साफ और सीधी बात ये है कि वास्तविक व् व्यवाहरिक रूप में (as per constitutional artiical 235) देश में केवल दो तरह के ही जज हैं, हाईकोर्ट के जज और सुप्रीमकोर्ट के जज/
डिस्ट्रिक्ट स्तर के सबार्डिनेट जज एवं एसडीएम स्तर के मजिस्ट्रेट में न्याय की बारीकियों और गुणवत्ता की कमी अवश्य है, वरना हाईकोर्ट में केवल अपील के अंतरगत् इतने केस फाईल नहीं हो रहे होते और न् ही हाईकोर्ट और सुप्रीमकोर्ट में निचली अदालतों के फैसलों को बड़ी संख्या मे पलटा जा रहा होता/
सबार्डीनेट जजेस अधिकतर केसेज में केवल "बाइनैरी पद्धति (only Arguments & Witnesses)" की ही घिसी-पिटी प्रैक्टिस कर रहे है जैसा कि फिरंगयों द्वारा स्थापित वर्तमान पुलिस विभाग में आज तक होता आया है अबतक (क्योंकि इनकी स्थापना हुई ही थी केवल शक्ति सम्पन्न व् पूंजी सम्पन्न लोगों की बेहतर सेवा के लिये, और निचली अदालतों का ग्राफ भी इनसे कोई अलग नहीं है, वास्तव में ये एक दूसरे के पूरक ही हैं, We The People Of Country से इनका कोई लेना-देना नहीं होता है हकीकत में, बस भ्रामक रूप में दिखता जरूर है, इसलिये संविधान में आर्टिकल 235 का प्रावधान विषेश रूप में किया गया है, क्योंकि संवैधानिक ज्यूडीशरी के विपरीत ये फिसल जाते बहुत ही आसानी से, सभी तो नहीं लेकिन अधिकतर) , ऐसे जजेस कभी "फारेंसिक पद्धति (on the actual degree of Consciousness of the case, petitions, documents and evidences)" के अन्तरगत् किसी भी प्रकार की प्रैक्टिस नहीं करते अपने इंट्रीम अथवा फाईनल आदेश (जजमेंट) देने से पहले/
शायद ऐसे जजेस "फारेंसिक पद्धति" से परिचित ही नहीं हैं/
निचली अदालतों के ऐसे अपरिपक्व आदेशों के खिलाफ Review petitions या हाईकोर्ट मे अपील करने के साथ-साथ वास्तव में ऐसे केसों की "निरीक्षण-परिक्षण प्रक्रिया" को चुनौती देते हुए सम्बंधित हाईकोर्ट के रजिस्ट्रार विजिलेंस मे सबूतों के साथ सख्ती से शिकायत दर्ज करानी चाहिए/ क्योंकि जजमेंट को चुनौती देने के लिये रिव्यू पिटीशन या अपील करनी पड़ती है परन्तु Process & procesior को चुनौती देने के लिए सिर्फ "संबंधित हाईकोर्ट के vigilance registrar में याचिका डालनी पड़ती है/
सकारात्मक रूप में जबतक ऐसे कानूनी कदम उठाने शुरू नहीं किये जायेंगे, निचली अदालतों में किसी भी सुधार की ऊमीद करना भी मुश्किल है/ लेकिन वर्तमानकाल में वकील समुदाय के पेशेवर वकील ऐसे आक्रामक कदम उठाने से भले ही हिचकिचाहट महसूस करते हों लेकिन संविधान की धारा 32 की शक्ति के अंतरगत् मैं (as a micro representative of We The People Of Country) ऐसे कानूनी कदम उठाने से न् ही डरता हूं और न् ही चूकता हूं (क्योंकि न् तो मेरे पास किसी बार एसोसिएशन से कोई लाइसेंस है और न् ही मुझे अपने ऐसे किसी लाइसेंस के रद्द होने की चिंता है)/
इसमें कोई शक नहीं कि ज्यूडीशरी हमारे लोकतांत्रिक देश में संवैधानिक स्तर पर सबसे प्राथमिक, माननीय, सम्मानित व् आदरणीय स्तंभ (pillar) है, लेकिन समय-समय पर उस स्तंभ को यह भी याद दिलाते रहना जरूरी है कि वे भारतवर्ष के प्राथमिक, माननीय, सम्मानित व् आदरणीय स्तंभ अवश्य हैं लेकिन उनके पास संवैधानिक स्तर पर अपने स्तंभ स्थान से हटकर किसी कुतुबमीनार के रूप में पदस्थ या स्थापित होने का भ्रम पालने का अधिकार कत्तई नहीं है/
और जहां तक पुलिस के स्तर का सवाल है तो उस विभाग की असलियत (पार्दर्शिता, देशवासियों के प्रति पूण्तया समर्पित, निष्पक्षता, समानता आदि) तो देश के बच्चे-बच्चे को पता है/ (ये दिखते तो दिये के साथ हैं पर वास्तव में होते हवाओं के साथ हैं)😜
असल जरूरत तो ये है देश में कि देश के माननीय CJI एक ऐसा स्वतंत्र कानून (अथवा संविधान के आर्टिकल 235 में संशोधन करक) भी बनायें कि किसी निचली अदालत के किसी केस के बकवास आर्डर को अगर हाईकोर्ट एवं सुप्रीमकोर्ट में पलटा जाता है नैतिकता और संविधान के अंतरगत् तो पीड़ित व्यक्ति के तमाम वो खर्च जो उसने Review Petition और Appeal के लिये अतिरिक्त रूप में खर्च करने को मजबूर हुआ/हुई, उसकी भरपाई निचली अदालत के उक्त जज के वेतन से की जाये जिसने अपना वो बकवास (गैर संवैधानिक) फैसला सुनाया था उक्त केस में/
यकीन मानिये कि रातों-रात एवं मात्र अगले 24 घण्टों में देश की तमाम निचली अदालतें Right Time हो जायेंगी Automatic स्तर पर/
ये संदेश लम्बे समय तक पूरे देश में पूरी ताकत के साथ हैशटैग के रूप में प्रसारित व् प्रचारित होना चाहिए, सभी देशवासियों के संवैधानिक व् नागरिक सुरक्षा व् सजगता के अंतरगत्/
