I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. Like most people, I love watching legal TV shows and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are so ridiculous.
Today I'm taking a break from teaching law students how to kick ass in law school. This one is just for fun.
In this video I tackle some of the most famous courtroom scenes in Ally McBeal, Boston Legal, and LA Law. Great dramas, but BAD lawyering. Most of them are preposterous, but I still love watching them.

Objection
In the rick and morty clip, the defendant is saying that his attorney is refusing to give him the discovery evidence which is in part necessary for him to be able to assist in his own defense, or in what seems to be the case in this instance in order to prepare to defend himself or get another attorney to defend him.

there was this one time the DEA nabbed me for selling 10 sheets of LSD, and I didn't have a lawyer. So one was appointed, and he was not real interested in me at all. Second time he came to the jail to see me he looked at me kind of funny and said "You have friends..." I didn't know what he was talking about but turned out the folks I was getting my sheets from in Cali had gone to the lawyer to have him look up a local lawyer for me, a decent drug lawyer. HAHA turned out to be the same guy who was appointed by the court only days earlier. I did a nickel at FPC Duluth, it was horrible! Between the pottery studio and my painting, and the band room, I never got a chance in all of five years to try out the 6 lane bowling alley. My day job was handling payroll for 200+, also running multimillion dollar federal contracts for acres upon acres of cubicle farms. For $1.15 an hour!
My personal largest contract was a Fort Smith job for in excess of $3,000,000.00. We had to account for every inch of fabric, every single screw. It was surreal.

The Rick and Morty being based on a real court transcript is my favorite part of this video, because it means the comedy cartoon is the most realistic thing you talk about. That just tickles me.
Watch the full thing. Rick Allen successfully got the judge to say things that guarantees an appeal.
I like when he said My Cousin Vinnie was a good legal tactic.
Not just based on a real court transcript. It is the transcript word for word. Every interruption, every pause, every sound is exactly as it's written in the transcript.

Probably my favorite show ever.
So for that Rick and Morty bit, it was recorded and set to anamatic (black and white outlines) for what a scene/episode could be. But the colorized version was completely created and animated by tiarawhy who added in easter eggs in the audience. such as the Brainslug and Kiff's midwife from Futurama.

The thing is it's all real, they used the transcripts from an actual trial in like Georgia or Florida as a script. It's word for word something that actually happened in a court room.
I know, that's why I want a breakdown!

Can you do something about the lawyer stuff on Daredevil (the Netflix show)? I think there's something to be said about Frank Castle's trial in season 2 and how many inaccuracies are there with law procedures. And something else to be said about the legal ethics of Nelson & Murdock's work going after Wilson Fisk in season 1.

+LegalEagle I bring up the Castle trial because I feel there's enough legal inaccuracies to fill a book. Such as trial speed, or witness sabotage, stuff like that.

I think the second Boston Legal clip is actually the final season of The Practice which is like a season zero of BL. I discovered it after being a massive fan of BL and it was so nice to get a few extra episodes!

In the Alley McBeal clip; Peter MacNicol's character John Cage has OCD and is neurotic when it comes to things like germs and physical interaction, so whenever people touch him he becomes very defensive about it and when they do it unexpectedly, he screams. lol

The TV show Better Call Saul would also be pretty ripe for things to dissect, particularly concerning a Bar hearing in episode 3.05.
What happens?
It's a trial hearing for disbarment of a lawyer based on alleged crimes of interference committed against his older brother when his older brother was working on a case - it centers on whether an event took place, or whether the lawyer was merely trying to protect the mental state of the older brother. Features surprise guests, a reverse pickpocketing, and presentation to judges instead of a standard jury. I'd also love to see you pick it apart.

When all he had to do is to get a statement from a doctor that figured his brother's mental state pretty quickly and definitively.
The show at least has a nod at the amount of paperwork that goes into making a case.

