The Philippines' NEW STANDARD MAP that Countered China's 10-Dash Line

  • The Philippines National Security Council will publish an updated Philippine map highlighting the country's maritime entitlements is underway in line with the 2016 arbitral ruling and the United Nations Convention on the Law of the Sea.
    The new standard map that will counter China's 10-dash-line map is crucial in terms of determining the extent of Philippine territory that is free for safe navigation and implementing environmental protection programs, according to the Armed Forces of the Philippines.
    AFP Spokesperson Colonel Medel Aguilar said the map which abides by the United Nations Convention on the Law of the Sea will be important in giving Filipinos pride and responsibility to preserve the Philippines territory. A Senate panel will craft an updated Philippine map in response to the 10-dash-line shown on China's new standard national map which claims nearly the entire South China Sea as part of its territory.
    The current updated version of the administrative map of the Philippines includes the Kalayaan Island Group, Scarborough Shoal, Macclesfield Bank, West Philippine Sea, and Benham Rise Region. It also shows Sabah, which the Philippines claims but is not actively pursuing against ASEAN neighbor Malaysia.
    The Philippines' 200-nautical mile exclusive economic zone west of the archipelago will be called as West Philippine Sea. Beyond the 200 nautical miles, it is still officially referred to as the South China Sea.
    This is the first time the Philippine government will publish an updated map showing the country’s maritime entitlements, seven years after the United Nations-backed Arbitration Tribunal ruled some rock features in the Spratlys form part of the Philippines EEZs.
    The UN Commission on the Limits of the Continental Shelf earlier, also approved the Philippines’ application to extend its continental shelf limit beyond 200 nautical miles from the base shorelines east of Lozon Island. The 13-million-hectare continental shelf, called Benham Rise by mariners, was renamed Philippine Rise.
    Recently, China published its map showing 10 dashes forming a U-shape in the South China Sea. In August, the Philippines protested against China after the latter released its updated standard map showing 10 dashes that form a U shape, claiming nearly the entire South China Sea as part of its territory. The area overlaps with the exclusive economic zones of the Philippines and those of Malaysia, Brunei, Vietnam, and Indonesia.
    The Philippines updated map, will have to undergo many layers of approval process to ensure that it is consistent with the UN Convention on the Law of the Sea and the Arbitral Award. This landmark ruling invalidated China's expansive claims in the South China Sea, with the arbitral tribunal largely ruling in favor of Manila in its EEZ and continental shelf that are being claimed by Beijing.
    Another interesting addition to the future Philippines Map is the inclusion of Sabah as part of its boundary entitlements. Northern Eastern Sabah is one of the disputed territories of the Philippines, which is currently controlled by Malaysia.

It was done by a temporary court named Arbitral Tribunal provided by the UNCLOS. Then it was a UN organ. Go to read the Award again and carefully, otherwise you will remain poorly informed..

      Way to go Philippines. Arguing over worthless rocks in the middle of the ocean, and suddenly you snuck in claiming Malaysia's second largest state? Why don't you take Sarawak and Kalimantan as well?
      Sabah is not some tiny rock with nobody living on it in the middle of the ocean. It has 3.4 million people and 74,000 sq km of land. It is comparable in size up Luzon and Mindanao, the two largest islands on the Philippines.
      When China whacks you and grab every island right up to your shores, good luck getting support from Malaysia.

      Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia.
      Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate (original owner) give North Borneo (Sabah) to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to British North Borneo Company (BNBC). These agreements exist and keep at the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned North Borneo into British Charter (1881), Protectorate (1888), Colony (1946) and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia.
      Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement on 22/3/1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing.
      Rebut with facts and references. Not hearsay.

      There is a court case recorded by ICJ (International Court of Justice, The Hague) pertaining to the Philippines claims on North Borneo. It is a special 37-page report by ICJ that was published in 2001 and easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah.
      Philippines which is not a party to the trial requested permission to intervene. To comply to Article 62 of the Statute of Court, Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve Philippines historical and legal rights over North Borneo and to inform the court the affect or effect of the court outcomes on its claim to the territories.
      In the trial within a trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were involved in this trial.
      On 23 October 2001, by 14 to 1 vote, the court rejected Philippines request on the ground that there is “no interest of legal nature” (Section 93). (Meaning Sulu/PH claim on Sabah is null and void)

    Looking back at your vlog minute 6.22 showing the Tausug version of the 1878 Sulu-BNC agreement. That version contain the word "lease". Where is the original agreement now? Who is keeping it? If that copy in the vlog is genuine, how you verify it when the original copy is reported missing during his majesty trip to Singapore? Why this copy not been produced as exhibit in all the court cases?

