We have gender-biased laws which are extremely hostile against men (specially married men) even if a wife can put your family in jail without proof which is just extream because if you are a strong-minded man then you can adjust to bad situations but you CAN NOT see your parents behind bars for false allegations made by your wife.
Although there are two sides of a coin, in rural areas wives are beaten by their husbands and in-laws most of them are uneducated and under the poverty line, for giving justice to them we have these kinds of laws. Also, we are the second biggest country in terms of population and do not have the needed number of police or the infrastructure for handling a huge number of cases.
The summary of the story is - if you are not a powerful or famous person and if you do not have strong political and social backings, then "marriage" could be a TRAP, you should be very careful before getting married, you don't know their intentions before giving such powers. - or go to another country and marry a foreigner, at least your foreigner wife can't put your parents in jail with false allegations.

I agree that laws in most countries favour women. But just to get it right, its worse here in India.
there has been incidence where an handicapped unemployed man was asked to pay alimony to his wife who is able and working. Similarly, the laws was silly like the following : If wife had an affair, its not the wife's fault, but the person who wooed her, Domestic violence cannot be conducted against a man by his wife, . Even if a wife conducts adultery and has a kid, the kid is your responsibility, rape can only be conducted by men against women and not the otherway round. But yes slowly it is improving here.
My recommendation is same as yours, dont marry, thats the path I have chosen for myself.

Main problem lies in the delayed trial procedure of indian courts...
Even if husband is innocent..oir courts still punish him with long trial procedure..husband And his family have to appear in court on every hearing ...as if they are criminals..
Usually these cases take around 7 years at the lower courts..

    • @VishnuAnilkumar1
      @VishnuAnilkumar1 Před rokem

It is not just the time taken by the courts.
Our fellow people dont understand that a person is innocent untill proven guilty. As soon as a woman sheds crocodile tears, the society is fast to condemn the man without a second thought. The news papers are in a hurry to demonize the man.
But how can we call their actions wrong, when the law itself requires a man to prove his innocence and is guilty untill proven innocent?
And even if he does prove his innocence in court, the society still likes to believe that there is something wrong with the man and the newspapers are not interested in clearing the man's name.

My wife and I have been separated for the last two months. And before separation, she kidnapped my son without my knowledge. And somehow after ten days, I found her and we had a very bad argument and she started blaming me for the past and kept on arguing with me after I even approach her for forgiveness and even touch her feet that please make everything normal and don't dig on the past as it will only create sorrow in our relationship. But she didn't listen to me and I took my son away from her and I was taking care of his education and took him along with me and even I shared every live update of my son that he was doing well with his studies. Though we were communicating less always regularly basis I use to share with her everything about our son. But just last week ago she filed a false allegation against me that I have kidnapped my son and taken him far away. What can I do? We loved each other so much and we use to have arguments sometimes but she use to keep all the words inside her heart. And when I asked her about our separation she said that I have been observing every word you spoke to me and I was under stress for the past 6 years. I cannot believe till today she can do this to me. I never found she was in stress as she use to enjoy every moment with the family and even our bed relationship was good for the past 6 years. My wife has a habit of digging into the past whenever there is any sort of argument, and most of the time she keeps herself silent. Just as a narcissist. Please suggest to me what can I do at this moment to resolve this issue. She wants me to cooperate or else she'll pass the case to child welfare. How can I live without my son as she is trying to make my son her weapon and trying to hurt me day by day? Please suggest!

Let me tell practical aspect to what Amish has said:
Any case if you file against your wife even after aquital is simply not admitted by court. While giving the final judgement in false case, in majority(90%) of cases judge mentions something like:
"in absence of any proof, husband is aquitted" or "petitioner/wife counsel couldn't prove the allegation made hence husband is aquitted" etc. Please not the choice of words here, nowhere judge will mention directly that "wife has filed false cases, wrong prosection, cruel intention of wife etc."
Because of not directly mentioined that such cases are false, you can't file counter cases against her. That's the ground reality.
Advocates will give you hopes and always tell that "sabak sikha denge ladki valo ko, jail karva denge" etc, but that's the truth. When you will file the counter case, judge will do the following:
    1. defamation case if you will file: show me what damage in your image has happened, tell me with before and after proof before I will admit the case.
    2. damages and monetary compensation: he will simply laugh off and take it very light and even cajole your lawyer to convince you that, nothing you will achieve out of it and live peacefully.
    3. filing of wrong prosecution against your family member: judge will simply say that getting aquittal is the reward and you can't expect further than that.
All in all, it is very hard to get girl prosecuted for false cases unless you have strong grounds like in your judgement it is written or it has done serious loss to you, like somebody died/committed suicide because of cases, or you lost job, or newspaper coverage of your false cases etc.