You got that right. My dad represented himself _pro se_ when he divorced my mom. No wonder she got everything except alimony.
There is a reason people study the law. They become professionals at this stuff, who thinks they can do better than the pro. Who would think they could simply diagnose or medicate or operate themselves instead of going to a medical professional to that. It's the same kind of situation. The written text is specific and can be read and learned, but each case is specific and needs to be look at before applying those knowledge to it. Both in law and medicine.

I really didn't like Alan Shore just because of what he put Eugene Young through and Young, Frutt, and Berluti in general, but he is a damn good lawyer, despite how he may treat women and his unethical tactics.
I do prefer him in the first season, where he's more disreputable.
That was not actually Boston Legal. It was from the final episodes of The Practice when they were introducing the characters of the spinoff.

As a fan of these legal dramas I'm hoping you can answer something I've always wondered about. In Boston Legal and The Practice one thing that happens quite a few times is this scenario:
Partner/Boss: I need you to take over this trial
Lawyer: When?
Partner/Boss: It starts in an hour....
Later...
Lawyer: I just got this case. We would like to request an extension.
Judge: No. Trial starts today.
Does that ever actually happen in real life?
I'm not sure but I doubt that. If one side in court is unprepared then the judge will call a mistrial and find someone suitable to represent the client/opposition. That person would have time to prepare for the trial which I'm guessing would be weeks to prepare. The only exception would be if someone had two lawyers as if one was unable to defend, the other one could still do their job or would postpone the trial until the other lawyer was able to defend again.
Probably depends on the the judge, the jurisdiction, and the case. In my jurisdiction (small southern jdx) the judge would probably grant the continuance. However, the longer the case goes on the less patience they will have. They don't like having cases clog up the docket for a long time because the defendant keeps getting new council. Also, if it's a simple case a good attorney can be briefed on the case and be ready for trial. Plus if they are in the same firm they might very well be familiar with the case already.
He addressed this in his Liar Liar (Part 1) review. The judge would normally grant continuance if someone just took over a case and didn't get enough time to review all the evidence yet.

I would say yes because when it happened in those shows the case already had 3 or 4 extension. If I remember correctly it was because the client kept firing lawyer to purposely delay the case.
The common thread through the early (and best) years of L. A. Law, and all of Ally McBeal and Boston Legal, is David E. Kelley, who was a prominent writer and producer on the first show, and the creator of (and major creative force behind) the other two. Having earned his J.D., he (by all accounts) a good knowledge of the law, but also a very strong sense of dramatics. At his best, he could balance sensationalism with trenchant debate. At his worst, the sensationalism would grow and take over (which happened more often post-90s, as on Boston Legal).
Since you looked at Boston Legal, I would suggest taking a look at one of the early (and best) seasons of the show it was effectively spun off from, The Practice. It was commonly said that the first few seasons of that show were among the best work Kelley has done, both in drama and presenting the law (again, with some sensational touches).
I would also suggest my favorite Kelley series, Picket Fences, which best balanced the legal stuff (set in a fictional small Wisconsin town) with family dynamics.
For a good laugh, too, the trial scene in Airplane II: The Sequel is great. If you have not seen it, I would strongly suggest it. A lot of courtroom drama cliches get skewered very well.

