“People Are Going to Die”: Supreme Court Case on Idaho Abortion Ban Threatens ER Care Across U.S.

    The Supreme Court heard arguments this week about the legality of Idaho’s near-total abortion ban, which criminalizes the procedure in all circumstances unless the life of the parent is at risk. It’s the first such case to reach the high court since the conservative majority overturned Roe v. Wade in 2022. A key issue is whether a state ban can take precedence over the federal right to receive emergency care, including an abortion. The Biden administration argued that Idaho’s law violates the Emergency Medical Treatment and Active Labor Act, or EMTALA. If the justices side with Idaho, it could have major implications for reproductive care and worsen racial disparities for healthcare in at least half a dozen other states with similar bans. “People are going to die,” warns Karen Thompson, legal director of the nonprofit advocacy group Pregnancy Justice. “They are going to be bleeding out in hospital rooms. They’re going to be dying from sepsis because doctors are not going to be able to make the choices that they need to make to give people the care that will save their lives in these emergency situations.”

      We are citizens of the federal government, too. Protecting citizens' rights against abusive policies is the business of the federal government. The US Constitution supports our Constitutional rights and citizenship and comes before all states, except for the original 13 colonies which legally are colonies today.

      It doesn't matter. The AMA is a medical association, not a lawmaker. No matter what resolutions or stance they take on a particular issue, it means absolutely nothing to the people who make the laws. This is the case in 1000's of different medical issues. The whole entire U.S. system is totally rigged & easily found when you dig into it for yourselves. Oh, and most doctors can't afford to speak out otherwise they'll get targeted by the gov't agency du jour & lose everything in the process.

      The vast number of obstetrical procedures were developed before Roe v Wade, tubal pregnancies and the like. Numerous obstetrics physicians have testified that this is a made up issue.

    Idaho claims to be the bastion of small government and individual freedom yet in law after law they want the government to dictate every aspect of health care, recreational use of anything they don’t like( everything but alcohol ) and how you live your life or raise your family. As someone born in this state and had lived here for 70 years, I am now more afraid of my state government than I have ever been in my life Just to think if my daughter got raped by some maniac, she would be forced to give up her career and raise the rapist’s baby by the government while the same government is cutting welfare assistance, aid to pregnant mothers and Medicaid forcing my daughter into poverty and homelessness to raise this child. How can people want to do this to other people?

    I live in Idaho. I was born here in a hospital which was forced to cease delivering babies due to Doctors being forced out of the state. Now it's drive 50 miles or the er. ALSO the legislature has discontinued the bureau in charge of counting maternal deaths to make certain the damage they are causing isn't reported. A fetus which has no chance of living is not a child, it is a tragedy and these laws are compounding that tragedy.

    In the ER for medical crisis IS the definition of a emergency.
    So , if a Doctor won't help save the a woman in need is not AFRAID of law , he or she is PROTESTING the law .
    The Law says ' you must save the lives of both the mother and child ,till the child is lost or to save the mother .
    When something is threatening the mother you must save her .

    In case of rape, the life of the mother is in jeopardy, in the extreme poverty, abortion should be allowed. Abandoning the baby by the mother is worse. Children who are abandoned by parents, should be easier to be adopted by a woman and a man. Giving children for adaption to pederasts ("gay") and lesbians is wrong because the child could go grow up thinking he's "gay" or she's a lesbian although he or she is straight. I saw that in one of the worst episodes of Beverly Hills 90120 (1990-2000), [see Julius Evola, Metaphysics of Sex, Chapter About Homosexuality].

    "Pregnant people" honestly is such a refreshing thing to hear when talking about the right to abortion and what's happening in the U.S.
    As a trans man I can't move to any state with these kinds of laws in place because of the possibility of getting pregnant and being forced to stop hrt. Since if I miscarried while on hrt, I could face criminal charges in some of them. While I know saying pregnant people doesn't inherently mean that the health disparity when it comes to trans people is there, it still recognizes that we exist and are facing the same thing.

Fetuses die die during pregnancy for any number of reasons. So a woman who wanted that baby should just die because the fetus died but abortion laws won’t allow the doctor to remove the dead fetus which will rot in her body and kill her too? The medical term for removing a dead fetus is also “abortion”.

