      She was in charge. That's the bottom line. I don't think she is guilty of something nefarious, she just being her. She's smug. She probably lives in Newton MA or Cambridge MA, but they are a little more crazy-leftey then they are smug and thinking they are better than anyone, Seems like pure Newton to me. Sloppy work from someone who thinks they are so good they don't really need to pay attention to the details...those are for the little folk.

    • @evelynmahoney3569
      @evelynmahoney3569 Před 16 dny +4

      Verbal instructions referred to were likely made to the jurors in private, outside of the attorneys' presence.
      The way she said, when dismissing the jury, "I'll be in to meet with you privately in a moment." sure sounded like it wasn't the first time that she'd met with them privately.
      She can easily deny any verbal instructions if she needs to, or claim the jurors must have misunderstood.
      Not so with written instructions, which are also the ones the attorneys are privy to.

    I was on a jury where this happened. EVERYONE thought if we hung on a SINGLE count, it made ALL charges hung. I kept telling them NO (because I was the lone holdout) and they absolutely did not believe you could convict on ONE charge only. They were livid that I was causing them to hang on ALL charges, which I wasn’t. I did find guilty on ONE charge. The ON.Y thing that saved the day was one of them, in trying to prove me wrong,asked the jury liaison, who said “No, you can convict on one and not others.” If not for THAT, they would’ve never believed me. So, we convicted on some, hung on one. Believe me, if not for the liaison telling to them to their face, they would have continued to bully me to convict on the one charge. The judge DID tell us from the bench before deliberating, but no one paid attention. They acted like they didn’t hear him. Anyhow, I can totally see how this happened.

      Also JUST KIDDING lol. I’m sure whatever the issue was, it was a good thing you stuck to your guns. We need ppl with integrity like that.
      What this DOES tell me is that we need to change the way we instruct jurors. I HATE all the wording and legal jargon. Lawyers and judges etc are educated on how and why those terms are important. Jurors are not. The wording and way it’s handled needs to be fixed to read in layman’s terms.
      To be clear, I’ve never served on a jury, but this sounds like it’s an issue that’s been swept under the rug for a long time. Sadly I blame it on ppl like this guys dad. He may be a good guy and he seems to have raised an amazing son, BUT he brushed off jury instructions and explained that it was nothing out of the ordinary… This is where the issue lies.

      The prosecutor and judge know 2 people in the house have confessed. They know Higgins went around telling everyone who would listen he just held Chloe back while Colin and Brian Albert beat John.
      The judge and prosecutor know 2 Canton cops grew a conscience during this and were willing to testify to what they saw happen in the sally port. I'll give you a hint. They didn't accidentally frame Karen Read. They didn't jump the gun and blame her. They outright framed her.

    Watching recent trials I have decided that so much depends on the judge. I was on the jury of a murder trial many years ago. It was a capital punishment trial. The judge treated us very well and made it plain that we could ask any questions we needed to ask. After reading the instructions and we went to the jury room, he came in and asked if we understood everything. He explained the evidence that we had in the jury room and told us to do our best. We asked several questions during deliberations and all were answered relatively quickly, since he had to confer with attorneys for both sides. Deciding guilt or innocence in any trial is stressful, but a judge can make it much easier. Sounds like judges these days need special training in dealing with juries.

    I said it at the time that Auntie Bev's Jury instructions were overly complicated and the Verdict Slip was illogical. When Atty Jackson forced her to change it, she repeated the same Jury instructions so they were probably no better off. All she had to do was tell them that if they found KR not guilty on any charge then tick that box. And the Tuey/Rodriguez instruction was pointless considering what were the Jurors instructed to do other than what they were already instructed to do, AND, the verdict still had to be unanimous. Auntie Bev knew what she was doing here - skirting the line between duplicity and outright fraud.

    You stated that if the defense attorneys didn’t argue their objection about the jury verdict forms to the judge then oh well or whatever, etc… but here’s the problem: Jackson did argue pretty hard with Bev about the confusion for the jury & stated there needs to be not guilty boxes all the way down, but Bec wasn’t going to hear it and was like, No this is how I’m leaving it. It’s how we always do it in Massachusetts. Then sometime later Bev comes back out and said ok…here’s what I’m going to do blah blah blah and she added an extra instruction. So it could be that maybe Jackson wasn’t going to push or argue anymore about what Bev finally decided to do because he was glad at least she added the instruction and he didn’t want to risk Bev changing her mind & not add the instruction and so Jackson left it alone at that. My point is that Jackson did argue. It got heated between Jackson and Bev. So we can’t say he didn’t argue.

      If I recall correctly, when Bev came back with the modified verdict sheet, she stated she added the NG choice, but I don't recall her showing the parties the form to verify.
      Same with their little bingo thing to choose alternates. I'm pretty sure the defense asked to confirm the numbers inside and Bev denied their request. Also, she chose the Foreman first which was really strange. Choosing the Foreman before the alternates guarantees that juror would be on the jury.
