Legal permanent residents are not subject to a public charge test when applying for citizenship or renewing a green card. However, they are subject to a public charge test if they return to the U.S. after remaining abroad for 180 days or more, or if they return with a certain criminal history. For your records, also any person over over 65 can apply for medicare based on five years rules, for elders with a disability may be eligible for Medicare without providing a tax history, depending on cases, a person can't keep up while laws change every short period.

I have an 8-month-old baby and this month we applied for Wic and they support us with food for me and my baby, I entered with a TN visa but I am no longer working, I have no status and my i94 expires in November 2022. This week we will be sending out the forms for the AOS. I thought WIC wouldn't affect me and I also have Medicare where I only pay $4 a month. Before that I had Medical Assistance for pregnancy but after that I was no longer eligible so they switched me to Minnesotacare. From the beginning I asked if it would affect me as a public charge and they told me no, but now I'm a little worried. I am married to a citizen and our baby was born here too.

WIC and Medicare do not affect your AOS

Hello Ksenyia . Thanks very much for all your value added information.
I’m a wife of a US Citizen and we are about to file our Adjustment of status . I have 2 kids born in USA and they get MediCaid and Food stamps Which I applied for . But I’m not receiving any for myself but I’m the card holder on my kids benefits . Does that mean I have to tick that I get assistance or not ?
    Thanks in advance

Hi, are you from Greece? This sounds like a Greek name😊. What if I work as a nurse with eb3 green card and get pregnant before I arrive ( which means giving birth in us). What are my right in regards to my work? What if I have to leave work during let’s say complications? Is my green card at risk?

As stated in the video, you are allowed to try to apply for public benefits. However, the department of human services will need to look at other sources of your income, INCLUDING the affidavit of support signed by your daughter.

Hola Kseniya! I love your videos so much. I'm currently working on my Marriage GC package and I have one question. I already have an EAD (asylum seeking) so I'm not sure if I should include Form I-765 + I-131 in my package.
