  • Celebrations broke out 6 September, 2018 as the LGBTQ community and others welcomed the Supreme Court judgment decriminalising consensual gay sex, asserting that the "historic" verdict granted them a basic human right but also acknowledging that complete equality was still some distance away. A five-judge Constitution bench of the Supreme Court unanimously decriminalised part of the 158-year-old colonial law under Section 377 of the IPC, which criminalises consensual unnatural sex, prompting joyous tears, hugs and dancing across the country. Activists, members of the LGBTQ community, authors and politicians welcomed the verdict -- which also said society cannot dictate a sexual relationship between consenting adults -- with many cutting cakes and unfurling the rainbow flag. On this edition of 'The Big Picture' we will analyse the verdict of the Supreme Court on Section 377.

    At 13:03 Hats off to Mr Frank for being so wise in not allowing hurtful comments to be passed in show he anchors. I really appreciate this aspect of his personality to quickly put water on sparks which potentially can be fire...
    His parents and friends and even Indian Media is so LUCKY to have such a wonderful anchor in our country... I see his name already in History books of our future...🙂

    ms menaka really upset sai deepak at the concluding remarks.She could have talked in a decent manner.But its ok.One thing really needs to mention here.Mr.J sai deepak is true gem of not only legal fraternity but also of our country.He always make me fall in love of his way of expressing,his conviction,his way of thinking.Hope some day India will see him as a CJI.

    The point of a debate is to have all views, opinions and aspects related to the verdict up for discussion. Not just about the verdict and its impact. I think Meneka Guruswamy needs to understand that whatever she had fought for over the years, is exactly what she is denying to other panelists- to be heard, to hold a variant opinion and to be tolerant.

      Absolutely correct, they are praising the same supreme Court which had held 377 legal. It's not good to rejoice only when it's in our favor.

      I need to study more about the issue ...to find out the locus of the case and judgment . There r many aspects (equality, dignity, freedom, fraternity ,privacy and along with science , stats, culture, morality, and in core constitutionality) . But which one is prime mover of this case !!

    Here a prophecy I make...that come one day, Mr. J Sai Deepak would be delivering verdicts from the bench of the Supreme Court, given the clarity of his thoughts, his commitment to his profession (who subsequently studied law after completing Engineering 😃) and the brilliant power of analysis he has been endowed with. He is a Justice Krishna Iyer in the making! 😊 RSTV...Pls make it a point to invite him to any issue which has a legal angle, because with him, you invite a whole new perspective!

    Menaka Guruswamy is correct. Other panelists have not really read the judgement. Reading down of Sec 377 is much more than privacy issue. It's also about equality and making LGBTs equal citizens like others. A judge said, 'I am what I am and take me as I am'. He is taking about acceptance of variant sexual orientations of people. So it'd not just about sex which was criminalised. People also saw LGBT people through the lens of their sexuality. So this Judgement is much more than what other panelists are saying. (Rahul Easwar is a dumbo, forget about him)

    Mr J Sai Deepak's point to S.C has to give its decision on basis of constitution and don't wait for public positive ness and should have courage to clarify what is wrong and what is right. S.C need to consolidate its position as a guarantor of CONSTITUTION.

    Rahul easwar is very rightly quoting the real situation in society but...no one's taking him in the right way..... though court has' very rightly ' decriminalised section 377 , our society is still not accepting LGBTQ persons as normal and equal citizens......sc has done it's part....and now the ball is in our(society s) court...... and we have to work for....social acceptance of LGBTQ persons......but if we are approaching the society (with deeply ingrained traditional ethos) with arrogance.....then society will react....with more hatred towards LGBTQ Persons.....so we have to keep in mind all this 'ground situation' and will have to work accordingly......so that LGBTQ persons are gradually accepted by the whole society as equal citizens (which is their birth right)
    ......this is not end but just the beginning of the war....the war of us with deeply ingrained intolerance in ourselves.....so lets fight it out together.....to give our LGBTQ brothers and sisters the place of dignity in our society which they deserve very rightly 🙂

      Exactly Arjun, a new perspective, maybe the Supreme Court has not discussed it now, but it can be a future bone of contention between different parties and that's what democracy and this civilised debate is all about.
      PS: the lawyer was arrogant and not ready to accept any other perspective than her, I hated that

    It's not all about guts , it's like "making hay while the sun shines" - when it comes to human wisdom . The honorable SC does it so often to prevent the unnecessary chaos in society.
    After all it's society consensus that needs to be considered. If constitutional touchstones are put forward every now and then there are n number of cases which can be delivered in very short period....
