    The fact that Trump is currently the frontrunner for the GOP should have no weight at all in front of the SCOTUS. The only thing the SCOTUS should base its decision on is the Constitution. Where people stand in the polls should have no bearing whatsoever. Any decision based on poll position would be a political one.

      facts matter to some folks. it is true that Trump never advocated violence, so what is a peaceful opposition to acknowledging that supreme court said it was over? I call thus pressure on Pence by Trump as wrong, but what is not wrong in this country????????????????????

      ​@michaelWNYYou don't have to be charged with insurrection and found quilty in the court of law for a state to uphold the Constitution and remove someone from the ballot. Two different courts found Trump had participated in an insurrection and they upheld the Constitution by removing him. It's called states rights.

    Here is the problem. The justice department should’ve gone after Trump on January 7 for insurrection. Then he would be convicted by now there would be no argument as to whether he committed insurrection or not two years later.

      Mkay, why didnt DOJ go after him? I can guarantee they went through every bit of evidence they could get a hold of, much more than any of the rest of us have ever been allowed to see, and they did not come up with anything to charge him with. What is the logical deduction to be made here?

      Please understand the boarder issue is not all on Biden. The republican controlled House has intentionaly failed to provide needed funds to deal with boarder issues. Biden is right not to allow inhumane treatment to people even if they are illegally trying to enter the US. I don't want people shot, drowned or chained up like animals in my name. We need immigration reform and it's not Biden's fault we don't have it. Our laws provide for people escaping certain conditions refuge.That requires hearings and that requires personnel. Republicans in Congress are trying to make it look like it's all Biden's fault by failing to provide new laws and funding.

      What a stupid question asked to Nicki Haley. It depends on whether you mean the proximal cause or the underlying cause or causes. The proximal cause was secession. Even Lincoln said so and conducted the first 2 years of the war in an effort only to end the rebellion. He would have achieved that goal with or without the abolition of slavery. It was only by the end of 1862 when things weren’t going so well for the Union that the war was transformed into a war of subjugation and the end of slavery became arguably the main objective.

    The fact that it even got to this point of people accepting Trump as a candidate is a canary in a coalmine. The point is, not that Trump is being invalidated by various states. Those states are within the law and doing things by the law. People will point out that it isn't "democracy". Well, democracy lives within a framework of law. The fact that some disgraceful person can break all these rules and still being accepted and it requires draconian aspects of the law IS an indicator on how far people have fallen. That the state of democracy is so low in the US.

    The idea that the Civil War was about states rightS, plural, has always been amusing. I'm pretty sure it was that the states wanted one very specific right, the right to own another human being, Body and Soul, in complete antithesis to what stated in the Constitution:
    All men created equal, inalienable rights to life and Liberty.

      States Rights as a cause of the civil war is technically true. But it ignores the issue at the heart of states rights.
      Fundamentally states rights were still predicated on the issue of slavery. Why? Because the issue of slavery played a role in the balance of political power in the US house of representatives. Northern States did not want slaves rk be counted towards the total population of a state which thereby gave them more representatives. Southern states meanwhile wanted slaves to count towards their total population because it granted them more political power. What happened was the 3/5 compromise. 3 out of every 5 slaves were counted towards a state's total population.
      So yes at the end of the day Slavery was still the root cause of the civil war. One could argue that the issue of Slavery became even more paramount for northern states with Lincoln's emancipation proclamation.

    Trump and others with like-minded views are exactly why we need this statute and should keep it. We know what he wants to do to this country, he has told us, and anyone who has done what he has should not be allowed to run for president. We should not take that kind of chance with our country because if he were to win all Americans lose!

      It isn't a statute, it's a constitutional amendment. Amendments are harder to get rid of, you'd have to pass another amendment to reverse it.

      Anyone watching just F$ox or CN$N or MSN$C who thinks they are getting the full story, think again. (I used to watch only CN$N.) One must watch both liberal and conservative news, like it or not, to get a much bigger and better picture. It really helps to see both sides. When I started doing so, I was taken back by what has simply not been reported on at all with some of these networks. I didn’t know what I didn’t know. I thought I was getting the full news by just watching CN$N. Significant examples: The Twitt$er Files hearings and the IR$S Whistle$blower hearings. Both hearings were presented by seasoned Democrats who did all the investigative work and were reporting their documented findings. All these Democrats had voted for Biden. And now the Trump bankers who approved Trump’s loans testified in favor of Trump’s valuations. I was clueless.