      Is what was stated in the 1878 agreement to give east Sabah to the Brits.
      "Sudah kuredhai pajakkan dengan keredhaan Dan kesukaan kita sendiri kepada tuan (name and place of living)-
      This whole phrase is in Malay. Which in native tongue can be simplified to
      Aku rela dan ikhlas (reluctantly) memajak (similar to jual or sell or lelong) kepada tuan (the name)
      For example: pajak tanah = jual tanah = lelong tanah
      -sampai lama-lamanya sekalian perintah dan kuasa yang kita punya yang takluk kepada kita di tanah besar pulau borneo"
      In standard malay, this can be rephrase to
      Sampai bila-bila (or to say forever) kalian (translate to "you guys") memerintah dan kawal kita punya yang kita takluk untuk kita sendiri (there are some unnecessary words here so that's why the translations are oddly long) di tanah besar iaitu pulau borneo
      Also note that the sulu sultanate only ever controlled the eastern part of sabah in history unless the western part is completely unloyal to the Sultan.
      Quote: "dari Sungai Pandasan di sebelah barat sampai sepanjang semua tanah di pantai sebelah timur sejauh Sungai Sibuku di sebelah selatan".
      Moving on,
      "tiadalah boleh sekali-sekali kuasa dan perintah yang dikeredhai dalam pajakan ini diberi atau ditukarkan kepada lain bangsa atau kompeni daripada bangsa asing kalau tiada dengan keredhaan perintah bawah duli Queen terlebih dahulu."
      Simplify it,
      Tidak boleh sekali-kali/sesekali kuasa dan perintah yang diberi/kurnia/serah dalam pajakan/jualan/borongan/lolongan (or something that is basically an exchanging/trading deal) diberi atau ditukarkan kepada bangsa/orang lain kalau tiada keizinan bawah duli Queen terlebih dahulu
      Keyword in the 1st page is
      "selama-lamanya kalian perintah"
      This means that this land was supposedly given permanently to the two named men. So it would most likely refer to selling the land instead of renting it. Unless someone is weird enough to rent a land forever (trust me, that's just insane)
      Now, the 2nd page
      The whole thing is saying that the administration power over the land (parts of sabah) must never be transfered into the hands of anyone else or some company if the Queen doesn't allow it.
      The handing of Sabah to Malaysia is with the Queen's blessing so I don't see anything wrong.
      Madrid protocol is just the spanish transferring the whole of sabah to the brits
      In 1903, some islands were confirmed by the sultan personally to be given to the british. But they decided to up the price and the Brits accepted it since they thought it's to buy those confirmed islands
      So that's what started this whole mess
      Basically the sulu Sultans abusing the possible different meanings of some malay words (pajakkan and such)
      The original writer of the content is no longer around thus meant nobody really knows what the writer thought when using that word.
      Despite this, there are tons of other phrases that supports the claim of it actually being sold instead of being lense to
      "selama-lamanya" already means forever or permanent. That would most likely mean sold or gave away and there is no way to get it back.
      And don't go telling me to redo my malay
      I'm what you called a native speaker. I can clearly understand even something from the malay language group like bahasa Indonesia. Even classical or old malay is readable
      Ask any random Malay in Malaysia and they will be able to read those text (even in Jawi) like reading a novel

      This is a clear case of the tail wagging the dog. If Sabah belongs to Sulu, then they are together as one entity. There is no reason to assume that Sabah would be second class and subservient to Sulu.
      Look at the map, can you even find Sulu? Why do we assume that Sulu must be in the Philippines, and therefore Sabah must also be in the Philippines.
      I says Sulu belongs with Malaysia. Look, Sulu has 1m people on an island 1600 sq km. Sabah has 3.4m people with an area of 74,000 sq km. They're not even in the same category.
      Besides the obvious common sense argument that Malaysia should claim Sulu instead of the Philippines claiming Sabah, consider the countries. Malaysia is a Muslim majority country with states ruled by sultans. The Philippines is a Christian majority republic, with no monarchy and no royalty. The sultan of Sulu isn't even recognized by the government of the Philippines.
      Sulu should just come over to Malaysia. It will fit much better. The sultan can be a real sultan, with power, and money. And recognized by the government.

