      Even if there are people coming in and not working to local standards( have personally seen this , but aussie tradies are hardly innocent either) , the majority of PM's/site supervisors are local people and they are the ones letting this work pass on site.

      I retired years ago but our building surveyor was so strict he used to have a magnet in his pocket and if stainless steel/galvanised screws were specified he would do random checks and make you replace everyone of them if he wasn’t happy.

      I don't think he's watched many of these videos. I watch regularly and there's rarely a problem shown that is a simple as a crooked architrave or unfinished seals. Zeher's knowledge of Australian Standards, the fact that he will feature *the exact breach* when filming is a testament to his intentions. Howard Ryan is either ignorant of what Site Inspections is about or he's being disingenuous. Smacks of professional jealousy form Ryan.

    im a licensed plumber in vic I fucking love you man. I struggle a little because I'm a perfectionist and I get panic attacks looking at the quality of work these days. Its disguising. Also, the overseas trades seem to care a lot more than aussies!!!!!!! aussies are taking the piss wherever they can

      I did my Trade in South Australia and now live in Melbourne I could not believe how poor the workmanship is in Victoria, I am a Plumber that has worked in the insurance industry, after working in Victoria for a few years I decided to get off the tools, I have just started working as a TAFE teacher, TAFE and the VBA are the major cause for this situation

      @@JamesHenderson-wr2gl when I did my apprenticeship the SA government inspected your work at trade school, your work had to be industry standard to pass TAFE, the introduction of the Australian standard and self regulations had turn the industry to a free for all, The VBA are the worst regulator in Australia, Victoria has under minded the Australian Standard regulations from the get go.

      @@craiggun9 i dont now the laws about this but building inspectors arent just there to make sure its legal but make sure the quality of the work is up to par, a tilting door may not be an issue now but can cause issues down the line.

      To a certain extend Howard is right about that.. I previously work in the industry(demolition) & the amount of immigrants work we had to demolish was quite high. I only know it was immigrants is because numerous building managers have disclosed so & witnessing myself these immigrants which a lot needed a fellow speaking person to translate Into their language to English...

    Howard Ryan is a tool, he picks one thing like not painting tops and bottoms off doors having to be sealed is not an Australian regulations issue, just warranty, wtf, don’t you expect your 7 year structural warranty on all items when buying a new house?? So if the doors start to bulge from water and you make a claim you can expect to be told “Sorry it was not fitted as required for warranty”. Howard seems to be one of the Industries problems!!

      Also that dumb inspector doesn’t realise that because the door warranty is voided due to not being finished to manufactures specification the builder has to pay for its rectification not the manufacturer or client.

      Because surveyors have a conflict of interest as they are paid by the builders if you sign a bulk contract. Some contracts even explicitly forbids you from calling your own surveyor, a contract practice that is illegal.

      Often they rely on certificates provided by 'experts' certifying that work meets relevant standards for that item (think roofing, engineering, water proofing etc.) so they are protected from liability in respect of that certificate. Under s 128 of Building Act 1993 (VIC):
      "...[the surveyor] appointed under Part 6 [that dealers with private building surveyors] is not liable for anything done or omitted to be done in good faith in reliance on a certificate given by a registered building practitioner or endorsed building engineer under section 238"
      Basically, "I relied on someone else (allegedly) more knowledgeable than me and they provide a certificate saying it was compliant, so I did nothing more". The legal attack point would be whether they were acting in good faith in the circumstances (also look at their industry code of practice requirements).
      On top of that, the 'professional service contract' between the homeowner and the surveyor usually favors the surveyor in terms of wiggle room (and when liability occurs) as they use their own, or an industry one, that favors them (though apparently not enough to trigger the unfair contracts term regime in the case of standard form contract).
      Basically, the regulator is asleep at the wheel (or focusing on big multi story developments where the risk of death from fire and collapse could create a bigger PR mess) and all the good players (including surveyors) left the industry years ago for greener pastures so now only unskilled and unqualified migrants and shit builders/surveyors work in the industry.

      Well this is why it needs to change. It was councils that removed it from themselves for liability to the public sector ages ago. There is no need for a compliance code if builders and surveyors aren't held accountable prior to settlement. The more it is highlighted and pushed maybe change can come. A lot more people need to bring it up.

