- Elusive graffiti artist Banksy used Instagram to call out a Guess store in London for reportedly using his artwork without permission. “They've helped themselves to my artwork without asking. How can it be wrong for you to do the same to their clothes?'' Banksy wrote. He said the corporation should know better and called the move “copyright theft.” Guess got the hint. Shortly after the artist’s post was live, the brand covered up the artwork. Inside Edition Digital has more.
I'm with Banksy as well as many original artists when it comes to copyright theft. Copying an original without permission is just wrong.
But did he copyright it?! If not,than that’s the biggest rookie mistake you can make if you don’t want others using your art without getting paid for it 😭😭😭 And the nerve to call guess out lmao
It's a bland, uncreative drawing. Not art. Basically akin to anything you can find on google images. Guess owes him nothing.

No one knows what he really looks like and if anyone were to ever catch him working on an art piece somewhere, he’d only be seen wearing a hoodie and ape mask to hide his face. Respect to him and his work! ✊

I hate when a company says we want to show our appreciation. Well appreciate him by giving him some of the millions you will make off stealing his art work. If they would have involved him In some kind of way, this could have been epic. But no. They simply just stole his art.

Artists do not make millions for a t-shirt designs. Generally $500-$1500. In fact, even the stores do not make millions off of a print. The cost of clothes is divided amongst the store and its supply chain. The store would have to sell 500,000 shirts to make $1,000,000.

I don't want to know who Banksy is and want it to remain a mystery forever honestly. He symbolises so much more than one person can ever be and finding his identity will ruin that.
Rest assured we’ll never know, because Banksy isn’t even an individual, it’s an experiment with many people on board. This ‘person’ remains so elusive because there’s not one single person involved. It’s an effort by many. I know some refuse to believe that, and it’s just one super human who’s able to appear any time, any place- but skeptics will say otherwise.

Few know who he is? His identity is well known in the graffiti world. And nobody likes him because he is unoriginal and steals art. Especially the rat stencils he does that’s a huge ripoff. His can control was terrible and he was considered toy so he had to resort to stencils. TeamRobbo.

One of my fears of creating pieces is that you'll never know someone will copy and profit from it, especially if it's a small or big company.
All the more reason to post it on multiple platforms straight away. That way you have the upload date as proof yours came first.
I've had some of my stuff ripped off. The reply I got (from friends no less) was, everyone doesn't, just get over it.
Well technically, Banksy can’t trademark his work without revealing his identity, so Guess technically could have gotten away with it without legal repercussion. What they didn’t anticipate was Banksy calling in his fanbase to threaten them with theft of their merchandise.
It's not his identity that is trademarked. He goes through lawyers for all of his legal work. His identity has absolutely nothing to do with it.

So what if he did, @tas tiger? Copying someone's technique isn't the same as stealing an entire artwork and then enlarging it so as to commercially and financially profit from it, is it? This is obviously what Guess in collusion with Brandalised has knowingly done, isn't it? It's not as if Guess has never known what Banksy's like because his hatred of capitalism and profiteering has always been on full display in all of his artworks, hasn't it? Maybe Guess should think about opening branches of their shops in Ukraine before they blatantly resort to stealing his original artworks, shouldn't they?

Wait, Guess says that they have a deal with a company authorized to license his art? That sounds legit. It’s like a record studio owning the rights to music an artist makes.. Happens all the time in this business
So yes and no. Banksy (and all artists under UK law) has the copyright rights to his own artwork but in order to enforce the copyright, he would need to reveal his identity. Brandalized is basically just taking advantage of a legal catch 22 to be able to merchandise his artwork.

Kind of sucks and weird that his art can be authenicated as his and profited off of but he can't claim copyright protection without revealing his identity.
@@leonardozhang A copyright has to belong to a person. So the individual needs to prove their identity and that they created the IP. Makes sense to me. He wants to be anonymous and vandalize buildings. This is the cost.

They can't just take Banksy's artwork and then go and make business deals with whatever companies they want with them.

The only problem with this is they have copyright permission. I'm not sure if everyone got it but they actually have a partnership. Meaning he sold the rights so they could use them and do as they wish with them. If he didn't like how they were used then he needs to pull the rights and give back the money. Not telling everyone to commit a crime because he is upset. Also because of that if someone did and stole from the store, got caught he could be legally responsible. Before people go there is no way he could legally be responsible. You say that but I can point out cases where it's a common thing.
