    @Web Mitra - A) If the company's employee strength is >=20 and a employee's salary is more than Rs.20000 at entry lebel, PF it compulsory or optional?
    B) If the company's employee strength is less than 20 and a employee's salary is more than Rs.20000 at entry lebel, PF it compulsory or optional?

      Employee strength is considered to see if the Act applies to the company or not. Once application of Act is established, then it is to see for which employee pf deduction is mandatory.
      (A) if employee strength is more than 19- pf act automatically applies to the company. Bt pf deduction will be mandatory for those employee whose entry salary is less than or equal to 15k. So, for an employee whose salry is 20k, pf deduction is not mandatory. ( Provided that he is not an active pf member already)
      (B) if employee strength is less than 20. In this scenario, since the Act does not apply to company (I am assuming that the company has not taken voluntary coverage ie coverage even for less than 20 employees through section 1(4)), there's no point for the coverage of its employees. So, whatever is the salary of employee, pf will not be deducted.

    हमारी सैलरी 18 हजार है, epf नहीं कटवाना चाहते, क्योंकि कंपनी epf ke नाम से पैसे की कटौती कर epf खाते में पैसा जमा ही नहीं कर रहा है, कृपया कोई आधार या कागज बताएं जिसको दिखा के हम Epf नहीं कटवाए। कंपनी बहुत शोषण कर रहा है😭😭

      PF deduction salary ke cash ya cheque hone pr depend nhi krta. If company PF mn covered hai and if salary 15k ya isse Kam hai toh PF deduction mandatory hai. Cash payment pf ki chori ka karan banta hai isliye bank account ya cheque se salary lene ki koshish rahni chahiye.

      You can register your grievance with PF office online or offline.
      Also, companies are required to get form-11 (ie declaration from new employees whether they are existing pf member or not). Fill the form correctly that you are already pf member. Even then if company doesn't make you pf member then this can become an evidence against its non compliance.

      Legally, an employer is bound to comply PF deduction upto 15K. Beyond that it's upon consent of both employee and employer to have surplus deduction or not.

      Past benefits for the member/ employee can be remitted by employer. But the employer will have to pay 14b 7q penalty ( late remittance fine) also

      Company ko 20 ya usse zyada employee hone pr compulsorily PF registration krwana hota hai. But if company khud chahe toh 20 se kam hone pr bhi voluntarily section 1(4) ke under PF registration krwa sakti h.
      So, if aisa case hai toh kyuki aapki salary 15k se kam h toh OF deduction zaroori ho jaega

      If his earlier PF membership continues to be in operation (ie if he has not closed it by withdrawing full amount), then in new company also he has to be a PF member

      Just tell them that you dnt have a UAN number and give them your Adhar Number. Using Adhar they can create UAN and in case if any UAN is already created for you then from Adhar that UAN can also be retrieved.

    आउटसोर्स के माध्यम से अभी नया कंपनी में ज्वाइन किए है, सैलरी 15 हजार से ऊपर है इसलिए हम epf नहीं कटवाना चाहते है, क्योंकि कंपनी वाले epf का पैसा समय पर जमा नहीं करते है, और epf काटने को दबाव डाल रहा है। मेरी आपसे विनती है की कोई सर्कुलर में प्वाइंट हो जिसको दिखा कर हम epf नहीं कटवाए। ईपीएफ नहीं भी कटवा सकते है इस प्रकार का कोई प्वाइंट बताकर कृपया मार्गदर्शन दें।

      सबसे पहले तो मैं ये कहना चाहूंगा की पीएफ कटवाने से कर्मचारी का ही भला है क्योंकि इससे आप ईपीएफ के सभी लाभों के लिए योग्य बन जाते हैं। और यदि समस्या ये है की आपकी कंपनी आपके सैलरी से pf काटने के बाद पीएफ ऑफिस में जमा नहीं करवाती तो आप इसकी शिकायत नजदीकी पीएफ ऑफिस में कर सकते है। इस प्रकार की गड़बड़ी करने पर कंपनी प्रॉसिक्यूट हो सकती है क्योंकि ये कानून अपराध है।
      और जहा तक बात है आपके पीएफ न कटवाने की इक्षा की तो यह इस बारे में नियम मैने वीडियो mn बताया ही है । यदि आप वर्तमान वाली कंपनी ज्वाइन करने से पहले पीएफ के सदस्य नही है और यदि आपकी सैलरी १५ हजार से ज्यादा है तो पीएफ कटवाना जरूरी नहीं है । इस स्तिथि में एक declaration form dena hota hai - जिसे फॉर्म ११ (ग्यारह) बोलते हैं ।

      If u are not a of member already then ur pf deduction is not mandatory.
      This declaration from your side( that u are not a of member already) will be taken by your employer through Form-11.
      There is no form for exemption. Actually, it's a form for declaring whether u already have a pf account or not.