Early in his career Christopher Reeves was auditioning for a play with Katharine Hepburn.
Kathrine was helping to select the cast and when Chris mentioned his mother had gone to school with Katharine she said "Oh yes, I remember her. I hated her."
I don't know if it was true, but it was a great response.
Now, if you can get that person to write a letter for you, that would be a different story, and much more impressive.
A friend of mine when I was graduating High School wanted to go to the Naval Academy. His family were friends of Admiral Carlisle Trost, who at the time was Chief of Naval Operations. His dad got Admiral Trost to write a letter to submit with his application.
It's true. Letters of recommendation are basically an acceptable form of name dropping. I think the key difference is that the letters are written by the person in question whereas just dropping their name leaves the interviewer with the onus of determining the truth of the matter.
And the nature of that association. I know lots of people who I would not recommend and settling pond cleaner at sewage treatment plant, yet they are free to drop my name at will.
Also, my friend had done a lot of work on getting himself into the Academy. There are a number of things that are required to be considered, plus a lot of optional things that are helpful. He had all of the requirements, plus a lot of the helpful items completed.
The letter was just one more of the helpful things. And the Admiral told him if he (Trost) had not felt he was a good fit for the Accompany he would not have written the letter.
It can go the other way as well. I was working in a shop as a welder when a new applicant walked in the door. The boss asked me to set up a welding test for the guy. I had worked with this particular person before and found him to be a terrible welder. He didn't even know how to set his machine properly.
Normally the machine is left in whatever set up it was last used in, but I knew if I set all the settings to zero he would not pass the test, so that is what I did. And he failed the test. He even asked me to set the machine for him. I said setting the machine is part of the test.
I don't think I unfairly sabotaged the test for him. Proper machine set up is such a basic thing for a welder, nobody even really thinks to test for it. It's on the level of a surgeon who can't use a scalpel or a pilot who cant taxi an airplane ("drive" it on the ground)
A friend of the family was a commander in the navy he could not proceed any further because his father had been a local counterpart to a chief of staff.

Can I just say that as an aspiring lawyer from the UK, I find this channel utterly educational and engrossing! The US legal system seems like a complex beast. And I thought I had it tough learning the legal system of England & Wales!

I am a master student in business management, I really enjoy your videos, not because i am within your field, but because i meet so many lawyers in my job, and strangely we always try and understand each others "world", and you sir make that very entertaining. Thanks for the videos.
I did defend myself pro se in a civil case a few years back. The judge didn't have to provide any 'help' or hand-holding. He asked if I was aware of the rules of civil procedure for the district court. I had already read the entire procedural guidelines and memorized the 127 pertaining rules (and sub clauses) and two additional addendum. He asked if I understood that I would be held to the same standard as an attorney, which I also knew, and agreed to.
Then, because it was a property related issue that contained elements attached to the border line of the property (and potential dispute of ownership in the court's eyes), the judge asked why we were in district court and not superior. (Superior would cover land border disputes and contested ownership issues.)
The attorney for the plaintiff stuttered and then I explained that it was due to a fence erected on the border, but did not contest the border itself. Due to the claim's value, it was not small enough to be a 'small claim' issue, so it fell on the District court. The attorney for the plaintiff was baffled that I answered accurately.
I let him in on the secret that while I wasn't an attorney in-fact, I did help a good friend pass the bar in RI and MA, and one of my first career considerations was to be an attorney. When I consider something, I do a lot of reading and sometimes deliberate for years on it. I gain an expert enough knowledge of it to be sure I want to do it as a career, but while I love the law, it's too slow and bureaucratic for my taste.
If you're smart enough and understand you must be humble in your research, you can succeed. (Cocky people assume they know the law, humble people study the intricate elements of their particular case, and how they can successfully argue it.)
This was really interesting, watched the entire playlist so far! I remember watching Law and Order as a child, curious on how all that was really so close to Real life. My husband who's not really big on Crime shows or lawyer shows has had a great time watching with me your playlist. We love how you pause to comment on the "Why' something isn't realistic and what about it. SO INFORMATIVE! Thanks for this series, I hope for more in the future!

I assume you are referring to the show but I would also like to recommend the movie (not the theatrical cut since that eliminated about 80% of the trail scenes), specifically the scene where he plays up his blindness to get sympathy from the jury since his client isn't particularly sympathetic.

Objection! The judge that complained 'how dare you' to taking the eating of the flesh and drinking of the blood literally. I don't remember which one(s) off the top of my head, but their are denominations that really, honestly do take it literally. They literally believe that the bread and wine turn into the literal flesh and literal blood of Jesus when they consume it.
That's the doctrine of Transubstantiation, based on Aristotelean physics, which Catholics (by far the largest deminination of Chjristians) are supposed to beleive.

