As per clause (c) of the Proviso to Section 17 of the Copyright Act, 1957, only the producer of the film is the first owner of the copy right. Only if an independently created original music work is subsequently incorporated in the film, the composer of that music work shall be the first owner in respect of that work. As regards cinema songs, they are mostly created by the music director under the work contract for money consideration and hence the producer alone is the first owner. Unfortunately, the producers are ignorant of their copyright over film songs.

There's no one can claim the music, no one is creaters here. Mr ilayaraja sir is a composer, composed music from various sources including Karnatic,Hindustani..and Western, Latin musics. Only who produced the whole package(film producers) in this case has full rights as they are the owners of whole package. Did we like just the tune , or voice or visuals? , It's wrong for one person to claim the whole credits. In foreign countries the album's are release by the musicians themselves (profit and loss will be with them) , in our country mostly the artists are workers, they don't share the loss (no accountability)

This right was claimed originally by Ilayaraja in Tamil nadu film industry. This right is already there & enforced without any hitch in Hindi film industry.
Why should there be hullabaloo only in Tamil nadu ? Purely due to self interest & jealousy.
To avoid any doubt & any other problem, Ilayaraja wanted to enfoce & safeguard his right he got it sanctioned by the court.
This legal right has been in practice in most of the countries in this world including in India.
There is a similar but another right under the same law. This law comes under a unique law called "Intellectual property law."
This royalty on the sale of book to the writer himself comes under the same law i.e intellectual property rights .
This royalty has been paid by the publisher of the book to the writer.
This has been in practice quite a very very long time .
We are all aware of it because of its long time practice & sanctioned by the same law in both the cases.
In the both cases, the producer of the film & the publisher of the book spend their money. This is not the basic criteria of intellectual property rights law.
This right pertains to "intellectual creation." And no other criteria will apply to this law. Both the writing a book & music composition come under this unique law.
Spending the money to produce the film or publish a book is NOT the criteria to sanction this right under law.
That is why the creator i.e. of the book( writer) & composer of the music ( music director) , is given this legal right.
Here, creativity is the basic criteria not the expenditure involved in production or publication.
Every one in this discussion knows this truth & law . Yet, every one feign ignorance of this truth & the relevant law.
There is a clear motive behind their discussion.
It is simply perverted discussion to obfuscate this simple & clear truth & law. All these people argue with a clear & hidden motive to try to get 'at least some amount some how' out of what is the sole right of Ilayaraja as sanctioned by the court as royalty.

காப்புரிமைச் சட்டம் 1957 பிரிவு 17 விதிவிலக்கு உட்பிரிவு (சி)-ன் படி படத்தின் தயாரிப்பாளருக்கே பாடல்கள் உட்பட படத்தின் முழு உரிமை உள்ளது. ஏற்கனவே தனியாக ஒரு இசைப் பாடலை ஒருவர் உருவாக்கி வைதிருந்து அதனை ஒரு படத்தில் பயன்படுத்திக் கொள்ள அவர் படத்தயாரிப்பாளரை அனுமதித்தால் மட்டுமே அப்படி இசைப் பாடலை உருவாக்கியருக்கு அதில் காப்புரிமை இருக்கும். திரைப்பட பாடல்களைப் பொருத்தவரை, பணம் வாங்கிகொண்டு படத்தின் தேவைக்கு ஏற்ப்ப பாடல்களைப் பதிவுசெய்து தரும் இசைஅமைப்பாளர் ஒரு ஒப்பந்ததொழிலாளி என்பதால் பாடல்களில் காப்புரிமை கோரமுடியாது. தயரிப்பாளர்கள் தங்கள் காப்புரிமைப் பற்றித் தெரியாமல் ஏமாந்து வருகின்றனர்.
திரை வடிவில் பயன்படுத்த மட்டுமே தயாரிப்பாளர் அவர்களுக்கு முழு உரிமையும்
உள்ளது. இளையராஜா அவர்கள் அதில் எந்த பங்கும் கோரவில்லை. ஆனால் தயாரிப்பாளர் பல நேரங்களில் தனது உரிமையை டிஸ்டிரிபுயூட்டரிடம் விற்றுவிடுகிறார்.

It is subjected to agreement between the producer and the composer. No producer can go to IR and dictate terms during 80s. In this case the complete rights lies with IR except for those early day compositions. Gangai Amaren has clearly explained this.
A owner-1(producer of movie) made a contract for erect a building with certain contractor(film director) and with certain design engineer(music composer). That doesn’t mean the design engineer(music composer) should not use the same design(song) to other owner-2(audio producer). Owner-1(producer of movie) cannot claim any rights from the profit of design engineer(music composer) getting from the building of owner-2(audio producer) for using same design(song). Conclusion- The design engineer(music composer) can use same design(song) where ever he likes. From the music point of view a music composer can use his compositions as many ways us possible . Music copyrights generally classified in to five types 1. Use in full length film that fully belong to producer of that movie. 2. Use in sound recording that royalty is shared between three audio recording producer 50/composer 30/ lyricist 20. 3. Live orchestra the rights fully vested with composer/ lyricist 4.remix rights belong to music composer. 5.same tunes used in other languages full rights belong to composer. Madam Ilayaraja sir also have the audio recording rights of most of his movies before the year 2000

This is hundred percent fault of producers. They are mixing with albums and movie songs. Movies funded by producers. Once the music director got the money for the music in a movie his part is over. Even after the producers released the movies and sold the tickets to the public, they can't claim. Pradeep is another one. He is the good example for typical Indian lawyer. Ilayaraja forgot his past. Ilayaraja became famous and even developed himself because of producers, technology and Eelam's tamils in abroad. The outcome, Ilayaraja and Pradeep are going killed lot of poor people who depends on this musical groups. At least the producers now understand their fault. They suck the poor Tamils (Tamil Nadu) hard earned money and made these music directors and especially heroes who came to industry as beggars and develop themselves as milliners. The producers must suffer because of their madness and their fault.
