I'd say wills were originated in Roman Law. Roman testators could well disinherit their sons, although it is true that it is was not frequent and usually property was indeed split

This legal insecurity corresponds with Calivinist theological insecurity: no one knows who is chosen to be saved; so, it is better to work hard to make sure you are among the saved. This is part of how Max Weber and Maitland can come together
