Non-judicial punishment under Article 15 of the Uniform Code of Military Justice or UCMJ is designed to dispense with the time and effort of going through a court martial. Usually offered by a commander for minor infractions when he is certain that if the case went to a court martial that a guilty verdict would be rendered. When offered an Article 15, the offender has the right to request a trial by court martial. The caveat here is that the court can dole out a much more serious sentence than can the commander under an Article 15. The sentence from an Article 15 also depends upon the rank of the commander. A field grade commander, O-3 and above can dole out a stiffer sentence than a company grade commander (O1-3). A commander should never offer the Article 15 unless there is near certainty that a court martial will find the perpetrator guilty!