    To qualify to be a candidate you must follow the 14th amendment , no ifs or bouts about it ,,,, the supreme Court must uphold the constitution.

      Do try to remember, the American people's taxes go into A huge variety of areas: Military, including Coast Guard, Infrastructure, Health, Education, paying Federal employes and Politicians salarys and perks, Border control, Natural Disasters, to name a few items.
      Lowering taxes for major corporations and wealthy investors, allowing them to write off to where they pay no, or very small amounts of taxes is what is not fair to the American people, and while in office that is what djt did not once but several times, and he neglected to improve America's health, infrastructure, put a band-aid on the border situation, did not negotiate trade deals with China very well, etc: etc:
      And further, had plans with his repub loyals to dismantle Social Security, Medicare, Disability, and Veterans benefits.
      Djt and his loyal repubs have proven, they can dismantle very well but not make the necessary improvements that the American people need.
      They are very good at supporting the wealthy corporations and wealthy investors which helps them, not the American people.

      The other "real question" is why do Republicans endorse a United States president who has been ready and eager to betray his oath of office; gather nuclear secrets to pass out to strangers; and demolish our Constitution by scoffing at election outcomes? Last week Trump stated that he would become a king (and create a children's book announcing such). Any citizen who agrees with such perverse thinking is actively ripping apart our democracy. We must speak to U.S. ideals and step up when those ideals are scoffed at by a former (loser) president. Trump has just admitted that he'd rather be king and intends to be viewed as such. If this fairytale became true, the U.S. Constitution and every man and woman who serves in Congress would be deprived of their obligations as essential to Constitutional law.

    What does being a leading candidate have to do with the law and constitution? Colorado and Maine he was removed from the ballet under the laws in those states. Your first guest is trying to say this is a political question for the supreme court and secretary of states. It's a constitutional question under the law , politics should have nothing to do with any of these decisions.
    The 14th amendment is a disqualifyer its automatic, you do not have to be charged with a crime to be ruled ineligible for office. It was written that for a reason , most Confederates werent convicted of crimes yet were disqualified under this amendment.
    This should be decided state by state, until case law and precedent is set in law. Ultimately ending up for the supreme court to decide, this is how are system was intended to function. Challenges to each decision should be made by the Republicans and Trumps campaign, they have that right. Voters deserve to have this settled before the election to make the most informed decision.

I was hearing that she called it an economic issue -- which is also what I was taught, in a northern states high school. Economic in the sense that the South would fall into poverty without slave labor. But that is not at all what she said -- freedom to do what you want?     Article 14 section 3 in the Constitution does not say let the voters decide whether somebody committed an insurrection. It is plain English and these Republicans that try to make it out like it's a riddle and we have to figure out what the framers meant.

    The fourteenth amendment is very clear; it is not, as some people say, "ambiguous". It is plain-spoken. We defeated trump at the ballot box in 2020--thus, it was settled at the ballot box--enough said.

    The old states of the Confederacy wanted to say that states had the right to hold on to slavery and expand it to the west and that the federal government wasn't going to tell them what to do. The federal government and the states of the Union agreed that slavery must end and end everywhere and that indeed the federal government has say over all the states and that the union would not be divided. If we are to live in a nation of united states, the federal government must be the central government that has say over all the states equally and the individual state governments have limited rights over the populations in their states. This was settled during the Civil War. The neo-Confederate party (a/k/a Republican Party) wants to undo that and they have been working on that agenda for decades now.

      It does not say Congress has the sole power to enforce. The Constitution must be applied by all relevant agencies, including the DoJ, and the Secretaries of State for the individual states. Section 5 simply gives Congress the power to enforce, should it become necessary to do so. All offices of government must apply the Constitution, not just Congress.

    So what if the questioner at Hailey's Q&A session was a "democratic plant"? Do republicans never send anyone to democratic events to ask questions and get the lay of the land? That's part of campaigning. It was a valid question, no matter who asked it. She was unable to answer it satisfactorily, no matter who asked it.
