      The problem is when answering the door with law enforcement on the other side, any move you make can be deemed as a threat, and when Fortson's left arm came up, the officer made the fatal mistake. He won't be charged.

      She told the officer it was the fourth floor multiple times, you can see in the bodycam footage that he exited on the third floor and stayed on it. She even told him before he entered the elevator because he asked and she said yes it's the fourth floor.

      Smh. I don’t know how anybody could have the opinion in this original comment unless they are someone who does not have the ability to think more than one step ahead. Based on this premise, I would never call the police if I thought a woman was getting her skull beat in. if I see men committing a home invasion, I won’t call the police there either. Because I always could be wrong. Maybe the men were just playing around when they acted like they kick in the door, and they were just delivering guns that the homeowner had actually bought from them. Or maybe they held something else it look like a gun. I mean, how can any adult literally have this type of thought process. I’m not even trying to be nasty, I really don’t get it.

      You should look into a case from San Jose, Ca around 2007. A Cop walked into a wrong home, discovering a Vietnamese woman prepping food in her kitchen. She challenged his presence in her home, again, while at the counter cutting vegetables with a plastic knife. Officer Blue unloaded on her fearing for his life and San Jose PD basically told the husband you need to drop your lawsuit against us before well pay. As soon as they settled the husband and two grade school daughters left the Bay. I was doing home healthcare at the time servicing the asian community and would get to hear all of the community chatter.

      Unfortunately, the deputy was legitimately responding to a domestic violence call and was duty-bound to investigate the situation. In the course of this investigation he was presented with the subject of the investigation who was holding a weapon. If the Airman hadn’t been standing in front of him with a gun the there’s a nearly 100% chance that this would have been a non-event. The Airman made a really poor choice and here we are.

      Incorrect. It takes a fraction of a second to point a gun at someone. Constitutional case has determined police respond to the threat of violence, not the violence itself.

    The subject matter is not that the Airman came to the door with his gun, it is why did the officer shoot a man posing know threat to him. Former Police Captain stop trying to create a narrative to justify the shooting, you said it appears that the Airman’s gun was pointed down when you know good damn well the Airman’s gun was pointing down in his right hand and his left hand was up with palms open. The Airman showed more Transparency than the police officer and yet he is the one who gets killed. This officer needs to admit he was wrong by excepting very little information, because the woman said I believe the noise was coming from the top floor

      They were responding to a domestic violence call.. in a domestic violence call they don't announce their presence, or stand in front of the peephole because they don't want the alleged offender to do something drastic to the alleged victim. Do you understand? Not only were they following their training, they were there TO HELP.
      They made a mistake. Have you ever made a mistake? It happens. The officer that is crying on body camera is showing remorse. You know, a feeling somebody gets when they identify they've made a horrible mistake?

    The deputy knocked and then stepped away from the peep hole several times. He's the reason the airman went to get his gun. Roobers and killers have been known to say they are the police to get victims to open the door. That itchy trigger finger cop didn't even give a command to drop the weapon. And then after the airman feel and dropped the weapon the cop starts yell as if he still had the gun. I'm glad the young man was able to say on cam that he didn't have the weapon which was obvious on the video.

      You are exactly right. You are not required by law to open the door for the police if they do not present a warrant. You can communicate through the door. NEVER open the door for police. Never leave your door unlocked. I live in Dallas and in 2018 a black man was sitting in his apartment eating ice cream and an officer mistakenly went to the wrong apartment and shot the man dead thinking it was her apartment. She’s in prison. Rightfully so.

    28+years n law enforcement myself and I have concluded that based off of my personal experiences that we must always assume any statements made from law enforcement to be a lie designed to confuse the truth until proven otherwise via credible evidence.....period. Remember, with law enforcement, it's us (police) against them (citizens/you). No thought necessary when it comes to pulling the trigger once the officer saw the color of his skin (Black) and the gun (pointed in a safe direction DOES NOT MATTER IF MINORITY) it was in his mind a good shoot. If Roger Fortson was white, trust me when I say that caution and care would have been the order of the day. In the end, by changing nothing, nothing changes. The capt is an idiots/plant on here making excuses for the police officer are a disgrace to policing. They have no clue to current policies and procedures, and both are from the past. Remember, even though you spent 30 yrs in law enforcement you only have 2 yrs experience responding to situations similar to this. Remember folks, a capt. is a pen pusher and nowhere near the front lines/street only showing up after the fact to judge actions he can't do.
    Second Truth: So the point to yell drop your gun after you shoot is a police tactic used to confuse the truth. In a shooting, there will probably be witnesses and police are trained to yell verbal commands after a shooting because law enforcement knows that witnesses are notoriously bad and just plain not reliable at best. Law enforcement takes advantage of this known truth to bolster their false narrative. Law enforcement knows that half of the witnesses will say "I heard the officer say drop the gun before, and half will say I heard the officer say it afterward". A 50/50 chance is a win in the eyes of law enforcement and the courts. Remember, law enforcement contends that citizens are stupid especially Black People, rich or poor.

    There was literally no officer safety issue except the one he created by the scary, unqualified officer. He saw a black man holding a weapon in a non-threatening manner and killed him. 2A does not apply to any black person when you police with racism and biases.
    There was no disturbance in the victim's apartment; that's the first clue. The deputy hid his presence and voice initially. He then gave commands, from cover, after he shot the victim 6 tines. This captain is a clown and likely helped other officers commit the same reprehensible acts of violence. He wouldn't give this same critic if it was him or someone he actually cared about.

    That hairless gentleman didn’t explain the first knock. He also leaned against the door and knocked, and said nothing. He moved out of sight for 33 seconds before knocking again and he then announced himself twice. But by that time it was too late because of the hide and seek games , the Airman went and retrieved his weapon.

    The officer left the leasing office while a phone call was being made and trusted a random woman in the parking lot who did not even know what floor the apartment was on. She told him it was on the 4th floor. The officer went to the 3rd floor. How did the officer know it was on the 3rd floor?? It was a set up!!

    What kind of neighborhood is this apartment in, is it the type of neighborhood where you would answer a door with a gun in your hand.

    The apartment had no windows in the front for the airman to verify who was at the door.

    I believe the young man was on the phone when the cop knocked. He may have heard the banging and loud talking of the cop, but it may have sounded like background noise to him. Either way, the cop opened fire because he saw a gun in the young man's hand, NOT because he was threatened. Cops always panic when a black man is in possession of a firearm; even if legally possessed.

    Frankly, I don't believe that the airman knew that it was a cop behind the door, because he could not see him through the peep hole, as the officer stayed off to the side of it. This is all based upon how the airman appeared to react when he saw the officer. It was surprise and made a gesture for the officer to wait or stop or don't shoot, I'm not a threat.
    He never raised his gun at all and the look on his face was that of shock and surprise, not a look that says I'm going to shoot you.

    You don't have to obstruct the view of the peep hole, all you have to do is step out of the line of sight. The officer clearly steps to the side of the peep hole. This tactic has been used many times to carry out home invasions , in fact I would be surprised if the officer didn't know that. If you get a knock at your door and can't see who it is , you grab your gun...The deputy should have stood in front of the door so he could be seen.

      Standing in front of a door when announcing you are police could get an officer killed and is not protocol.

    you can tell by the airmen reaction when he opened the door, he didn't expect to see a gun pointed at him , the officer just reacted too quiclkly when he saw the gun, the gun was obviously pointed down in a non threatening manner and the airmans other hand was up as if to say dont shoot im no threat.
