Party filed a delay complaint and it was condoned. They told the delay was to due to medical leave, but i have evidence that party is lied in affidavit of the delay cause. If we bring perjury can we dismiss the case early?

DEAR SIR, I HAVE PURCHASED AN OLD FLAT WITH GARAGE. BUT THE GARAGE HAS BEEN CAPTURED BY A PERSON SINCE TWENTY YEARS, THE SELLER SUPPRESSED THIS FACT AND SOLD ME THE FLAT WITH GARAGE. FOR THIS I HAVE NOT CLEARED A CHEQUE AMONG THREE CHEQUES. I REPEATEDLY REQUESTED THE SELLER TO RESOLVE THE MATTER AND GET THE MONEY. THEY HAVE FILED A COMPLAINT UNDER SECTION 138. IS IT APPLICABLE HERE? PLEASE SUGGEST ME.
