      @user-dw1ls3rp1l thank all the people that voted democrats and Newsom, californias wish to clean the air meant all commercial vehicles had to be replaced with new ones, and all new commercial vehicles with DEF keep breaking down , turbos, diesel engines and exhaust filters have major upkeep costs in the many of thousands per year, there is California with all the clean air laws and the 49 states that still permit older trucks that run forever with little maintenace costs its just as bad as cvt trans in cars, it's not just towing all trucks have problems and the consumer voted to pay for it , you also pay for it at the grocery store with higher freight cost comes higher prices,
      Then insurance for tow trucks is non existent or thru the roof in califirnia if a business can even find it, insurance have been pulling out of califirnia for other things like houses and cars, that is the answer people voted for clean air and the high cost, in a few years all trucks will have to be electric which means consumers will pay for the replacement costs. The bay area , LA and San Diego have the highest real estate prices, consumers pay for that too.

    Every tow company I have heard of and every person I know who has had a car towed, has a story similar to this. They are sleazy, charge too much, and usually break laws.

      My son borrowed my car, parked in a NO parking so it got towed, I called the tow company to find out about open hours, they told me and added that I could only pay with cash, I hurry to the lot and the bill is $120, all I had on me was a hundred dollar bill and a 50. He dropped the money in a slot on top of the counter and handed me a note to show the gate keeper, I ask for my change and he said, "Sir we do not keep cash on hand". True story and my car was towed less than 1 mile and sat on the lot for less than 1 hour, I got more respect for somebody robbing me with a gun, at least they make no pretense about robbing you.

      yes the cops cite the car then have it towed. the tow company needs an 180 form from the police to be able to move the car. then the tow company has 3 days to file a lien on the car. that notify lien holders, and registers owners that the car is in their possession.

      Actually ca has a state law to change your address within 10 days on the car registration, so when a tow company liens a car and DMV sees a military address it voids the lien sale, most people don't comply with address changes and then they wonder why

    When I deployed, I was informed that NAS/MCAS MIRAMAR has warehouse space for vehicle storage. I had to fill the gas tank and disconnect the battery. After 7 months, it started up.

      It was not parked legally. His registration was more than six months expired and that was the reason it was towed. This guy thinks that our streets are his personal junk yard like many service members think. He is too stupid to be an officer in the military if he can't handle simple responsibilities like paying his registration or not leaving his car parked on the street for months at a time.

    This company will pay dearly now he pocketed 2500 for the car , its more then 1200 he reported and the a huge fine from the feds and then paying compensation to the service member another 10k. So good towing job.

      State law authourises police to order tow trucks to tow vehicles.
      State law requires registered owners to change the address within 10 days, the DMV lien unit would have red flagged the tow lien.
      The service member is supposed to leave a person to handle their affairs while deployed
      The tow company should have checked the SCRA military website to authenticate military status since creditors cannot perform collections or repossesions without a court order on service members.
      There was negligence on both party's, specially waiting 4 months until finally report and file a lawsuit

      Kind of hard to do something when you are out in the middle of the ocean and your ship does not come back to port until 4 months later. Or did you miss that part? Also, nowhere in the report did it say he was from out of state or moved, only that he had a friend watch his car while it was parked at his house so it would be easier to watch over. And the police would have access to the cars details and know that it belonged to an active duty military member and, if they did their job, would never authorize anyone to tow the car. Besides, even if the registration is expired, as long as it is not being operated on the streets the police would have no authority to have it towed anyway.

      @patriot101101 the DMV by state law requires every person to change their registered address within 10 days, the DMV lien unit authorizes the lien and if it sees a military address base 6it red flags the lien and voids it, the tow company uses a lien company to pull a record of vin.
      There os a website that authenticate SCRA military status' the tow company becomes a creditor by state law where a creditor has a credit application and knows a person's employment military history a tow company does not and has no idea who a registered owner is, Chase bank once foreclosed on a house and turned around and just gave them a house for free.
      One would think the military would make sure that service people leave their affairs in order or have someone on charge. The military is like bankruptcy. Creditors cannot perform collections or repossession without a court order. The only thing the tow company did wrong was sell the car. Had they not the debt would stand.

A police officer has qualified immunity and the Supreme Court held a tow company following police orders is not liable under the good faith defense if sued, but every creditor must always check with the military , if a person is military then dumping a car in the street and hoping the creditor dosent check might be profitable in the long run, this is not the first time towing companies have failed to check, in the eastern United s tates their are a few past cases where tow companies sold multiple vehicles towed from apartments, so it is nothing new

      The police can lawfully order a tow company to tow a vehicle its state law, the registered owner must change their address within 10 days it's state law, the DMV lien unit woudve seen a deployed military address and red flagged the lien voided it, people who are deployed need to leave a responsible person to take care of their affairs, the car left to the friend still has financial responsibility even if the member is deployed,
      As a creditor the tow company should have checked the Military SCRA website to see if the debtor was a military active status, since repossessions and collections are illegal without a court order.
      The military needs to do a better job of preparing setvice members for deployment, it's not their first rodeo

    Not a big fan of tow companies. I am a big supporter of the military.
    BUT.
    The car had expired tags and was a a public way. An Officer in the Navy should have his shit together to avoid situations like this. When he reported it missing, the police knew where the car was located, which indicates either the police or the tow company legally towed it and followed procedure.
    The big question is , didn't his buddy, who's house he parked in front of, and had the keys, notice the car was missing for two months?

