    So I’ve been sued for $3000 . I entered a payment plan. I’ve paid 2400 in two months. The attorney entered a supplemental proceeding two months after I paid. I didn’t default on the payment plan. Why are they so eager to garnish my wages

    Must be old cause banks are required by law to do 2 months look back on accounts to see if ss benefits were deposited. If so banks are obligated by federal law to protect twice the amount of those benefits this is automatic.

    Put your money in offshore accounts...they cant touch it. There are certain stares that do not allow judgments to be garnished out of a persons bank account. Use an account in one of those states. This way they cant touch your money and you can wait it out. See if they offer a good settlement after a year or two of getting nothing

    Just don’t get the mail that’s return receipt, send back all letters with a return to sender on the mail, keep track of the court case under court website, if your going to get served with papers don’t answer your door…you case will be dismissed with lack of notice…..if your on Social Security you can’t get anything taken from you….don’t be worried about it…

    Does judgement affect credit score and ability to purchase a home or car...etc....

    • @MichaelZieglerLaw
      @MichaelZieglerLaw Před 2 lety +1

      Hi Jan: A judgment can affect two parts of a credit report. There is a section of a credit report where lenders report whether payments are current or not, and often, if a balance has gone to a judgment, there are associated missed payments on a loan. Additionally, there is a section of a credit report for public records. In some instances, the credit reporting company may "see" the judgment and add it into the public records section. So in short, it can be possible for a judgment to affect credit score, which in effect can affect the ability to obtain lending for homes and vehicles.
      Maybe more importantly, I warn consumers to be warry of "dormant" judgments. Most people aren't aware that Florida judgments can last forever and they accumulate interest. So often, nothing happens with a judgment for years, and then out of the blue, a consumers bank account gets emptied out. Just because a creditor has not actively collected upon a judgment yet doesn't mean they can't do so.

      @@MichaelZieglerLaw Thanks for your response. Greatly appreciated! I just recorded a default judgement against my previous tenant where she left damages to my home when she moved out. It was a brand new built home, mansion! The judge granted the default judgement since she ignored the numerous notifications to pay, which was served by the constable. She just refuses to pay.
      Before she left she said she is claiming she is "mildly mentally retarted" so that she can get housing paid for buy the government, in the meantime, shes pocketing money to buy a home next year. Yes that actually came out of her mouth!
      Fast forward to now, she just bought a Mercedes and Maserati! Yes , you heard me... Maserati.
      Once she is "recorded" in the respective counties, is it immediate public record, or does it take time for it to show up in public records when she goes to buy a home... or another Maserati?

      @@janjoy9759 Good luck collecting on her. I have two like her I am sitting on. Here in Bama judgments accrue 12% interest. So like an alligator…. I am watching them, I will strike next year.
      Here it takes approximately 8 months to reflect on public records.
