my specific example. Next they will try to put words in your mouth, do not fall for this, you must be negative all the time. E.g. they could ask how are you on a good day so you could reply something "I feel like everyday is an awful day, I wake up every morning and I turn to dread because Im upset that Im still alive, I dont remember the last time I had a good day.
    See I was extremely negative and never positive, if I said something like I felt good last week because my favourite tv show was on then that would go against me, they will twist it to say that Im not depressed all the time. You really need to understand the marking criteria and the same goes when you are answering the paper application as well. I was just awarded the full rate yesterday for depression and I didnt provide any medical evidence, they may have contacted my gp or looked up my medical records but the only medication im on is anti-depressants. I was actually quite shocked, I had my assessment on 1st July, awarded 24th July, back payment of 3k will arrive 29 July and now I will get £730 every 4 weeks. I found it easy but remember you need to be a negative nancy about every single aspect, do not be positive about anything.

    • @Mike--Oxmall
      @Mike--Oxmall Před 26 dny

      What the hell does race have anything to do with it, they're following a checklist, you need to study the marking criteria very carefully, apply it to your conidition when you answer the questions, dont let them put words in your mouth, never say anything positive and you will rack up points. If you rack enough points then you will get it, there is no way around it, most people who get refused dont understand, its a game and you need to learn how to play it. Also I think the assessor was actually some ugly chav who lives in a crappy run down crack infested council estate in Mankychester.

You MUST match your illness and how it affects your life to the descriptors.You have to be extremely accurate .For example ‘I am unable to walk 20 meters without severe pain and having to stop to rest on any day ‘ ‘i have severe pain in both legs and feet which affects my walking’
    It is no good just saying for example, ‘I have pain when i walk’
