Right, well. said. But that conversation didn't happen in my CCW class. I was alarmed by the number of fellow classmates who obviously passed the FBI background checks, but were clearly mentally, emotionally and ethically unqualified to own a weapon.
Its why I wish more people had to take at least a basic course on use of force before conceal carrying.
A bit too many people pumped up and eager to carry firearms but not actually listen to what is legally allowed.

I agree completely! Several months ago as I exited my home to go to I was confronted by a complete stranger who was standing in front of one my neighbors homes. As I walked to get into my vehicle, he yelled towards me which made me turn towards him. I found out later that he and my neighbor had been engaged in a verbal altercation and this guy was yelling for me to come over to where he was, I did not comply and kept walking towards my vehicle. As I approached my vehicle and started to open the door I observed this guy had come across the street and was approaching me and it was clear he was upset but at that time I had no idea what had happened. Realizing he was approaching too fast for me to get inside my vehicle before he’d been close on I turned to face him which made him stop his approach about 15-20 feet away. However, he was still agitated so I thought to see if I could find out why he was upset and whether I needed to call 911 or not. During the next few minutes as we talked, I learned about the verbal altercation between he I and my neighbor and it became clear he felt that my neighbor was less than decent towards him. I tried to give him a little moral support given I had no other 1st hand knowledge of the antecedent event so I just was hoping he would calm down a little and I could be on my way. During our conversation neither of us made any movements towards the other so we maintained that 15-20 feet spacing throughout. After a few minutes I realized that his level of anger towards my neighbor and the situation was not getting any better so, I attempted to end our discussion so I could leave as I was late for a meeting and besides, I wasn’t getting anywhere with him. As I started to open my car door he took a couple of steps towards me and at the same time threatened to take his anger he had for my neighbor out on me! I remained calm and did not brandish my CCW but I advised him that it wouldn’t be a good idea to take out his anger or frustrations on me or anyone else. At that moment a woman who I believed to be his wife or girlfriend call out to him from down the street and he departed. I got into my vehicle and left. I don’t know if he was armed or not, there wasn’t anything in his hands at the time but I did not know if he had any weapons on his person or not. In any event, I’m glad it ended with me not having to use my CCW however, when he made the threat, I instantly transitioned from a primary helpful secondary defensive posture mentally or a primary defensive one. I know this is a mild situation and most defensive situations won’t happen like this but, I just wanted to share my story because after he threaten me, I began weighing what he might do that would make me have to use deadly defensive force and hoping that it never happened.

I need to thank you Jhon today I chose not to use my gun even though he had a knife and he was chasing the restaurant workers around the kitchen . I used the 5 ds plus one and wrestled him for 10 minutes till cops came . 20 workers and even the men were scared and wouldn’t help me . He was try to go for his knife I was holding his hands but he was sweating bad and if I lost my grip I was going for my gun carried in the small of my back . Thankfully I didn’t have to shoot him and everyone was extremely thankful to me for stopping him. God bless and thank you. I carry smith and Wesson 1911 .45 cal with rip defensive rounds.

Excellent topic. One thing I have realized after seeing many of these videos on this channel is that for example if you live in a state that is a Stand Your Ground state, sometimes the actual standing your ground falls under the should I category. While it might be legal, that doesn’t mean it was wise. Even if the DA and prosecutor completely agree with your defense attorney that it was justified and within the law does not mean all your troubles are over in the future.

This is a very important topic and should be brought up as often as possible. I've read so many comments on ASP, other youtube channels involving DGUs, reddit, etc where so many people have this attitude of "when CAN I" as if they are itching to have a legal justification to kill a human being even if it's not 100% necessary. It's disturbing and hopefully most of them are just keyboard warriors who wouldn't do what they say they would do in real life.

"shield, not as a sword" - Awesome statement. If you are following simple home security protocol, there should be no reason for anyone to open a door and walk in "accidentally".

@@ASPextratoday Sunday March 26 I stoped a man chasing restaurant workers with a knife I tackled him and used the 5 ds plus one I held his hands and nobody would help me . I had my gun carried on my back if I lost my grip I was going to be forced to shoot but luckily I didn’t. Cops came after 10 minutes of wrestling the workers were scared and wouldn’t help me .
Great video topic. Found myself asking myself that question while hunting. Is when to take the shot. I might of had a bear or deer if I took a little more time aiming. I have had 3 bear encounters while walking with family in 3 years. I realize shooting an attacking predator means guilty until proven innocent.
This content will hopefully prevent unnecessary loss and destruction of life

Must I shoot? Literally, for me, that's the only question. I'm not willing to unholster my weapon for another and risk everything if something goes pear-shaped. My firearm is to save my life and those I love, that's it. I will do all I can to help otherwise but my ccw does not make me the police.
Absolutely great video! Situations can be tricky at the exact moment but when you break it down in the “can,should, and must” way I think most responsible gun owners have should absolutely view and say it mentally. Could save you from a life time in prison!
Can, should and must is an excellent thought process anyone carrying should consider before they arm themselves. There is no glory in taking a human life…even a bad one. Great topic and presentation.

