LIVE WATCH! Commonwealth v. Karen Read DAY 26

  • We finished the day on Friday with the voir dire of Trooper Paul's new opinion that Karen Read's taillight could not have been broken by hitting John's car in the driveway at 5 a.m. on the 29th because, well, he says so. Alan Jackson was fuming because this opinion was developed weeks ago and never disclosed to the defense, so he wants it excluded. Why Judge Bev needs to think about this I don't know, but she did and so we are expecting the ruling first thing in the morning before we finish Trooper Paul's direct exam and continue to a cross that is sure to be spicy now that Mr. Jackson is good and pissed off. What's left in the Commonwealth's case? We are assured that despite 20+ witnesses remaining on the list, the jury will have the case before the 4th of July holiday, and the key witnesses remaining for the Commonwealth would seem to be the medical examiner and Trooper Nicholas Guarino, who performed all of the cell phone extractions in the case.

    The gaslighting in those texts…. Being treated poorly then reacting, then being called crazy for reacting. I don’t know if that was supposed to make me think she was crazy but it just made me empathize with her.

      Especially with things like him not wanting her to have the plumber out because he wanted a night out and be collected by her. For someone with Cronhs, and possibly a colostomy bag given her surgeries, not having access to hot water would be horrible. I feel so bad for what she's been through, it's heartbreaking

    More , I am admiring Karen for being so gracious in face of all the dirt and humiliation they put on her . I also understand why she made so many phone calls to John because I don't like to be played and I prefer a clean break up instead of being played around . Is it a reason to kill someone ? No. It is not .

    Finally - an honest portrayal of John. An apple doesn’t fall far from the tree. Look at the behavior of his mother. Death doesn’t give you automatic hero status. These text messages speak volumes (as does the friend who said John called Karen a "babysitter with benefits").

    I find that that whole group of people have a very misogynistic view on women. It's probably cultural, even the women are very nasty to each other and jealous of each other. JO behaved just like Proctor and all the other troopers showed us on their chats.If this was about someone else he would also be there on chats saying the same crap about that woman. He was a stand up man for his family, not many people step up to raise 2 kids, but he was also one of them with the same cultural flaws and mentality.
    I recognize that behaviour on my daily life because it is pretty much the same culture of my generation in my own country. I am 58 years old and live in Southern Europe.
    And smaller communities tend to have patterned behaviours that are very hard to break, KR was the outsider that grabbed the handsome bachelor so they disliked her for intruding and disrupting their dynamics, she was vocal about the way she was treated and that was a big no no. The other women that testified seem to be strong and opinionated but there are unspoken rules that she broke. The way one of them, i forgot who, said that she was a babysitter with privileges shows the contempt they had for her. The guys are all very manly in front of their group, even in court they all showed a facade of manliness and were arrogant , even a bit threatening. But Jen rules the house, she hated being interrogated by yet another outsider, she absolutely hated having some guy calling out her bs, she is not used to that, same with the Albert daughter.

    • @viqala9159
      @viqala9159 Před 8 dny +2

      And what's awful is that to live with it you habe to either choose to not want to know more or dig more, and/or you grow in hatred towards the person, justifying to yourself that even if they didnt do X, they still deserve bad things to happen. Or you choose to consider yourself the bestest expert that ever experted no matter what. You may also think to yourself that you're just such a small part of the whole process and that she'd be convicted anyway, no matter if you chose to be more honest or not. And there's what Andrea mentions often too - that some people only do the right thing if they know they can be found out. If they're certain they wont be, there's no incentive. So you may think there's a bigger incentive to stay on the same page with your cop buddies with the protection of the state. It's all awful.

  • @richardfeverel99
    @richardfeverel99 Před 8 dny +8

    From a 10,000 ft view, what I got from the two phone extraction experts is that they are both having trouble explaining an anomaly: the "hos long" Google search appears in other databases on the phone, but NOT in search history, and an ordinary end-user would not be able to delete the search selectively from the history database. Because they are starting from the assumption that the extraction has not been tampered with by an IT professional, they are struggling to explain the anomaly, and ultimately DISAGREEING on their explanations.
    But we already know that there has been suspicious handling of evidence by MANY investigators involved in this case, and that at least Jen McCabe and Higgins have access to people with some level of IT knowledge (husband & friend, respectively). So a relatively simple explanation for the anomaly is that someone with a significant (but not expert) level of IT knowledge IMPERFECTLY deleted the Google search from history, but failed to remove all trace of it, leaving behind confusing artifacts.
    In an ordinary case, an explanation that relies on tampering with the phone extraction would not be the simplest explanation, but in this case? What a mess... we just need to see the Google server side of this, if that's even possible.

But yeah the negligent downgrade screams we'll take any win, indicative of proof we had a legitimate case in the 1st place and thus also to prevent any revisit, if not Karen, then who.... Yeah I guess they need to prove how karen saw John so easy, immediately, when 10 or so others couldn't. If she didn't already know, cause she was there and did it, then only they were there, yet didn't see John, maybe they did it, explains why they didn't see John but Karen did, for good reason, her's cause she cares and loves John, wanted to find him, and their not so good reason but nefarious reason.