    That’s not good enough Alito you either believe in the letter of the Constitution or you lie to say you do. The first amendment proscribed religion as the guide to governance. You by reference included it.
    As I see it you were correct to defeat Roe but for the reason you know but did not understand. Roe was unconstitutional because it restricted the rights of women. What rights the list is long simply to restrict the right of women to pursue happiness. We start there. All abortion laws should be stricken. They are all Unconstitutional if examined by a just Court.
    This Court majority seems caught in an Age of older generations when it was in the government interest to justify brooding. The State’s interest no longer exist in the USA. The government if it wishes can produce as many humans as it desires. We no longer need to force women into unwanted pregnancies.
    Free women for a complete society.

      It's called birth control pills. Planned Parenthood was a FAILED program. They were in large cities where the average woman went back for 3 abortions before she had to wait 2 years to get another abortion. As a Federal Clinical Social Worker I know the statistics. Also, I had to have a medical abortion back in 1998 due to ovarian cancer. I was seen at St. Mary's a catholic hospital until I went into my 2nd trimester and was graciously with no recriminations to BJC. Women are being lied to and frightened into believing if a necessary abortion is needed somehow they will not be able to secure that surgery.

    There is one fact that is overlooked by every person who claims the fetus has equal rights with the pregnant woman. These people would let the woman die rather than give her the care she needs. The law is so vaguely worded that even if this decision does save the life of the woman, a judge could argue that it wasn’t necessary. It’s a slippery slope that will lead to more suffering and death of pregnant women due to not being able to get abortions in certain states.

      Are you ignoring that there are many poor women who can't afford the transportation costs, the hotel room needed, the extra time off work to travel, etc.
      And you are ignoring the topic of emergency room care. A woman can have a wanted pregnancy but suffer a miscarriage, which can mean the need for emergency care if hemorrhaging. Also, if the sterility of the womb is broken, as when the 'water breaks' too early, if the fetus and placenta is not removed within 24 hours, a terrible infection will lead to the loss of the woman's uterus or even her life if she gets sepsis.

      You are not following what is actually happening.
      Miscarriages happen a lot. On average, every woman will have at least 1 or two. If the miscarriage is happening, labor happens to push the contents out of the uterus. Most of the time this all goes smoothly. But If the place where the placenta is attached comes loose too early, or if a bit of placenta tissue is still in the uterus, it can't contract and shut off the blood supply that used to go to the placenta, so uncontrollable bleeding happens. To stop that woman from bleeding to death, she needs an abortion immediately or she will die.
      The other problem that can happen is if the plug that seals off the uterus from the outside world with all its germs, is breached, bacteria will invade the uterus. No fetus can survive that so an immediate abortion is needed to save the life of the woman from dying of infection. And if the abortion is delayed, waiting for the fetus' heartbeat to stop, the infection may be so massive the woman will die or at the very least, lose her uterus.
      These are the problems that state is now threatening ER doctors with lose of their license and prison time if they try to save these women's lives.

    I always thought the issue was whether or not the federal govt should fund it, If it has now become a bigger issue then my question isnt when is the spark of life. I would argue that some people never get that spark over life. I do reject that life starts at moment of conception. Quite the opposite, I see life as a coming into being much earlier than what is said and it would be that our lives started when our soul started and that is not at the point of conception. So in many wars, the right to have an abortion and right to life is out of my perspective. if one were to follow through that abortion is murder then do we make the mother a a killer or is that saying merely symbolic because if you want to follow that through then you would have to follow that with the death penalty and I know thats where even the evangelicals and catholics draw the line because that would be immoral. So you can say its denying life but you cant say someone committed murder. They are not the same,
    If one equates their religious view is interconnected with the law of the land then I would say your religion is technically the govt and the supreme court has argued that is a legal direction in that the govt cant dictate that the govt can make you follow them be ause that equates to freedom to worship in a way that is forced where the govt is your god.
    So, if our views are seperated from legislation then your religious views are more legitimate than if you legitimize the govt according to its laws its a strange connection but if you want seperation of church and state than you do not want to make abortion a teligious topic.
    Perhaps the actual laws are just too general. I would say there are cases that it is a true medical emergency and that some of these things are out of the scope.

      Doctors say there are too many possible complications to ever write a law to cover every exception. That’s why it makes no sense to set a certain number of weeks, because an abortion can become medically necessary no matter that person’s politics or faith. Almost all abortions are very early on. Nobody is going late term and just making an elective decision to end it, because the later it is done, the more risky it becomes. The only logical thing is to let doctor and patient decide.

      Simply put, he is not risking his health or life but the pregnant woman is. Just as no one can force you to donate a kidney or even blood, because it means health risks to you as a donor, a pregnant woman should be the only one to decide to continue the risky business of pregnancy, delivery and the month after delivery.