I like the Mas quote for what is good in virtually any jurisdiction in the US. "Immediate, and otherwise unavoidable, risk of death or great bodily harm to the innocent."
Great video. Very important and I hope more of your followers watch it. Always concerns me how eager some in the main comments or in the r/ccw subreddit seem eager to shoot and take a life because they can.
Doesn't help when we had cases (like that poor 9 year old in Texas) where a shooter gets off despite clearly shooting at the wrong vehicle after having been robbed.
The law needs to restore faith that those who were not in true danger for their life or health and use deadly force will be held accountable.
Those who shoot because they can are exactly what the anti-gunners are concerned about, a bloodthirsty person looking for a legal excuse to kill.

Indiana Law provides immunity for a defender that's been ruled as justifiable defense.
Remember, though, that it is very seldom that a defender gets a definitive ruling of justifiable defense. A not guilty verdict at trial or no charges brought is not the same thing as being declared justified.
The whole point of possessing a firearm is to control outcomes:
a. Best outcome - nobody is hurt and everyone goes their separate ways
b. Next best outcome - somebody else is wounded and runs away. Your action is ruled self defense and you are not charged.
c. Next best outcome - somebody else is wounded and runs away. You are charged and defend yourself and are acquitted.
d. Next best outcome - somebody else is wounded and runs away. You are charged and convicted or plea bargained to a lesser offense.
e. Next best outcome - somebody else is killed. Your action is ruled self defense and you are not charged.
f. Next best outcome - somebody else is killed. You are charged and defend yourself and are acquitted.
g. Next best outcome - somebody else is killed. You are charged and convicted or plea bargained to a lesser offense.
h. Next best outcome - you and somebody else is wounded and runs away. Your action is ruled self defense and you are not charged.
...
You see where this is going, all the way to:
xx. You are killed. Your heirs are sued in civil court and lose everything.
You cannot determine which of these you will get. It is a crap shoot. So, avoid getting in this spectrum of misery. The very best way to deal with the criminal justice system is to never ever have anything to do with it.

Expecting people to make this sort of determination in the moment is a big ask. I think about these things often, but I really doubt all of that would go through my mind in the moment. I have watched a bunch of your videos, how often do you think people have the time to compute the "can I, should I, must I? " question? I have "brandished" my firearm as a normal old legal carrier twice in twenty years, never shot anyone thankfully, but anything beyond "this is a threat I need to address right now" did not really enter my mind. In one situation, if I am honest with myself, I could likely have gotten out of it without drawing the weapon. I think it is awesome you are encouraging folks to think about this stuff ahead of time, however, I don't think it is going to enter their minds if they are in a real or perceived life or death situation. This sort of threat assessment has to take place prior to being in that situation. If one has time to run through this I would suggest one likely also has time to remove themselves from the situation. Different for police officers, I am sure.
It certainly won't enter their minds if they haven't trained and considered in advance.

That incident with the defender of the handicapped spot, happened a short distance from where my son and his mom live! It’s not in the best neighborhood and was a source of racial divide at that time! After I saw the vid, it’s was very evident the shooter was in the wrong! My son and his mom are both concealed carriers, and had very different takes on it. Let me just say, I’d rather be dealing with my son in a similar situation! Gives me great comfort knowing he takes a little more from my parenting! Another great video @Active Self Protection on a very iffy topic, but crucial in our everyday dealings as defenders!

John. In your experience, how does a jury generally look at a situation where a retired LEO takes action? They are wired for 20 to 30 years to respond a certain way.
Depends on the community, but generally a retired LEO is given a good bit of deference because of their training. Not absolute though.

My parents have told me multiple times that they'd rather die bound & gagged with a GSW to the head than face the legal system & the destruction it would bring to their lives, regardless of the jury's findings.

I think Rittenhouse was being reasonable when he went to protect the car lots. He was naïve but he wanted to help. He was not going alone he was with a group of other people not that much older than him all similarly armed. And he had been asked to help.
A lot of people see the end result of that night and ignore the actions of everyone but him.
He was there from the afternoon till almost midnight without any incident at all until he went to put out a fire in a car on one of the 3 properties the group was watching.
. He was doing what he went there to do. First aid because he had lots of training as an EMT cadet and as a life guard. He also had some training in putting out fires when he was a cadet with the fire brigade. And he helped watch over the property.
Just because WE see it as possibly unreasonable does not make so. He had some skills he believed would be useful it is not unreasonable to want to use them to help. Naive but not unreasonable.
When you watch his actions, he did everything right. He ignored taunts from the rioters he walked away from people accusing him of things he did not do, and he ignored blatant threats of death. He ran away from a man who pointed a pistol at him and a man who chased him the same man who had threatened to kill him.
He did everything he could to deescalate even taking a beating before he defended himself.
He should not be blamed because the mental ward let out a crazy suicidal lunatic who beelined to the riot buddied up with a pair of chaos tourists one of which was armed and decided to a attack a young man he mistakenly believed had put out his dumpster fire.
He is not responsible for their actions when he had literally done nothing to them.
He did take responsibility for his actions by turning himself in and reporting the shootings.
There is not a lot more you can ask of anyone. Adults/police probably would have reacted very differently if they were attacked and assaulted like that and l dare say a lot more bullets would have been fired and people hurt or killed.
He was put in a bad situation and did what he needed to do. Maybe he should have stayed home but he felt an obligation to the city where he worked. If the rioters had stayed home then none of this would have happened either. It was bad all around but he handled himself as well as anyone could have. Fortunately, the jury agreed.