      Post office ya bank mn jo pf jama hota h wo ppf kahlata hai. And ye epf se bilkul alag hai. Bank ya post office wale ppf mn koi bhi deposit kar sakta hai. And uske withdrawal rules aur interest epf se bilkul alag hota hain.

      And my personal suggestion would be ki if possible, deduction krwana chahiye. High return, pension, insurance..ye saare advantages h. Jitna khud ki salary se deduct hoti hai utna hi employer ke side se jama hota h - ye extra hi toh hai.

      PF mn jama hua paisa partial ya full nikalwaya ja sakta h online form 31 ya form 19 bhar kar. Jama hue paise per government interest bhi deti h.. abhi wo 8.5% hai

    Sir meri salary abhi 30k hai, mera pf deduct nahi hota , but TDS 3000/monthly deduct hota hai, previous company me bhi 16000 salary per pf deduct nahi hota tha. Iske pahle ki company me 8000 salary per pf deduct hota tha jo mene resignation ke withdrawal kar liya mera uan no. Bhi hai , kya ab mera pf deduct karwa sakta hu.

      If aap ek baar pf member ban jao toh switch karne pr if aapki salary 15k se zyada ho toh bhi aapka new conpany mn PF deduct hona chahiye. Lekin condition ye hai ki aapka purana of membership khatm nahi hua ho ie aapne withdraw nahi kara ho.
      Aapke baato se aisa lag raha ki aapne withdraw kar liya h. Iss scenario since aapki salary 15k se zyada thi joining k time so aapki company pf deduct karne k liye mazboor nahi thi.

      As u said ur new company is not covered under EPF Act, so despite of you being eligible the new company may not deduct your pf as lons as it remains uncovered. You still may not close your previous pf account and continue earning the interest at least.

      If you are working for an contractor they have to pay you ESI and PF. I am also a railway contractor I pay ESI and PF to each and every employee. What many people do is show that their family member is working and the ESI and PF is registered on their name. Which you should have got, if your salary is less than 15k then I have to pay 12% for your PF and rest 13 percent will be paid by government. (PF percentage is 25% in railway of your base salary)
      If your salary is more than 15k PF amount of 12% can be deducted from your salary and the rest 13% will be paid by the government.
      On ESI you or your employer have to pay 0.75% and government will pay 3.25%.

      PF deduction is mandatory for employees with salary upto 15000. If u were not an active PF member before this current job and if ur entry salary here was above 15000, then your PF is voluntary not mandatory.

      @@_webmitra Not the same for Railway, those who earn less than 15,000 the employer and government pay for their ESI and PF. If some contractor doesn't pay ESI or PF amount he or she can go to jail. 12% is paid by employer and 13% from the government for PF. And for ESI 0.75% from Employer and 3.25% from the government.

      यदि आपके कंपनी में किसी भी दिन सभी प्रकार के एम्प्लॉय मिलाकर 20 एम्प्लॉय नहीं हुए है तो आपकी कंपनी पर ईपीएफ एक्ट मैंडेटरी नही है। इसलिए इस स्थिति में जब तक कंपनी ने खुद सेक्शन 1(4) में वॉलंटरी coverage ना लिया हो तो पीएफ काटना मैंडेटरी नही है।

      If ur new company is covered under EPF Act and if ur entry salary is less than or equal to 15k then pf deduction is mandatory. You have no other option.
      Also, if you had a pf membership and have not withdrawn that money then your new company will have to make you a pf member irrespective of your salary in your new company.

      Theoretically there's no problem. However, presently, the software of EPFO is not processing any transfer claims wherever overlap is there. So, one has to apply offline for this. And the demerit of offline is that it takes time to be processed and is on the mercy of promptness of the concerned pf office

      Since location is different, there should not be any overlap. So, ensure that date of joining (doj) of ur new company is after date of exit of ur older company.
      I believe that ur new company will not be remitting any money to ur pf account before ur joining ( coz obviously they would not be paying u salary before actual joining).
      So, in case ur Doj (as per pf record) in ur new company has been entered as some date before ur actual joining date, then in that case u can get ur Doj modified/changed by sending physical joint request to the concerned PF office through ur new company. I don't think there will be any problem in that.

      If aapne pichhle company ka pf withdraw kr liya h toh aap existing PF member nahi ho and iss scenario mn since apke new company mn salary 15k se zyada h so, pf deduction mandatory nahi h. If pichhla withdraw nahi kara h toh pf deduction mandatory h. Pf deduction ek social security h. Iska deduction ya non deduction career per koi asar nhi lata. But whenever possible, pf deduction karwana chahiye coz iske benefits bahot h. Eg- employee ke salary se 12% deduction ho rahi bt at the same time utna hi employer bhi toh de raha h. So, double paise PF account mn jaate hai. Pension and insurance benefits are additional benefits. So, investment point of view se bhi and future security ke point se bhi pf deduction is recommended.