He’s clearly not qualified enough and nobody told him. 120 hours isn’t enough to be an expert in anything and the fact that he is training people is concerning. I understand he’s nervous but you need to be able to answer better than this. Kind of sort of is not good enough. His inability to answer more clearly makes it even worse. He says could be this and that, until he is crossed and than he suddenly can answer more assertive. And the way JO is hit doesn’t seem credible at all. JO would have massive arm and shoulder damage. I think it’s terrifying that someone’s freedom can be taken away by people with this lack of knowledge.

He actually worked out the momentum if you take JO to be a standardised shape and size across his weight and height from the measurements this so called expert gave, and it came out to a momentum which would have hit JO with a ridiculous force. I forget the numbers he told me, but it was insane and would have broken bones across the chest without a doubt. And would have flung him far further than 7ft or 30ft. There are four of you whose coverage I'm following, so I'm still catching up on Day 26 and I'm seeing these texts over and over, and seeing in my mind's eye your puzzlement at why anyone would put up with this behavior each time they come up. That's understandable, and I hope you won't mind one perspective.
    For those of us who struggle, for whatever reason, to 'function normally', whatever that means, whether sometimes or all the time, in ways that are visible or not, it's with other people who also struggle that we stand a chance of learning and growing together. Ms. Read and Mr. O'Keefe, like all humans, are/were imperfect, they struggled, at least in some moments, maybe in many, to find comfort with someone they loved. Maybe one of them worked harder than the other, maybe we're just seeing a moment in which that looks to be true, we don't know. It sounds like they'd been together quite some time. Maybe nothing ever changed between them, or maybe there was a reason they kept trying, maybe there was progress, maybe not. Maybe this was their breaking point, and undeniably it's not a particularly healthy or productive way to argue, but maybe it's better than how it used to be for them.
    For me, I struggle not to envy folks for whom interpersonal relationships come more naturally, but I'm learning to love who I am, partly with the help of the man with whom I've spent thirty years learning and growing. We're not perfect and people are never going to be easy for me (I'm grateful they are for him), we've had fights worse than this (the texts) along the way, we've had many more disagreements that didn't devolve into this kind of sniping, but we were never - neither of us - going to manage a relationship without some bumps along the way; we're dysfunctional, both together and separately, but we're better people, and we have a better relationship, than we were and did when we started, and we still like each other. (Loving is easy, but liking can be a real challenge sometimes. 😄 ) I don't know what your challenges are, and I suspect you meet them with aplomb, but clearly they don't lie with people or... ya know, life in general (folks like you are aspirational to me, thank you both for sharing a bit of your lives), so maybe that gives you a little glimpse at why these texts aren't particularly egregious on either side for some of us, and certainly, as you said many times, don't indicate an intent to end a life.

    It certainly sounds like that is what is said, and it sounds like his voice, but if you watch his mouth, his lips do not move. They certainly never come together as they would have to in order to form the word "me," and there's no audio delay, so that doesn't explain it. Either we're all mishearing it, it's coming from someone else, or he's practicing his ventriloquism skills.

Annually, we took a class, reiterating the fact: You are OVER THE LIMIT after 2 drinks in ONE HOUR. Karen had SEVEN. In addition: Pretty Much every COP there was also LEGALLY DRUNK. Many Drunk Drivers. Karen was SUPER DRUNK, her & John had been fighting all day. She ran him over in her Drunken Stupor, woke up at 4:30 am, realized what she’d done but still Half-Drunk, and frantically tried to get over there to “Discover” him in the snow. She’ll be found NOT GUILTY because of these Keystone Cops, but she did it.

    6:54:30 "[sigh] *KillMe* " after witness response "Yes it is" to Prosecution Q about Exhibit 48: "Material that you reviewed from the defendant's phone, is that consistent with what you observed of Mr O'Keefe's?"
    Too quiet for yt subtitles to pick up or the court clerk or the judge or Defense? But *Andrea* got it: the eyebrows went up at 6:54:29 " *Did he just say 'Kill me'?!* " & then chat went ape, me too.
    Perhaps witness feels awful about his prepared task of reading aloud in court Facebook Messenger chats between KR & JO?
    Would this be a quote for Defense to ask the witness about today? If AJ or Yanetti watch lawtube replays they will know by now what the witness said.
    I wonder if there's any point asking him about it today? Defense cannot call on court clerk transcript to show it - - it will not have been transcribed.
    Witness could anyway simply say it was an unwholesome conversation to have to read to the court. The point in asking witness about "Kill me" & witness reluctance to read those texts aloud is because JO's part in those texts are what's most unwholesome about the conversation - - but it isn't pertinent to KR's defense, & playing up how awful JO's attitude was would play into Prosecution hands.
    Sidebar: Lally's fluffy waffle way of mumble-speak made transcribing his question even on repeated replay Very Difficult. It's a further impediment that makes so many of his Qs incoherent even to his witnesses.

    1. Calculating the conservation of momentum doesn't work at an angle, apparently. (Even though I distinctly remember the highschool physics course on forces, movement and momentum including those exact types of calculations, they weren't complicated))
    2. The ground is pretty blunt.
    3. Projecting a 6ft man a distance of 30 feet is possible without him flying through the air OR skidding/rolling on the ground. So... teleporation? Like the people apparating in the sally port video? Maybe there's more to this phenomenon in Canton than "motion activated" surveillance video being tampered with.
