How Can a TN Visa Holder Change TN Employers?

  • In this video we discuss two common scenarios for those who already have a TN visa and receive an offer of employment from a new TN employer. Specifically, how can a TN visa holder change TN employers? And, in the alternative, how can a TN visa holder add a concurrent TN employer, thereby permitting them to work for two TN employers? Both options are possible, and in this video we explain how each can be accomplished.

    I just read all this the USCIS site, but I wanted to hear ot from a professional to be sure. You are the first one I watch saying it to the point with put trying to sell something in the middle. Thanks a lot. I would like to see on your videos if I can change to green card from TN VISA.

      1. Cualquiera puede aplicar a Green Card, no ocupas contar con una Visa TN.
      2. De hecho tener una Visa TN lo hace más "complicado" en el sentido de que tendrás que cuidar las fechas CRÍTICAS, por ejemplo, la fecha de vencimiento de tu Visa TN Vs. la cantidad de tiempo que se tardarán en resolver tu caso en inmigración, en cualquiera de las categorías del resto del total de los 65 tipos distintos de visas norteamericanas que existen.
      3. En este caso sí recomiendo contratar a un buen abogado con MUCHA experiencia en Visas TN así como en la categoría aplicable de tu elección para la Residencia Legal Permanente (nombre correcto), PERO que además esté afiliado a la AILA, pues no todos los abogados certificados por el Dpto. de Inmigración pasan los filtros de la AILA.

    I have an offer from another employer under TN2 as Mexican, I have the paperwork needed to so I called POE to confirm they could do the proper process and they told me that as long as my I-94 is valid, I do not need to renew my I-94 and work until it expiers and that I'm able to work for any employers as long as I work under the list of professions approved by my background

      1. "TN2 as Mexican" es un pleonasmo.
      2. Los Permisos i-94 NUNCA se "renuevan" ni se "extienden". Sólo se CORRIGEN, o bien se tramita uno nuevo lo cual es altamente recomendable para prevenir restar regresando a México con mayor frecuencia.
      3. En cualquier puerto de entrada se puede tramitar el CAMBIO de empleador, que es otro trámite.

      Terrestre o aéreo eso no importa, mientras que sea un PORT OF ENTRY y el CBP tenga en dicho puerto de entrada una oficina de Deferred Inspection Site@@TCTSGlobal

    Hi Dustin,
    First of all, thanks for your video. It is full of worthy information.
    I have a question I hope you can help me with. On regards to the change of employer of a TN2 holder at a USCBP... It drives me crazy why sometimes they approve it and some other times they don't. You mentioned that 'depending on the profession, certain ports of entry can be more challenging'... do you have more information about it? or what to take in account to do a change of employer at a USCBP? Other thing that doesn't make any sense to me is that being basically the same process, why they charge $460 for the I-129 plus $2,500 for the Premium Processing at the USCIS while they just charge from $6 to $50 USD at the USCBP to get the approval right away. 🥴

      1.- El nuevo empleo debe decir el MISMO nombre del puesto con el NUEVO empleador.
      2.- Premium Processing aplica INCLUSO a gente con visas vencidas pero con permiso i-94 válido o corregido. Cosa que NO es posible de hacer en un puerto de entrada con Visa VENCIDA.

    Can I continue to work with my current employer even if my change of employer is approved? i got a counter offer of my current employer and I prefer to stay? (i havent move yet) (TN visa)

      Si aprobaron el "change of employer", la cagaste.
      Pero recuerda siempre puedes realizar otro segundo "change of employer" o los que quieras, si estás en el periodo de gracia de los 60 días desde la última vez que trabajaste.

      Lo correcto y como lo hizo mi compañía actual (cuando cambie de empresa) fue que ellos llenaron el formato I-129 pagando el proceso premium tomo dos semanas en recibir la respuesta (aprobado).
      He visto en grupos TN que alguna mexicanos han podido cambiar de empleador en algún CBP, yo hablé como a 4 diferentes CBP cuando quería hacer el cambio y todos me dijeron que tenía que aplicar por una nueva visa o hacerlo a través de USCIS, entonces no puedo confirmar esto.
      Pero la opción segura es que tu compañía lo haga a través de la USCIS y después cuando tú visa estampada expire (aunque tenga el nombre de tu empresa anterior) puede generar un Ds-160 y renovar sin problemas.
      Es lo que te puedo contar en base a mi experiencia y lo que hice cuando cambie mi empleador con visa vigente.
