- The plaintiff and defendant met on a party bus. The plaintiff was drunk and high while on the bus and she was dancing on a pole when the bus hit a pole. She fell down, and the defendant posted the video of her falling online without her permission. She’s suing for defamation. The defendant argues she was recording someone else, but then the plaintiff came into the shot. She’s countersuing for defamation and harassment.

In other words you can film/tape someone driving,jogging,pumping gas, shopping, walking their dog,even working.that doesn't mean you can film someone in the bathroom,in their underwear,having sex, .for example if you are at Walmart and you go to the restroom and there is a a hole in the stall you can't film them . Even if if it's a single consent state their are limits to how and we're you can film a person.

Ok some of you guys seem to be confused on the privacy and filming laws. If California is a single consent state the defendant had a right to film her that's legal,but you can only film someone doing appropriate things like mowing the lawn, working out at the gym, playing sports, shopping, washing your car. For example if I go to Walmart yes I can be filmed,if I go to the restroom and their is a hole on the door or stall you can't film me peeing or changing my clothes. If someone rents a hotel for the weekend and they are on the bottom floor I can't stand outside their window and film them being intimate, pleasuring themselves, walking around nude. In this case the defendant chose to film her private area which is the same as the last examples I used. If the planiff had regular pants or even a bikini then she would of lost,bc getting drunk on party bus and falling is pretty common,but once a private area is exposed or filmed it nist be deleted or edited out. She could of filmed everything before and after that.

The defendant is hands down the worst court show litigant I’ve ever seen. Hopefully she got some bad karma since this case aired. And those picking on the plaintiff; shame on you. Yes videos like that can get a person fired. Some major companies have policies that they will fire an employee if they have any risqué content online including videos (like this one that the case is about), pictures, explicit sexual dialogue in posting, and the of course Onlyfans/erotic sites. Heck even in the past couple years there’s been several suits brought on from fired NFL cheerleaders for wrongful termination of instances like this of either an account they had or a risqué video or photo going viral.