    Two important points:-
    1. Howard Ryan states that a non-painted door is a breach of manufacturer warranty. How is this factual when doors are painted on site by the builder/painter. Painting is not not undertaken offsite. These works are clearly incomplete works if OP has not been reached; OR a defect if an OP and/or Practical Completion has been granted.
    2. It is a mute point, if Howard Ryan says that Standards and Tolerances are not relevant ... he says ... "A defect is only a defect if it is is in breach of the NCC; that's it." This is not the case if the Construction Contract requires Workmanship to be equivalent or better than the releavant Standards and Tolerances... If works are not in accordance with Contract, then it is a Contractual Breach.

      The owner would have to insert in the contract that the building works be built to the standards and no builder will do that.

      While I absolutely agree that doors should be sealed with 2 coats, including inside of the handle cut outs and hinge check outs for external doors, the building douche is correct that it's just a warranty requirement... However it is also part of a long list of warranty requirements that I bet aren't being addressed...
      Most manufacturers have clauses that external doors must have an extent of weather protection depending on the wind and terrain categorire, as well as direction. For example Corinthian specifies that external doors must have horizontal roof coverage to 1.5x the height of the door in West facing Urban environments. This is never enforced but it's as relevant as sealing the doors. They also specify the type and colour of the paint that can/can't be used to retain warranty.
      Meanwhile the manufacturers also seem 6mm deflection on a 2040 door to be within manufacturing tolerance and not considered defective. Point being, sealed or not sealed, door manufacturers are as shoddy as the builders... The builder is still liable for the doors warranty if they didn't meet the warranty criteria, they just have to fork out to replace it themselves.

      If we're paying for things like doors, countertops, appliances, balustrades, windows ($$$)... all these materials come with a warranty, right? Builders voiding that warranty from the outset is downright disrespectful, especially if they're not willing to cover it themselves and have a damn good reason for deviating from conditions.

    I went for a job interview at a dodgy building surveyor in Balmain. The short of it was he explained that although their job was to certify that work was compliant with codes and legislation, it was the builders that paid them and as such they had to look after those builders as at the end of the day that’s who they were contracted to and that’s where their repeat business came from.

      yeah its unbelieaveable what he said on national television , I mean so what if its a breach of the warranty from the manufacturer, it still a breach, and that means the warranty is void if there's something wrong with the product because it wasnt installed properly , so if the door is warped, swollen and broken, becasue the top and bottom of the door is not properly sealed, then that's it, the owners have to pay for it. That old fart is talking off his arse.

      Yeah, it's bullshit! Inagine taking your car to the mechanic, but the mechanic will only only look at issues that affect the car's legal roadworthy status and will ignore any other problems. You'd get a new mechanic, right?
      Likewise, you expect a building inspector to be an expert on your behalf - to identify issues that you don't know how to identify or don't even know to check.
      Before I moved to Australia, my experience with building inspectors was that they don't only point out noncompliance issues and warranty issues, but they will even point out expected wear-and-tear issues and give you some idea when these will have to be addressed and how expensive it is likely to be, so that you can negotiate the price to account for these upcoming maintenance issues.
      Their job is not to get anyone in trouble; it's to make sure the buyer knows all the facts before they negotiate the biggest, most life-changing purchase of their life.

    I just wanted to say thank you for inspecting my cousin's house recently. I won't say which one on here but I was really disappointed for them. I went over there for the first time last weekend, lovely house however so many defects that needed rectifying and a loss of friendship that they put trust on that project manager that has broken.     Watched this last night and so happy to see it on A Current Affair. As being someone who has been stung with the absolute hell we went through and the quality of the home that my elderly parents Ended up with from Masterton which was very sub standard to say the least Thankfully there are people like you to bring things to light. I wanted to go to A Current Affair however Masterton advertises heavily with Chanel 9 So Thankyou it is a massive issue that needs to be governed 🙏🏻

      Hi @johnno7429, I think the only way to fix the problems is to have more supervision on site, builders and site supervisors need to do their job and be at site everyday doing there own inspections and checks. Site supervisors should also be registered with VBA to ensure compliance is meet on site and they have answer for issues on site.

