    They didnt mention it in this video, but on the local Hawaii news, they reported the developer didnt conduct a survey prior to building or selling the property as is required by Hawaii state law. They apparently located the lot by "counting the light poles," which obviously isnt reliable. They tried to cut corners by not hiring a surveyor. They're very clearly negligent and at fault, so amazing that they would have the gall to sue the property owner for their mistake.

      That's funny because a survey is only about $600. Anything built on your property illegally is yours to do with as you please in the eyes of the law. So she just got a free house out of this deal. With idiots abound like this, the housing crisis will surely end soon.

      You need a survey before getting a building permit. You can't sell a home without running a title search. She needs to find out what Title Company was used for the purchase transaction. Sue them for letting the sell go through.

      and that in fact is the sole reason to keep resisting. Otherwise you could defraud people of their land just by illigaly building on it and sue to make them sell you the land. It would create a dangerous precedent. And iam not talking about small time builders making a mistake, but big developers just building on any land and dragging land owners into the courts to force them to sell.

      That's right,@@brianw4brian. It's a regular practice here to get a judge drunk on Christmas or New Year's Eve; so that the judge will sign papers to approve filling in ancient fish ponds and the like in order to build hotels, golf courses, and sub-divisions, etc, on sacred lands.

    She needs to hire a really good lawyer that specializes in this area. Doesn't matter that they made a costly mistake, they're in the wrong 100%. She shouldn't have to pay one dime to rectify this situation...if anything, the contractor will end up paying her attorney fees and compensate her time/aggravation, court-ordered.

    not only does the landowner NOT have to pay ANYTHING for the house that was built on her land, the construction company that built the house will need to REIMBURSE her for the cost to KNOCK DOWN AND REMOVE THE HOUSE, even if she chooses NOT to. none of these costs or issues are her fault.

    They never stated under exactly what terms the developers sued this woman. Reynolds is being sued by Keaau Development due to her being "unjustly enriched." Building a house on someone else's property without their approval or consent apparently makes them liable for restitution in their eyes.
    Even if everything is the contractors fault and this woman is absurd, its her land to choose what is done to it. They literally bulldozed her land's massive vegetation. Suing her and expecting her to cater to their whims is completely unrealistic. Keaau Development are purposely dragging this woman through the mud.

      This woman is a jerk. Why can't she just take the lot next door. They are both equally flat, same size, they look identical. She could request a $5000 fee or more for them screwing up, and come up on top, with a 25% discount on a lot she paid $20,000 for. This is how humans hurt themselves by being thick headed and stubborn. This negative could be turned into a positive for her if she had the intelligence and metal flexibility, but no, now lawsuits left and right, frustration, bad feelings for all, and bad relations with future neighbor.       This is the type of frivolous lawsuit that the wealthy and big corporate use to force unfair concessions from normal people with normal means. The only thing here that matters is that a developer stole someone's land. The nature of the theft is irrelevant. If the situation were reversed, the developer would win 100% plus full legal costs instantly at the expense of the normal person. This is part of our 2 tiered justice system that almost always favor the wealthy over the rest of us. The only correct outcome from this situation is that the property owner gets a full and 100% say so as to how the developer's mistake will be disposed of, and completely at the developer's expense. The developer is a professional and therefore should know better each and every time they build anything.

Well, an honest judge will listen to her and tell the companies involved "You had due diligence to verify the land you were building on was correct, its not the owners job to look over your shoulder or approach you, that's YOUR job. The owner of the land has objected to the building on their land. You will pay them for damages to the land, and $2,000 a month for using the land during the duration of its use from the day you broke ground to the day said ground is made whole." Because that, is exactly what those corporations would demand of her if she had built on their land.

    Am a Contractor in Florida, non hiring surveyors is their fault, it's the owners home now, those contractors should have their licenses revoked. And pay her money to remodel the home as she wanted, even daring to disturb her with this is so wild.

THAT is adding harrassment on top of the inconvenience, stress, legal fees, travel expenses, and even the cost of having the house removed and the property restored to its previous condition. The developers trespassed on her property, and built a house on her property without her permission or knowledge, then tried to sell it. Then, when their offer of swapping her lot with another wasn't accepted, they sue her?
      Honestly, the developer messed up. And they need to make it right.

      Developer didn’t error, general contractor did, developer is suing all parties involved, that’s what has to be done. She will not get the house unless it saves the builder compared to moving it of tearing it down.

