Using a police cruiser to knock a motorcyclist off of his bike, should never be used for anything other than a deadly force situation. So using your example, if he was shooting at kids, that would be understandable. But the key thing there is we were going about 5 miles an hour and when he fell it was in dirt.We ended up recovering a loaded gun that was stolen, and quite a bit of cocaine. I would never strike someone off their motorcycle at 25 miles an hour unless my intent was deadly force. Bikers and cops both have a choice in the safety of the public. I'm not going to chase a motorcycle at a hundred thirty miles an hour. First of all because it's not worth me crashing after a tire blowing out, and secondly it's not worth some innocent person getting struck by a motorcycle going those speeds. But on the same token, we do have a duty to apprehend criminals. We are law enforcement, that's our job title. So no, we are not going to just let everybody go just because they run. But for me personally, unless it's murder, I'm not chasing you on a bike. I'll see you tomorrow at Walmart while you're buying your girlfriend's Preparation H and cuff you in checkout line 3.
What this clip doesnt show is that the biker was slowing and he was hit and extremely low speed. If i remember currently it was just like knocking the guy over at a stop, not running him over at speed. There was a 2nd angle of the incident somewhere, just not shown here.
Found clip, he was moving faster than i remember when he fell. Im sure this report reads that the officer was using his vehicle to block the path of the biker at which point the biker struck the cruiser, causing him to fall. On paper, he didnt "intentionally" hit him.
In my oppinion he shouldnt have done that in the uk where im from the cops do it diffrent hear instead of knocking them off the road or using pit we use a boxing method one cop at front one on the side and one on the back of the guy getting away and it works better the pit cause they cant drive off

I try to stay out of comments, or I dont call myself out, but I'm an officer in Wisconsin and a biker. What I'll start with is: California is a whole other world. Some stuff they do is crazy compared to WI. For us with our pursuits, when there gets to be a substantial risk to the public because of speed or going into oncoming lanes or a crowded area etc, we either terminate the pursuit, or we force it. Meaning roadblock, spikes, rolling roadblock, ramming being the ultimate, but that is deadly force. Seeing that video, the officer definitely did not ram the biker. Theres a night and day difference there. Yes, the biker was slowing down. My best call here would be that the officer was taking advantage of the slowing down and attempting to do a rolling roadblock, which typically involves more than one car, boxes in the suspect, and redirects them or forces them to have to stop. That's in practice... real world never works the same. That video, it clearly didnt go well and it looks horrible. Do I think the officer did anything the department doesnt allow? No. Do I think the biker will win the lawsuit? Absolutely

Preliminary traffic report doesnt prove whether or not he intended to hit the bike. Just some perspective from the UK, we told our Police they weren't aloud to ram or even pursue bikers regardless of the crime they had committed. Now we have a massive problem with mopped and bike theft to the point where people are having there bike stolen recovered and stolen again in the same week! On top of that the stolen bikes and mopeds are being used for other crimes, everything from armed muggings to jewellery store raids. I can't state how bad this is without saying it is now the number one crime in London. I think the answer is indeed proportionality, should the Police ram a biker of their bike for speeding or wheelies and failing to stop? Maybe not... But if they see a mopped two up no plate, having had reports of Armed muggings in the area and they fail to stop, yeah ram them.

As a former Military Police Officer here’s my $.02 In the Marine Corps our definition of deadly force was “That force which a person uses with the purpose of causing death or serious bodily harm or which a reasonable and prudent person would consider likely to create a substantial risk of causing death or serious bodily harm.” That being said any reasonable and prudent person would consider running down a motorcyclist in a car creates a substantial risk of causing death or serious bodily harm. Therefore the officer used deadly force in apprehending the suspect. The next question is “did the offense warrant the use of deadly force?” And the answer is probably not. I don’t know what he did but it was probably speeding or hooning around doing wheelies and then running from the police. Deadly force not warranted, the cop fucked up and is going to lose the court case. As a biker myself my take on the running from the police thing is if you run and you die that’s probably 100% your fault and you deserved it. If you’re running and go down at 150 or hit a tree or another car or whatever, your fault. If you’re running and you get ran off the road and die, less your fault and more the cops fault. As far as biker speeding creates a hazard to the public, that’s where Officer discretion and department policy comes into play. If a speeding biker is a danger to the public then how much more of a danger is it for the cop to chase the biker? That’s why many departments have non pursuit policies. If your department has a pursuit policy then you need to weigh the dangers of chasing this person. If it is rush hour on the interstate it’s probably not worth the risk to the public to pursue over a speeding ticket. If it’s 0200 Friday night with minimal traffic and maybe this idiot is drunk, maybe it is worth chasing. Anyway I doubt anyone read that long ass shit but I had to throw it out there as this shit is super interesting to me and the vast majority of people commenting on these situations have no experience and absolutely no clue what they’re talking about.

I actually looked up California Highway Patrols, SOPs or Standard operating procedures on bike pursuits they are allowed to on some circumstances allowed to knock the bike over. The honda I had, the stator to rectifier snap (White plastic) together connector's terminals are made of dissimilar metals that loved to degrade connection, and would randomly s**t stators and rectifiers without warning. After swapping rectifiers 3x and stators 2x , found that if you chop out the plastic connector and solder and shrink the connections it solved the problem. As usual your mileage may vary with the Magna being an older model than the Shadow I had.
So basically, if you’re running, you’d better make sure it’s worth dying for. And if a cop runs someone off the road, the person better be life threatening.
Shedman running can be considered felony evading here also I believe. But different states, counties, and even cities have their own policies in place. Some of them love to chase you and others simply are not allowed to unless you have just committed a violent felony.

My father was an officer for 22 years, and both me and him ride bikes. The truth was (at least for our town) was that officers were never to chase an evading motorcycle over a traffic violation or some petty misdemeanor. He was even a motorcycle officer, and if eyes could be kept on the suspect, than instruction was to wait until they dismounted the vehicle to resume the chase.
"PROTECT and serve" This guy hasn't presumably hurt anyone, hasn't run into anyone (no damage on bike) and the officer ATTACKS him. That is NOT protecting. This man who did not hurt anyone could've been seriously injured.

The police chargers feature a pentastar V6 which is what’s in stock jeep wranglers. Now they CAN choose the hemi motors but most departments don’t due to the fact that it’s obviously more expensive, however this is why most police chargers are slow.

if I remember correctly, there was a video clip before the clip you showed, that shows the cop trying to pull the guy over on the freeway when the dude started to run. and the officer pursued him for over 5 minutes trying to get him to pull over, either way its still a misdemeanor plus whatever traffic violations he did, but it all could have been avoided if he just pulled over the first time he got lit up.

idk about California, but in Florida FHP has statutes regulating motorcycle pursuits only for forcible felonies. But usually they will chase anyway...

The police chargers feature a pentastar V6 which is what’s in stock jeep wranglers. Now they CAN choose the hemi motors but most departments don’t due to the fact that it’s obviously more expensive, however this is why most police chargers are slow.

if I remember correctly, there was a video clip before the clip you showed, that shows the cop trying to pull the guy over on the freeway when the dude started to run. and the officer pursued him for over 5 minutes trying to get him to pull over, either way its still a misdemeanor plus whatever traffic violations he did, but it all could have been avoided if he just pulled over the first time he got lit up.
