    What the ATF did had all the markings of a hit job. There was zero necessity to do an early morning in-the-dark raid, covering up the homeowners camera, cutting the power, over an issue of "a firearm license". Insane.

      The man in Arkansas ? The ATF had a warrant that didn't apply to him personally, only his safe with his guns in it. It was a no-knock warrant. At 6am the ATF broke down his front door and he went downstairs to see what was going on, and the ATF agents shot him in the head, in front of his wife. It was a 10 car SWAT team withlocal police. All body cams were turned off. (Hmmm...) They could have just called him and said they were coming with a warrant, HE didn't even need to be there. They waited a whole week until they knew he was there. This man was a $200K a year airport executive who had been selling his own guns-which is legal, but the ATF claimed he was "in the business of sellingb guns without a license". Not true. Those were his personal collection and he was selling them off. For that they murdered him. Waco, Ruby Ridge, the cattle rancher in Montana, Ashley Babbitt, and now Mr. Kronowski in Arkansas. Not one single jackbooted nazi thug US government agent has been prosecuted for ANY of those murders-with the exception of Waco, all victims were unarmed. Where are we living-Venezuela?

      He was trying, the Senator cut him off 4 times. Basically, the ATF is saying that the senate fucked up their definition of a rifle and by extension a short barreled rifle. The senate has not defined what a “pistol brace” is in law, only a rifle and short barreled rifle
      Under title 18, part 1, chapter 44, 921, of the U.S. code (7) reads “the term rifle means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder… fire a single projectile… through a rifled bore for each single pull of the trigger” (I removed some of the legalize to help, confirm yourself if you like)
      (8) reads as “the term short-barreled rifle means a rifle having one or or more barrels less than sixteen inches in length and any weapon made from a rifle… as modified has an overall length of less than twenty-six inches.”
      The argument the ATF is saying is that: since a rifle by definition is a weapon intended to be fired from the shoulder (including being made or remade to do so). When a brace is attached to a pistol, that pistol has been remade to have the intention to be fired from the shoulder. (A brace is designed to allow the weapon to be braced on the shoulder). Thus by the definition within the law, the pistol is now a rifle.
      Now that it is a rifle, it is now checked to see if its barrel is less than sixteen inches, or if the total length is less than twenty-six inches. If the “pistol” turned rifle is less than either of those measurements, it is a short barreled rifle.
      To me, the ATFs argument is actually sound, mainly because the Senate really fucked up their only job and messed up the law. The fix? Redefine a rifle and SBR to something that makes sense.

      The NFA was created to lock certain weapons behind a paywall, thus preventing lower-income people from using them. $200 in 1934 is the equivalent of about $4,500-5000 today. So ask yourself, who were those low-income people? What demographics did that impact?

      Unironically the ATF actually have a good argument for classifying pistols with braces as rifles.
      The logic being? A rifle is defined as “a weapon intended to be fired from the shoulder” by the SENATES laws.
      This makes a pistol with a shoulder brace a rifle since a shoulder brace is intended to be used to brace a pistol with your shoulder. (Wow shocking I know)

      @@lisafeck1537it’s because the 1934 act is still in place and has never been revised. The definition of both “rifle” and SBR within the actual written law are from this 1934 act.
      Nobody complains that the constitution is still part of the law even though it was written in 1787.
      The senate sits on its ass in vacation half the year, and doesn’t revise shit definitions like that a rifle is “a weapon… intended to be fired from the shoulder…” (18 U.S. code 921 - definitions)
      Which a pistol with a shoulder brace is intended to be fired from the shoulder, suddenly makes a pistol a rifle, and therefore an SBR. All because the senate are lazy pieces of shit and can’t write a laws even if it’s their only job.

      In 1968 Congress passed the Omnibus Safe Streets Act, which enabled the BATF.
      It also made something new happen: "Enabling Legislation".
      Congress punted on a lot of actual regulations, by saying:
      "The Director shall..." and under Administrative Law?
      That's the same as Congress saying so.
      It's wrong, but there's a lot of case law to support this.

    Congress needs to man up and tell ATF they were not elected to pass any Laws and they don't have any legal rights to dictate what our 2nd amendment Rights are. And make something illegal when no law was passed by Congress or made so by the senate, the ATF is and still is over stepping their mandate to just uphold the Law. This is just smoke and mirrors for the public to make it look like they are going to hold any federal agency accountable for any illegal over reach.

      The ATF regulates firearms. A “firearm” is defined as the receiver in which the firing mechanism is put in place. Braces are not firearms. Stocks are not firearms. Safety devices are not firearms. Yet the ATF regulates them all the same. The ATF cannot make laws, only enforce them and interpret them. They “interpret” definitions to fit their ideals and enforce the “rules” that they are in charge of defining. Pure tyranny.

    I don't owe anyone $200 so I have permission to exercise my rights. Who the hell do these people think they are that they believe that they have the authority to infringe on people's rights? They have no right to do so. They are extorting people and kidnapping under color of law. It is illegal for senators, representatives, judges and LEAs to make and enforce "laws" that require people to have written permission to do things and have things that we were born with the right to do and have. The constitution says "The right of the people to keep and bear arms shall not be infringed". That is the supreme law of the land. When someone is put in prison because they had a fire arm and it was not registered or they had it in their pocket or in their car, the arresting officer is a thief and a kidnapper. The judge is a cartel leader, and the jailers are kidnappers as well. The prisoner had the right and did nothing criminal. The legislature betrayed the people and committed treason in direct violation of the law. The definition of a crime is when something is done that is against the law and generates a victim. It is against the law for the members of the legislature to make laws that are unconstitutional. That also means the act of enforcing unconstitutional laws is a crime. Enforcing an unconstitutional law is the same thing as kidnapping, extortion, robbery, assault and murder. And the strip search done on the people put in jail who have been arrested unconstitutionally is rape. Most people are too stupid to wrap their head around this fact.

      Have to justify wasting tax dollars on tactical hit squads by creating firefights that could have easily been avoided. Why does the ATF need armored vehicles and machine guns? Because instead of arresting criminals in a safe way they turn towns into war zones and common criminals into terrorists. Can’t stop mass shootings, or gangs, or gun running Cartels (who get their weapons from the ATF directly) but they can show up to your house in an LAV and turn a search/arrest warrant into a siege/skirmish.

When you actually talk to people in the industry who have actual records kept of the items sold, it is between 10 and 40 million sold.     The ATF decided to change the law to call an item that helps people with disabilities continue to maintain their 2nd amendment right, the pistol brace. A short barreled rifle will fire less accurately over a longer distance than a long-barreled rifle. This is evidence the 1939 act needs to be changed or scrapped.
    With his argument he could be even more creative and call a pistol, an "extra short barreled rifle," and make it illegal.