      Since waha no of employees 19 se zyada h so, uss company pr PF Act laagu hoga. Iske baad waha PF kis kis employee ka deduct hoga ye decide hoga unki entry salary aur pahle se PF membership ( if any) se.
      Aapke k case mn aapko entry salary 15000 se zyada h. So, if aap pahle se ( kisi aur company k thru) PF member nhi toh aapki present company aapka PF deduct kare ye compulsory nhi h. If Employer aur aap dono apasi sahmati se chahe toh pF deduct krwa sakte h..but compulsory nhi h

      See, firstly u have to see whether the pf deduction will be mandatory or optional for you. If mandatory ie in case ur salary is less than 15k then you and your company don't any choice but to get your pf deducted.
      But if u happen to be an excluded member ie salary greater than 15k, then ur pf deduction will be optional. You and ur company both should agree for your pf deduction to actually make u a pf member.
      My advice would be wherever possible, become a pf member. Being a pf member first of all, you will be getting an extra 12% of salary from company side, Of which 8.33 would be pension share. And as far as investment is concerned I don't think anyone else is offering the return that EPFO gives. Insurance Benefit is also there.

      Now coming to your question.. your account will continue to earn interest till you withdraw it. (Account becomes in- operative ie it will stop earning interest when you attain 55 years of age).

      Yes ..PF deduction is mandatory for those whose salary (EPF wage) is less than or equal to 15000. For those above it's optional and depends on joint wish of employer and employee. However, if were a of member in your previous job and have not ceased it, your pf deduction is compulsory in ur new employment also irrespective of your new salary.

      If your Employer forces you for deduction/ non deduction against the provisions of the Act, you can register a complaint in PF office. It can be doe online at- epfigms.gov.in
      I would also like to add, the employer has to deposit amount equal to your share of remittances. So, Pf deduction is a financial liability for any employer. So, actually its good that he is willing to make you a PF member enabling you to have the PF befits- PF, pension, insurance.

      @@_webmitra I have a much complicated issue in my scenario. I have worked in an organization where I used to be covered in PF. But the employer assigned me UAN which is reflecting completely different details. Like
      Correct Name Wrong Name
      Himanshu Negi (Me) Kumar Majumder (one of their employees)(has already his own UAN)
      Same is with other basic details like father's name, DOB, etc. Except the DOJ, DOL. I have filled several correction requests but this scenario is with around 80+ employees thus PF dept. is also taking time to get these stuffs corrected.
      Now please suggest If I should opt for the PF in my next company. I can't continue my previous UAN untill the details are rectified. I can't even opt for the new UAN (because of the KYC thing I guess).
      Looking forward to your revert. That will be a great help.
      One more question, A fresh employee joining on Basic+Other Allowance(except HRA) >15000, he than will not need to be covered in sec 1(4), right? He can either choose or reject to be covered under PF Act?

      Himanshu, actually as far as what I have understood in ur case, ur previous employer has committed a mistake (blunder). In case of complete name/DOB/ father name change, things can get corrected but through offline mode and employer has to give justification and undertaking. So, in short ur problem will be solved but it may take some time.. may be around 2 months or so.
      Now ur querty regarding new UAN number... See, presently UAN number cannot be created without Adhar but before 2017-18, it was possible. So, if your previous uan would have been linked with adhar then, it would not have been possible to create a new UAN for you. But since ur name/dob has a mismatch in previous uan, so it is obvious that your previous UAN has not been linked to your Adhar. Hence, if so.. a new uan can be created by your new employer using your Adhar.
      Later on, once your previous uan details get corrected you can get your previous uan merged to new uan using form 13.
      section 1(4) is for companies not employees.. anyways.. I got your doubt. If a member who has never been a pf member enters a job with epf salary greater than 15k, then his/ her pf membership is optional not mandatory.

      @@kaby8729 Para 31 of EPF Scheme, 1952 says- "Notwithstanding any contract to the contrary the employer shall not be entitled to
      deduct the employer's contribution from the wage of a member or otherwise to recover it from him."
      So, legally speaking, it will be violation of Central Act and its Scheme on part of the Employer.

      its is epf wage ie sum of (basic+DA+retaining allowance+cash value of food). if other components are not being given by company then it will become (Basic+0+0+0)= Basic.

      Entry salary matlab wo salary jo aapko job joining k waqt milti h. And pf mn jab salary ki baat hoti h toh salary ka matlab epf wage h... ie 4 chizo ka addition... ie basic+da+ retaining allowance (if any) + cash value of food coupons (if any)

      Meri salaah toh yhi rahegi ki aap bina dare PF office mn complaint kare. But if aapko job chhotne ka dar h toh aap baad mn bhi complaint kar sakte h.. bas apne documents aap sambhal kar rakhe