Another show you can review on this series is a new Legal TV show named ‘ For the People’ it’s a pretty good series so far about young lawyers who work as Public Defenders and Prosecutors for the Southern District Of NY Federal Court.

Did lawyers walk around in the well more often before microphones existed?
Might be wrong here but most likely not, since many of the older courtrooms I've been in seem to have been designed and built with amplification of voices in mind, much like churches are, just not as extreme as a church. As a musician and composer, I would love the chance to record in a few of those older courtrooms, especially a couple of Federal courts - they all can create a natural reverb effect that sounds gorgeous.
Add to the physical design of the courtroom proper vocal projection from the attorney's. Actors have been making themselves heard in large theatre spaces of varying acoustic quality for thousands of years, long before microphones existed, so I expect a good many lawyers had to do the same thing, learning to project their voice clearly in order to be heard.
Watching this oin 2021 and I noticed that the video and production quality has really gone up in 2-3 years. Amazing work 👍🏻

Yes please! I'm aware that most of the process of making sure both parts and the judge have all documents is cut and that hearings are dramatized and exaggerated, but that is clearly for entertainment purposes, we wouldn't like 5 straight minutes of the judge confirming receiving all documents and files, but aside from that I'd like to know how realistic it is. If I've learned anything from Dr. Mike about Grey's Anatomy though, is that Shonda Rhymes didn't care too much for authenticity, but maybe that's not the case with HTGAWM
I was in law school at the time HTGAWM started and honestly i had to stop watching after the first episode because it was just so inauthentic and unbelievable to me

What this series has taught me is not that TV shows get alot of things wrong about trials, but the creative license needed to make a trial compelling with only 15 minutes or less.

But one day one of your videos auto-played when I wasn't paying attention, and I fell in love with the channel instantly. I love the sly nods to your sponsors. And the not so sly nods are hilarious. I grew up on Perry Mason. Got home from school and watched it in reruns. I believe it is still one of the most popular law shows and definitely the most famous. What about doing some list videos about it? "Top 10 Best Court Room Tactics by Perry Mason", "Bottom 13 Worst Court Room Tactics by Perry Mason", "Top 10 Best Cross Examinations by Perry Mason", "Bottom 13 Actions That Would NEVER Be Allowed In Court by Perry Mason", etc. Yes, I know those titles are too long winded but I'm sure you can tighten them up.
Also, how about rating TV lawyers? "Top 10 Best TV Lawyers" and "Bottom 13 Worst TV Lawyers". I wonder which list Perry would make.
I also object to you ignoring Perry Mason. Please avoid contempt of (TV) court by doing at least two videos on Perry Mason.

Given all your advice about law school. I think a perfect "lawyer reacts" video -- even though it is not a courtroom drama -- would be for the 1973 film The Paper Chase, which probably set the idea for what law school is for a whole generation of people, in the same way Jaws told them to be afraid of (largely harmless to humans) sharks. I don't know about the subsequent TV series, but John Houseman's Professor Kingsfield became what I am sure is most people's idea of a prototypical law school professor. Plus it has a young Lindsay Wagner... sigh... :)
On that show The Practice the lawyers were constantly yelling at the judges or badgering witnesses. But one thing that got me was once a lawyer literally threw a book at the judge. Tell me there is no way that an attorney would not be disbarred for that...
Its a good thing The Practice ended with Boston Legal beginning. It was starting to get ridiculous towards the end.
Throwing the book would be assault, if the book hit the Judge that would be battery. You're looking at a possible civil suit, certainly criminal charges which will be compounded by the victim being a Judge, not to mention contempt of court. If it was in front of a jury, that's a mistrial, on top of everything. Considering all of that piling up yes... I think that would go beyond normal sanctions or suspension & would definitely result in disbarrement but it would be subject to a hearing.
