Debating our Fishing Rights Against Security then Catching a Pike - Urban Fishing London Canals

    It's another day on the bank targeting urban canal predators, and we haven't been at it for long before security closes in on us again, this time showing up in the form of 3 guards and a dog.
    Jay lays out a set of well balanced arguments to highlight the opposition's lack of logic, before we move on to a different stretch of canal where something very unexpected occurs, enriching the day's eventfulness.
    There's never a day to come without anything new to experience.

    The worst you are doing is tresspassing which is civil matter and not an offence the police would arrest you for, you could just carry on fishing until the police arrive and then leave peacefully. This would mean you would have these yellow jacketed security muppets giving you hassle until then so its probably best to leave after you've made your point to them. Keep up the pressure with urban fishing boys, it's ridiculous that so much water is being taken away from fishermen in the name of urban development.

    I hate to go against the grain here but the security officers are right in this case. You can have private property where license to access is given to the general public but can be revoked at any moment without a particular reason, and this estate looks exactly like it. The fact that an NHS trust is part of the estate, owns the estate or is adjacent to the estate makes no difference, as NHS trusts are technically also private property (hence why you can be removed from a hospital if you make a scene or cause any inconvenience to people around you).
    The reason why security staff don’t call the police is that in England trespass is not a criminal offence - but a civil law issue settled in tort law, hence why the police can’t enforce it. The only time police get involved in trespass is when there is a threat of physical harm or invasion of privacy. The property owners have to sue you in civil court to get an injunction and/or claim damages against you (which they would be entitled to, but it’s too expensive for anyone to bother).
    I sincerely admire the fact that you guys go outdoors and spend your free time in such a healthy manner, but if you’re told by someone that you shouldn’t be somewhere it’s worth considering whether they might be right. Also, I think there should be more activism around creating public green spaces for our youth to freely enjoy, but that’s a different matter…

  • @formicapple2
    @formicapple2 Před 4 lety +1

    Yea, I understand exactly how you feel. any towpath or public footpath are public rights of way and nobody can order you to move on except a Constable and you have to be breaking a criminal law. I can not see any footpath or towpath, so I would assume you are indeed on private property. WTF. In any cases, you are involved in a Civil Dispute and not criminal. Yet. If the landlord/or his agents, in this case the security bods tell you to leave then you should, otherwisw it is aggrevated treaspass which is criminal. However, and this is what gets my goat, so much public domain has been taken over by Corporations, there are now many places where security guards are able to "flex their muscles" so to speak and get away with it. I'm sure if the land owners wanted anglers there they would charge you a heafty day ticket. Anyways, the fact that you said you would leave if security called the Police and the Police said you had to leave then you would. You'r being totally reasonable: challenging Security with a Civil Dispute to be resolved by a Constable. Imho, you conducted yourselves correctly, as did the guards. So, the police did not attend, assuming security called the police, I suspect, the police told them they would attend so time today. So well done to all, especially you.

    A public right of way does not confer any rights to fish, even if there are no signs. Many years ago when these areas were effectively derelict, nobody really cared whether people fished there or not. Many of the redeveloped waterside areas are now privately owned land, but local authorities include a "public right of way" as part of the planning process, otherwise these places would be gated estates for the wealthy and pedestrians would have to walk round the perimeter to reach the other side. Most docks now have clear no fishing signage.

    I know it's frustrating because you're doing no harm, but the rights of fishing are the responsibility for the estate its no point arguing the legalities it would be better to go over the securities heads & try to get permission. although it makes for good viewing if you're not catching

    Where I live in Northumberland your not allowed to fish from a public right away,so maybe applying that rule from the local council will put a stop to you just fishing where u want to this may seem harsh but nowadays people are watching as everything nowadays is abused because of the media

    You guys reasoning way too long with these nutters. You should have cut it short:
    1. Land can be private, but that water is not private, it is public water. Water management and fishing regulations falls under the EA's authority. Fishing is not an illegal activity on public waters (with valid rod licence). Hence no one can send you away except the police or a bailiff.
    2. They don't have the right to confront you. That is harassment. IF they believe that is wrong doing going on, only thing they can do is call the police or report it to the relevant authorities.
    3. Putting out NO FISHING sigs needs to be authorized by the council and the EA. Also any prohibitive sign must contains the relevant law written under the sign, which the restriction refers too.
    Knowing these rights and rules can cut a meaningless conversation short.
    Another word of advice, the more you talk the more chance you giving them to harass you. Keep your say short and factual, end of.

    “This is private land”….trespass at most, which the land owner needs to make the request to leave, section 33 it is publicly accessible, just throw the clowns in the water next time an the dog aswel

  • @daddyfixit5188
    @daddyfixit5188 Před 3 lety

    Criminal prosecution of trespass can only be charged if you wilfully damage property. If the area is not gated and open to public there is probably an easement that lawfully allows public to pass through even with a fishing rod 😁👍