The horror of all this is that a threatening person has put you in the position of having to make a life or death decision while under extreme stress and anxiety.
You were just going about your day, living your life as a decent, moral man or woman, when suddenly some creep puts you in a position that you never sought to be in. You are now expected to make a perfect decision, which is impossible under such extreme stress. That is why I would always give the benefit of the doubt to the defender. They never wanted this. It was forced upon them.
Not a perfect decision. A reasonable one.
Naw, some people go too far and lack the proper temperament to carry. No excuses, you decide to carry a firearm you accept a responsibility. No excuses.
I feel the same way. Prosecutors have all the time in the world to go frame by frame and critique every action from a comfortable chair. The defender has to deal with life or death decisions under extreme stress in milliseconds. They should be shown what they could have done better to maybe subconsciously remember it next time and be given a pass.
@@ASPextra That begs the question, is the DA handling the case a reasonable person as we define reasonableness, and would a jury of our "peers" be reasonable people? We live in strange, scary times where rational thought among the general population is eroding by the day. I can only hope that people of reason handle my case if ever it comes to that. Reasonable men of the 50's 60's and 70's were just that - reasonable. Reasonable men of today are far less so, I observe.
My point is that reasonableness is now in the eye of the beholder, and is no longer a generally accepted standard.

Knowing when to shoot is like you’ll know when to shoot. It’s like porno, you’ll know when you see it. I responded to a traffic accident involving a a senior citizen and a sex worker. As I walked up to the vehicle, standing behind the old man. I noticed he was trying to get something out of his pant front pocket. It turned out to be a 22 pistol. Thank the Lord, it was a feeble attempt to brandish the gun. I was able to grab his hand and remove the gun. “ Hey grandpa, what the hell are you trying to shoot me “? The pro took off running,but grandpa was the main subject. By the way, the vehicle was a convertible, made all the difference. The DA and I agreed about prosecution. He was in his nineties. Imagine if I shot and killed grandpa. Another happening in the streets of Brooklyn, can’t make it up. Please evaluate carefully if time permits. May the Lord bless all out there and the Holy Spirit be with all.

I completely disagree with the basic premise of this whole speech.
The legal doctrine that allows the use of deadly force is referred to as the "doctrine of NECESSITY". In other words, you are legally allowed to use deadly force BECAUSE YOU MUST. What this means is that "may I shoot?" and "must I shoot?" are, from a legal standpoint, the same question.
You SHOULD shoot the instant you are legally justified in doing so, because that is the moment when such action is necessary to prevent death of grave bodily harm to an innocent person.
To NOT shoot when you are legally allowed to do so is irresponsible, because that means you are placing an innocent person (possibly yourself) at grave risk.
You can disagree but there are several falsehoods in your comment.

Feel free to watch John's Briefs on the channel. Necessity is not the actual legal standard. Reasonableness is. Those are different.

You are mixing up the "reasonable and prudent person" standard with the Doctrine of Necessity.
The distinction here is subtle, but important. The perception of necessity is what actually justifies use of deadly force. The standard of the reasonable and prudent person is a litmus test applied to when a perception of necessity exists.
Thus, reasonableness is involved, but it is NOT the element that provides the actual justification.
Here is the common-law standard, in full, as taught in Massad Ayoob's MAG-40 class, which I highly recommend:
The use of deadly force is legally justified, when:
1. A REASONABLE and PRUDENT person
2. Knowing only what the shooter knew
3. Would believe that the force was NECESSARY
4. To prevent immanent death or grave bodily harm
5. To an innocent person
Thus, the law requires us to be reasonable and prudent, but that is not enough. Reason and prudence are necessary for justification, but not sufficient.
We must also, being reasonable and prudent, believe that the force is NECESSARY.
There is a standard "reasonable force", but that is something different...generally applied to peace officers using force (not deadly force) to apprehend a suspect.
Since non-officers have no duty to apprehend suspects, the reasonable-force standard is generally not relevant to judging their behavior in court.
Now that we all possess a complete set of facts, let me reiterate my thesis:
1. You MAY NOT (legally) and SHOULD NOT (morally) shoot until the moment you REASONABLY believe that deadly force is NECESSARY.
2. When that moment arrives, you MAY (legally), SHOULD (tactically) and MUST (morally) shoot.
You can church it up if you want, but you're wrong.
