  • The International Court of Justice (ICJ), the principal judicial organ of the United Nations, delivers its Order on the request for the indication of provisional measures and the modification of provisional measures previously prescribed by the Court submitted by South Africa on 10 May 2024 in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel), on 24 May 2024, at the Peace Palace in The Hague, the seat of the Court. Session held under the presidency of Judge Nawaf Salam, President of the Court.

    I am a 68 old white south african. Israel must learn from our situation. We gave peace a chance, and thank God we did. Today, we still have issues, but on the whole, the different ethnic groups get along amazingly well.

      The latest verdict of the ICJ is, inter alia:
      50. The Court considers that, in conformity with its obligations under the Genocide Convention, Israel must immediately halt its military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part.
      The State of Israel shall, in conformity with its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide, and in view of the worsening conditions of life faced by civilians in the Rafah Governorate: (a) By thirteen votes to two, - 15 - Immediately halt its military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part;
      In other words: military offensive (neither other actions) which may not inflict genocide is NOT to be halted per se. Since military offensive has in principle another goal than killing civilians; let alone genocide, Israel can continue its military offensive if its military offensive does not constitute genocide. Military offensive per se is aimed at destruction of the enemy military forces and may inflict its physical destruction in whole or part, but a military offensive as such is not regulated by the Genocide Convention. So, military offensive may inflict physical harm but is not necessary genocide, even if the intent of military offensive is to destroy the army of the enemy (but not civilians).
      Ergo: Israel can continue its military offensive if it is not aimed on destruction c.a. of the civilians in the Palestinian group in Rafah as a side effect. (Conditions of life that could bring physical dead or harm does refer to general conditions of life and not e.g. a direct hit by a projectile and the like (“collateral damage”) but you should think as things like inaccessibility to water or food etc. which, indeed, impact life conditions and could bring physical dead or harm to people (civilians in Gaza).
      However, military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part, form not components of the legal definition of genocide. There are a lot of activities that “may inflict” on a group conditions of life that could bring its physical dead or harm such as a disturbance of a food or water supply chain or a longer lead time for medical care. This happens in most cases of war. For example a high number of military casualties will increase the lead time for civilians for medical care (even if this medical care is not related to the conflict as such, which is the case in pre-existing conditions; heart condition, cancer, chronic diseases).
      It’s clear that the ICJ misinterprets or broaden the legal concept of “genocide” and tries to impose more stringent boundaries on LOAC for Israel than other countries in a conflict by introducing a double causality potential (“may inflict”… that “could” …). In the Genocide convention it is formulated as follows: “(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part…”
      There is a huge difference between: “deliberately inflicting”…to “bring” its physical destruction (which constitutes genocide according to the Genocide convention) and “may inflict” that “could bring” its physical destruction. In the first case there is a clear intent in the latter case there is no intent, but something could potentially happen.
      Of course, Israel is not respecting such a conclusion of the ICJ because it obviously violates the nulla poena-principle and the rules of LOAC.
      The same holds for any other armed force in the world in a conflict. Would e.g. the army of the Russian Federation stop it’s special military operation activities because it may inflict on the Ukrainian group in Ukraine, or any specific kinetic spot along the 1,000 km contact line, conditions of life that could bring about its physical destruction in whole or in part?
      Finally, we condemn all the violence in the world and believe that everyone has the right to be left alone.

      She doesn't represent Uganda (that's just her country of origin) and I doubt she sold out. She stated that the conflict is “essentially and historically a political one” and argued that Israel already has to do everything it can to prevent a genocide, so restating it is redundant. The German judge also voted with the majority despite stating "I do not find it plausible that the military operation is being conducted with genocidal intent".

      The ICJ doesn't have that power. They issue orders on disputes between countries. In fact they have no enforcement provision. To enforce an ICJ order it would require the UNSC and of course there it would be vetoed by the US. The ICC is the court for individuals that commit war crimes. The ICC doesn't have enforcement authority, practically speaking, because they have to rely on members of the Rome Statue to arrest someone under indictment. For example, if the ICC issues the warrant for Netanyahu he can't go to a country that belongs to the ICC, as long as he stays in a nonmember state... Israel and the US are two of them and there he's safe from prosecution. However I agree with you, I want netanyahu arrested and tried. Best wishes

    Now the rest of the world has to stand up and put in place measures to reinforce implementation of court decision. Of course the usual bullies USA, Isreal, GB and Germany will oppose. There are a lot of activities that “may inflict” on a group conditions of life that could bring its physical dead or harm such as a disturbance of a food or water supply chain or a longer lead time for medical care. This happens in most cases of war. For example a high number of military casualties will increase the lead time for civilians for medical care (even if this medical care is not related to the conflict as such, which is the case in pre-existing conditions; heart condition, cancer, chronic diseases).
      It’s clear that the ICJ misinterprets or broaden the legal concept of “genocide” and tries to impose more stringent boundaries on LOAC for Israel than other countries in a conflict by introducing a double causality potential (“may inflict”… that “could” …). In the Genocide convention it is formulated as follows: “(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part…”
      There is a huge difference between: “deliberately inflicting”…to “bring” its physical destruction (which constitutes genocide according to the Genocide convention) and “may inflict” that “could bring” its physical destruction. In the first case there is a clear intent in the latter case there is no intent, but something could potentially happen.
      Of course, Israel is not respecting such a conclusion of the ICJ because it obviously violates the nulla poena-principle and the rules of LOAC.
      The same holds for any other armed force in the world in a conflict. Would e.g. the army of the Russian Federation stop it’s special military operation activities because it may inflict on the Ukrainian group in Ukraine, or any specific kinetic spot along the 1,000 km contact line, conditions of life that could bring about its physical destruction in whole or in part?
      Finally, we condemn all the violence in the world and believe that everyone has the right to be left alone.

    The two dissenting judges are, by their perverse decisions, obviously so out of line with the rest of their colleagues that their independence must be questioned and they should be subject to an investigation for potential breach of their sworn oath to make judgements, without fear nor favour. They should be suspended from the court until an independent investigation is undertaken and concluded. I give my opinion, right or wrong, as a simple layman.

    This is a significant development! The court is ordering Israel to stop its offensive and to immediately open all land crossings to allow unimpeded humanitarian aid into Gaza, at scale. It also reminded all countries of their obligations to uphold their rulings and to prevent genocide.       the main judge is from lebanon, the icj is a politucal body because itws judges are picked by polititians in thr general assembly wich is made by mainely dictatorial, third world and such countries, i have first and masters degree in law try to find evidence to what you say n ot from tictoc

    How and who will enforce the jurisdiction? What happen when the party involve do not accomodate that jurisdiction?

      You can personally cooperate with this by implementing BDS & you can tell your representatives in your government that you require this ruling to be upheld.

      ICJ orders are not enforceable by the court. If Israel continues to ignore the ICJ orders it can be taken up by the UNSC, however there we know the US will veto any action.