    Towing companies are a big theft racket. When I was young I got a DUI. When I sobered up and was released my car was there where I was arrested. I had to go to jail and pay a fine that was my punishment. It's against the law to punish the defendant twice. This is called double jeopardy..

      He parked his car with a friend so someone can start the car and keep the battery charged. You park it on post and the battery might be dead and you’ll probably have flat spots in your tires. The Servicemembers Civil Relief Act has been in place since 1940. Anyone operating a tow company in a military town like San Diego should know to verify the identity of a vehicle owner before auctioning it. The moral of the story here is to not make excuses for a sleazebag company.

I don't park my vehicles on city streets for more than a day, definitely not for months on end in front of a friends house while I'm out of the country. That's just straight up stupidity.

    There was case in Long Beach in 2000s where service menmber car was repoed and sold in auction with the car never having loan on it. Tow company was driving up streets and running plates for quick buck.

Also, his friend should have called police immediately when the car was discovered missing (duh). They would have told him the car was towed and I'm sure it could have been resolved without a huge problem.

    Tow companies are given a right to steal by the law enforcement municipalities. They often will tow vehicles on Friday afternoons, as they will not release the vehicle until Monday. This way, they collect 4 days in lot fees in addition to the actual tow…which winds up being close to $1,000.

    These "Tow Truck stories" are really sad. However, it's also very sad that this young man foolishly choose to park his car on the street, with expired tabs, making his car a target for thieves, vandals, police, AND crooked tow truck companies! More than one person to blame in this story!

    Call a well-known tow company. Ask for assistance.
    Wait 10 minutes.
    Call them back and cancel the request.
    Enjoy meltdown.
    I didn't find out about this by a company trying to intimidate me.

    I'm playing gta online and there's a car theft mission. That is, they literally give me a tow truck and indicate which car I need to bring to the recycling shop, where the car will be disassembled for spare parts. I don't live in the USA and this mission has always seemed too absurd to me, even for the gta world. But after reading the comments, I was very surprised.

    This story is misleading. The sailor had expired tags, it was parked on a public street. It should have been towed, but the auction without a court order was wrong.

      I call once police for a car that was left on front of my house for two months no one ever came for the car . Car was getting tickets cuz of the sweeper. Call police a they towed 👍

    The action by the towing company was against federal law since the Lt. was deployed and a protected class. This gives the government standing to sue. The Lt. is due compensation for loss of the vehicle plus the balance due on the loan plus damages. This will make him whole but he doesn’t deserve a new car from Tony’s but I’m sure if they looked they could find one on the streets for him. 😁
    His caretaker is probably renting the apartment and street parking his own car. He was not a diligent caretaker of his friend’s property and is negligent himself. If Tony’s has a good lawyer and is properly insured then they will settle with the Lt. and the Feds.

    Tonys did the same thing to mine . Back in 2017. Expired tags , they towed it while I was working on a job site . Had to get a ride 3hours back home.
    Took me a few days before I found out where it was and it was sold.

    Since Navy federal credit union financed the car, it would seem when the ran the vin they would known there was a lean and that is one of two banks a lot of military do business with and sent up a red flag to the tow company and the credit union who would have to release the car's title for which they had a lean on. Seems like the sailor got failed on several fronts.

    I realize how ill informed the general public is on these tows. The tow company was within their jurisdiction and grounds to TOW it once it was clearly called in by Chula Vista PD. Where they messed up was auctioning the vehicle. The rates are contracted with Chula PD. Means agreed with the city so they are monitored to some extent. Don’t leave expired vehicles in the street. Streets is not your trash or junk yard.

    I own a tow company. Can someone tell me how the heck I’m supposed to find out someone is deployed let alone a service member. Good intention but asking us to do a background search on the owner is not feasible. We already send certify letters to the owner and lien holders when we impound a car. That is the extent of our responsibility. The courts hold that if the person moved without notifying the DMV, that’s on them.

      There is a military website that creditors ( a tow company becomes a creditor by statutory law) can use to see if a person is a service member, i don't have it off hand, try googling it, usually you can also look for military base windshield stickers, military personnel are also required to change their address within 10 days of being deployed and DMV will red flag and void the lien. But they don't always change the address.
      Since all liens are prohibited on service people who are deployed

    The police and the tow company were lawfully authorized to tow the vehicle,
    The LT did not change the registration address as required by state law within 10 days, the DMV lien unit would have red flagged voided a deployed service member registration lien
    The tow company as a creditor should have checked the military SCRA website to authenticate active service member status since repossesions and collections and liens require court orders
    The service member did not leave a responsibli person to take care of his affairs, then people wonder why, it's not the military first rodeo they need to do a better job of preparing setvice personnel for deployment

      @gethomas02 it also has an appearance of a ploy, the military has long term storage for vehicles on a inside garage, leaving an expired registration, abandoned vehicle on a public street and then not claiming the vehicle for over 4 months , and lay in wait until the car is auctioned.
      One would think a service member was a little more disciplined,
      If the tow company had not auctioned up to the point of enforcement of the lien the vehicle the service member would have been responsible for all the debt tow plus all those storage days.
      What the tow Co did was not shady, they just didn't know, Chase Bank foreclosed on a service member and then gave them a house for free. Credit collections some times slip thru , and if they do then it's ching ching time. Otherwise why wait for 4 months.

    Never park your car in California over a week they will tow it if they think it’s abandoned especially if it’s worth anything at auction.