      @@richardnassano623 THAT piece of information isn't specifically included in this video. I don't believe it's mentioned WHOSE mistake led to the situation. Did the developer give the contractor the wrong information, or did the contractor have the right information but sent the construction crew to the wrong lot, or to the right lot? Did the construction crew mess up? Was a surveyor get called in or not? Did the surveyor, if contracted, make the mistake? How, exactly was the mistake discovered (I got the impression it was the Title company or govt. agency that found the discrepancy)?
      The reporter states, "The construction company built this particular house on Ann's lot by mistake." But there's no follow up as to whether the construction company built on the lot they were instructed to build on, or whether they went to the wrong lot because they didn't double check. Whose mistake WAS it? Developer? Contractor? Construction company? Exactly WHO mistakenly said, "This is the lot"?
      It's odd that the REAL owner states that the REALTOR called her to tell her "I just sold a house that happens to be on your land." How did the realtor "sell" it, and how did they discover the mistake? My guess is that when the sale was submitted the title deed didn't match. It sounds like the Dept. or Property Records rejected the sale.
      The biggest insult here is that the developer sued Ann (she's named alongside everyone else involved). Ann is actually the victim here. In one sense, one could say that her property was vandalized by the contractor working for the developer. That's like crazy. It's harassment. Now she has to hire an attorney to defend herself against this bully developer.

    This is an easy case win for the lady. Any reasonable and ethical judge can reason that the developer trespassed on her properly and without consent or authorization "placed a building on her property". Therefore, the developer needs to "remove the building from her property" and at its own expense. The developer may be required to pay the lady for any damage to her property, including emotional and mental stress inflicted onto her by the developer. If I were the developer, I would withdraw the lawsuit and remove that building and all fixture as soon as possible from her property before she counter files for damages.

      actually, the developer didn't contact her. The realtor that was selling the house did after she did a title search or something like that when she found out who the REAL owner was.

      no, it isn't strange. when the house was sold it went into escrow and when a title search was done it was discovered that the property belonged to her. that's why the realtor called; it fell out of escrow.

But she doesn't have to do this, but I think she should be looking for some kind of compromise solution. It will be interesting to see how this turns out.

It's their screwup, they're at her mercy, but they're trying to bully her into submission by suing her is how it seems. Still there likely have a lot deeper pockets than she does, she'd be better off accepting the lot next door and moving on, everyone makes mistakes.

      Dont believe this ladies story…. HPP is common 1acre lots on invasive species scrubland 5miles from Hilo. They have zero access to ocean for swimming because of sea cliffs. the lots have 2-4 inches of soil and are infested with 50-100+’ tall albizia (this home has 3’ tall babies in the front yard that will become 50’-80+’ tall in 15 yrs with a base 7+’ wide…
she could settle for a better endemic Ohia lot, ….there are thousands in that HPP subdivision.and even better lots uphill/mauka from there….
FYI most everyone in Puna lives with many unpaved roads, we have 13 traffic lights in 500 sq miles of land, we have solar and water catchment or fill stations, we dont have home mail services we all go to PO… we give directions by mauka/makai and power pole numbers or mile markers on hwy as most raw cinder/lava road dont have signage and many dont have address posted for homes unseen down long driveways. Most lots are 3 acres (3 football fields) .. these thousands of 1 acre lots HPP are smaller and full off invasive species.. its a bedroom community for Hilo that suffers w/ bad traffic on its only hwy…. iow This mainland EastBay kine lady IS hyping this for attention, this is not that rare but kinda rare they didnt catch it before they started building…

    This woman should counter sue the developer for filing a frivolous lawsuit since the developer hasn't a leg to stand on. This is one more example of a wealthy entity abusing the legal system to scam a normal, hardworking person out of her property and it should never be allowed. In fact, this woman should not only be given her property back with her choice to keep or demolish the house at the developer's expense, the owner should have the option to force the developer to revert the property back to its original state so she can pursue her goal of building the house that she wanted. That includes all vegetation, landscaping, and everything else that made the property attractive to her in the first place. The developer should also be forced to pay her for all of her expenses incurred by this so called "mistake."

    In most states, the builder is out of luck. He builds a house on the wrong lot, it now belongs to the lot owner. She owes him nothing. If the builder pursues legal action for his mistake, he opens himself up paying the landowners legal fees and she could also make a case for damages as she now has higher property taxes, insurance, and maintenance cost she did have before the builders mistake.

    She should have a free house here. Developer messed up and built a house on her property. She signed no contract to have a home built so they can’t lien her property. She owns the property so what’s on it is hers. She can sue them and have them remove the home off the property which would cost them even more money or they can write the cost of the build off and walk away. She can’t be held financially responsible because they made a mistake and they can’t force her to take another plot. Hire a good lawyer and be happy you got a free house and probably utilities run.

    Developers mistake. They should just take the loss and give her the house. Sure, they can tear down, but they better clean it up back to the way it was. The realtor should lose license. How can u sell when the paperwork for the land ownership doesn't match up. The city, loaner, inspection, escrow and and everyone involved should be investigated for fraud. You proceed with this complex transaction without landowner consent or even knowledge!?

      Was it a mistake? Or did they investigate the property owner and figure out how much assets she had or didn't have. If she didn't have enough assets to withstand a lawsuit, then they could win simply by outlasting her in expensive litigation that was dragged out over a long time period in order to increase her legal fees and legal per diem costs. Eventually, lacking finances would force her to sell her property (to the developer) in order to pay her legal expenses.