    I've spoken to a bunch of builders recently who have said that you have done a fantastic job keeping builders on their toes and they love watching your vids.
    A couple have also called out the whole "calling things non-compliant when they aren't" thing as well so it was good to hear your side re. the tolerances.

      Not going to happen.
      The local MP for Preston replied to me and said the Minister in charge of the VBA would get back to me.
      Nothing but crickets for 4 months.
      The government wants to get housing built as fast as possible so they are going to let the owners take a brutal hit on quality to get there.
      No doubt in 15 years time there will be so many places being demolished because of this and the housing crisis will be more or less the same and home owners will be poorer for it.

    To anyone watching this, note that builders are incentivized to cut corners to increase their profit margins and so will obviously gasl1ght you hard when you try to raise concerns. They have called Site Inspector "ambulance chaser" for this reason. Builders also make contracts that make them be the ones to get private surveyors and inspectors to sign off, and so even these people are financially motivated and have conflicts of interest. As homeowner, we are obviously incentivized to have the best home and so Site Inspector being meticulous in a shoddy industry is like a god send. I would much rather have an "ambulance chaser" than an "she'll be ayt" builder.

    Good move. They need to do these stories more and if they can't, then direct people to channels like these. The news tells us how expensive houses are 3 times a day but will expose a dodgy builder like once a month or less..... Even if by some miracle you're able to scrape by and buy a house you get ripped off.
    This is why channels like this became so popular, people found out how bad and widespread the building standards issues are....

    Well done Zahir ! I applaud you for your continued efforts to bring the industry back in line.
    I have spent 25+ years working with the engineering of footing designs for dwellings and every time I inspected a pre-pour footing or slab that did not comply with the design or the codes, I often found myself having to explain to the concretors, supervisors and even some builders that it is easier and in fact 'CHEAPER' to do it correct at the beginning rather than try and fix it later on. This principle actually applies all aspects of the build of course.
    The astounding part of this is that it really does take some amount of effort to be lazy and not do things correctly so why not just simply complete it properly first time ?
    This is one of the aspects of the industry frustrated me so much that I no longer work in it.
    And that clown on ACA, jeez........
    The NCC simply cannot cover every aspect of every build which is why the NCC references Australian Standards which in turn reference Manufacturers Specs and Guides and in turn reference 'standard & tolerances' documents etc. From a legal perspective it is necessary to not only look at NCC but look at every document that it directly references as well as the references in those subsequent documents to ensure everything is in complete compliance. If it is referenced, then it must be complied with regardless.
    Every builder and relevant trade should be using every aspect of these documents to aspire to do their best job possible, hold themselves to high standards and earn a stellar reputation for their workmanship not just get in and get out as quickly as possible and leave a trail of destruction for someone else to clean up.
    The QBCC in QLD ( a regulatory body) obviously rely on NCC and Standards etc. but they also use the Standards and Tolerances like a big stick so Howards comments about these documents essentially being erroneous are unfounded as the regulatory bodies heavily rely on them as does QCAT and industry experts and as mentioned above, legally any documents that are referenced should also be complied with.
    Talk about being out of touch and a major part of the problem as well as being incompetent, well done Howard you are a clown !

You're paying a million bucks its the least you can do...and if they cant be bothered sealing the bottom of the door it means there's hundreds of other areas they probably didn't bother with either. You should actually start the inspection with the bottom of the door as an indication of what the rest of the build is going to be like.

      Yeah really odd that people defend that kind of workmanship, just pure laziness as the cost would be next to nothing to do. My build I have found a few places missing paint as I guess they assumed no one would see it. Currently trying to get my stairs repaired as the installer of the floor has done a poor job that just over use has cracked the boards as there is no support under certain spots.

    Love what you do as a father of an apprentice carpenter I regularly talk to him about your videos we are both fans and he says he's learned a fair amount from your videos, mostly it's the steel construction homes which his boss doesn't or hasn't yet built a new home using that type of framing but he's still learning a little here and there but it's making him a better builder so keep up the great work and keep them honest
