  • We often get this question in the context of a divorcing couple. And the short answer is, “Yes.” The court can force you to sell your home because they have the authority to transfer property from one spouse to another or to order property sold pursuant to a dissolution of marriage. What if there is a 15 y/o child in high school?
Also, what if both spouses agree to live in the home together after the divorce?

Neither spouse wants to move out or sell the home. But the spouse who filed for divorce wrote in her demands that she wants sole possession of the home.
    What happens?

How long can she drag out the sale of the home?

What if one party was awarded the home without selling or buying out other spouse. Other spouse took XYZ assets... Spouse 1 just wanted the home... spouse 2 quit claimed home to spouse 1 (who is staying in the home)

I am not sure of your question. You both agreed to your decribed exchange? If so, what is your question?

Thank You for this video. Im scheduled for trial..Will the Judge force the sale of the house if I can afford it, my ExSpouse cant afford the house and doesnt want it, but wants to block me from buying him out. I am preapproved to buy him out, but he wont agree to it. Will the Judge REALLY force the sale because he is being a jerk?

I had the same question, if I'm able to buy her out, the judge will have to give that options to the one who wants the house. a judge cant force if one has the means to make the buyout happen. providing all other assets and community debt is property divided and each can support one self. only an experienced trial attorney can answer this question. open for a better answer.

      I don't understand:
Your Ex does not want the house, but also does not want a buyout?
      Or
He doesn't want the house and also doesn't want YOU to have it.
      Seems actionable.
      What happened to you?

What was the outcome to your situation? Seems similar to mine. My ex doesn’t want to accept the amount of the buyout so she is trying to force me to sell the house because she thinks she will get more.