      Wrong. Sulu only claimed that Sabah was given by Brunei to Sulu as a gift for purportedly helping Brunei fight rebels. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans.
      The sovereignty of Sabah and Sarawak as component states of Malaysia is intact, recognized internationally and recognized by the United Nations. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says:
      "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia".

      1. How could British gave Sabah to Malaysia when Malaysia was not in existence? Malaysia was only formed on 16 September 1963 when Malaya, Sarawak, Sabah and Singapore, they all came together and signed an agreement (MA63). Before that Sarawak was given independence on 22 July 1963 followed by Sabah, given independence on 31 August 1963.
      2. How could British expand their colony by giving independence to Sabah and Sarawak?

      It's already resolved, only the Philippines are not aware of this. There's no issue in the first place, it's a baseless claim which the international court has dismissed.
      Malaysia is currently sueing the people involved in this issue and interpol is on the hunt for some of the individual.

      @@akane8615 both countries has different international courts and the other international court is sided with the philippines offcourse for fairness with sultanate of sulu this issue is still not resolve as far as the international community is concern..... the lease agreement of sabah from sultan of sulu is undoubtedly cannot be denied by malaysian government. I think both side will as usual is going to do their best to take this on legal terms. At the first place during malaysian federation formation, if malaysia did not intervene or taken advantage of releasing eastern sabah from the hands of the original lessor (british) this will not happen. Malaysia did not forsee that they will be hunted by historical owner which is the sultanate of sulu.... as ive said this will be given a chance to be resolve in the future.

The people involved are the one that filed this through multiple international court, dragging malaysia to go here and there while this could've been solved with just one court. And what result did they get? still dismissed lol and now you're trying to deny it.
      Malaysia is sueing them for damage, anyone involved in this will not leave unscathed. Even interpol are on the hunt, the PH are supporting criminal and fraud. Have some shame.

    If i remember correctly during my Elementary days 1986-1994 the Philippine Map includes Sabah, and text is SABAH not Malaysia or Sabah, Malaysia.

      Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate (original owner) give North Borneo (Sabah) to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to British North Borneo Company (BNBC). These agreements exist and keep at the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned North Borneo into British Charter (1881), Protectorate (1888), Colony (1946) and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia.
      Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement on 22/3/1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing.
      Rebut with facts and references. Not hearsay.

    the philippines should also discuss and have them regularly taught from elementary to college to keep inculated in their minds that these are philippines territory.. also, patriotism should be inculcated at an early stage to remove the corrupted pollutants in their mindsets..we have too many traitors and unpatriotic idiots in our midsts and they should be dealt with harshly esp who serves the government

      Yes, Malaysia had stop paying the annual cession money (not rent) because of Sulu's wrong doing. And if Malaysia doesn't want to continue the cession money payment, there's nothing Sulu can do about it.

    With our territorial rights in the PH Rise we have to start conducting explorations of its oil and gas deposits before China give us another headache like the West PH Sea. A very thorough study on this without sacrificing our environment is important in as much as our Malampaya is about to run out in a few years. This must be done in the earliest to establish our soveriegnty in the area. With the help of our allies we can achieve this and alleviate the country from poverty.

      Not correct. At least the part that put Sabah as part of the Philippines is not correct.
      The sovereignty of Sabah and Sarawak as component states of Malaysia is intact, recognized internationally and recognized by the United Nations. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says:
      "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia".

    During the past Philippines Administrations, China was the only occupying the West Philippines Sea or within EEZ 200 nautical miles. They were strict guarding the said territories and even now they are still very strict to the Pilipino citizens or fishermen. Therefore China is the only one responsible for neglecting the destruction of the coral reef and why they did not monitor it.

    If you called it a rent, where is the agreement between Sulu and Malaysia? If none, it is just like what pirates and mafia do for a living. Why in the 1878 agreement, Malaysia not mention? Is there any clause in the 1878 agreement that Malaysia inherit responsibility to continue paying Sulu? Why in the receipts that are in Sulu possession do not mention the money is for the rent? Why the amount is so small and not what been stipulated in the agreement? One Mexican gold dollar (coins) in 1878 has a weight of 1.7 grams of gold. So, 5300 X 1.7/1000 = 9.01 kg of gold. Compare the value 5300 Malaysian dollar to 9 kg of gold. Giving away money is not an offence. Can give or stop giving anytime.