    Seems to me no one is expecting anything from the landowner and she just got swept up in the lawsuit as due diligence. I am just at a loss how a construction company made such a grave mistake. The landowner should be suing them to remove the now squatter's house on her plot of land, she should sue for her emotional stress, pay her lawyer's fees, and pay to get her land back to it's original state!

    When you purchase a house or a piece of land you should always perform a property search by a professional. The Developers failed to do this and their NEGLIGENCE resulted in a house being built on the wrong lot. The owner of the lot was totally unaware of what was happening. The lot owner did not giver permission for anyone to be on her property so from the minute other people put foot on her land they were trespassing as they had no legal right or reasonable excuse to be on her land.
    .
    There are 2 possible options:
    1. bulldoze the building and return the land to its ORIGINAL state. This means planting mature trees and vegetation etc...This option does not enrich her and just returns her to her original state.
    .
    2. acknowledge their negligence and acknowledge that the structure is hers to do what she wants to do with it. The option does enrich her BUT she is now not able to develop the property how she wanted to. She will also be subjected to additional taxes, maintenance, and security costs. She will either have to rent it out or move there to stop squatters etc. From this perspective, I do not see her being enriched as we do not know WHEN she wanted to live there. She may have purchased it to retire in and wanted to keep the native vegetation intact until then.
    .
    This is why as a professional, you must make sure that all checks are performed and not cut corners.

      Nothing to do with title insurance. The property wasn't sold or transferred to the developers by the rightful owner. The contractor was hired to build a house on a different property.

    In our neighborhood, a house was built partly on another lot. The 400' water well was also placed on the wrong let.
    All of the contractors lost in court and the home owner and their neighbor got a huge reduction in the costs of their homes and one reduced price free well. The other lot didn't have it's own well on their lot yet. Mistakes cost.

      I have never been in a subdivision where 2 lots are equal... view, angle to sun, drainage, elevation, foliage, sq/ft... even distance to utilities as they would have to be brought in ... there are always differences. Personally, I would've taken the other lot and if it wasn't equal, asked for compensation for the difference. But again, if this woman picked her spot using astrology she is not going to have the same criteria I have.

    I don't live in Hawaii but I checked online and Title Insurance is mandatory for real estate transactions in Hawaii. If there is a dispute, the developer needs to file a claim with the Title Insurance company.

Lawyers answer to the State, attorneys answer to a private bar association and are practically immune from any penalties for doing wrong, bearing false witness and trespassing upon a right.       It is almost certainly not a good lot, not in a good area, and probably "high lava hazard". There are some scammers on the big island that sell dreams of an affordable Hawaiian paradise to people on the mainland that are unfamiliar with the big island. I think many people see other people's tourist photos of Maui and just kinda assume all of Hawaii is like that. I love the big island, my favorite island, but there are some places I for sure would not buy or rent. There are some parts on the south end of the island that almost look like the surface of the moon or something.

      @@farmerbill6855While it does give her leverage as the owner of the property i would pause on the ownership of the house. Consider financing of a car or a house. You sign an agreement to make monthly payments which, once paid in entirety, you receive the title/mortgage of the property. I feel the in the end, this lady is going to take over any money due to financiers. The "unexpected burden" of assuming this takeover should offer her relief in some form from the $500,000 valuation of the house. I am guessing she is due either $75,000 in damages or acquisition of a $250,000 - $300,000 debt. Either way she may have figuratively struck gold, but not the lottery.

    Technically the house is the property of the land owner unless there is signed agreement with the builder she can lien it until they settle, the builder needs to eat every last penny of that house, as far as alterations to her land, that could also be reasonably considered legally. This is nightmare for the builder, but a gift to the property owner at this point. I'd turn around, and let the builder know how much the property is worth $$$$$$$$$, though reasonable price for the property fair market value etc etc etc, she still has a right to occupy I believe, then sell at later date when economic conditions are better. That said the builder is probably going to still try to put a lien on the house on her property, but she can turn around and charge for use of her land at what ever price she want's...... I'm betting the builder was cognizant of exactly what they were doing, and if there was fight, they would try every legal angle to delay the process that ultimately rest with the builders.

    Obviously there are issues in real estate and building on land when you don't hold the deed should not happen.
    However, she lost me when she said this zodiac is why she bought the plot...... I know that should be matter, but it's laughable.

    If they rule in her favour, is she entitled to keep the house or will it be destroyed? Would the developer have a right to destroy it or would it be trespassing? There's no point in wasting that house, she should have it for free as it was built without her consent on her own land. Imo that house is hers. If I build a shed on my neighbour's lawn without his consent, that shed isn't mine. I wouldn't have any right to enter the yard again to destroy/remove it. I would be trespassing. Same rules should apply to her land right?

I don't know if it's the same developer but a developer tried to buy her property before all this happened and she refused to sell because of all that she did when she picked this particular parcel of land.

    Get a lawyer ASAP, they "make the mistake" ( I Dout it) why would they try to get you in trouble when they are the ones who made the mistake, in any case you should sue them for damage / trespass, stress etc. on you and your property.
