- Ever wondered if you can go to prison for using pepper spray for self-defense? Some people certainly believe it. In this detailed video, James Reeves dives into the practical and legal distinctions between using pepper spray and a firearm in self-defense situations. Drawing from personal anecdotes, expert opinions, and a thorough review of relevant legal cases, James explores why carrying pepper spray could be a wise choice in scenarios where non-deadly force is sufficient. Whether it's defending against an aggressive dog or de-escalating confrontations, this video provides insights into the potential legal outcomes and real-world applications of choosing pepper spray over a gun.

Real story... I watched a video on this channel probably close to a year ago where James talked about pepper spray for animals. I found one on Amazon with a cool neoprene sleeve that went over my hand and had a pocket so I could hold the pepper spray for me while running. It had solid reviews and I seen some testing on other CZcams channels. I bought an extra so I could practice with it. Life being what it is, I never got around to practicing with the spare so I never took it running.
Back in February, I moved to my dream home in the country. Its pretty rural. So rural, I can see my neighbors' houses but cant hear them, each road is about a mile long, the closest gas station is about 7 min away.
I went for my first run in my new "neighborhood" in March. Right before I left the house, I seen the pepper spray and thought "couldn't hurt to bring." After all, I've see coyotes several times.
I was on mile 4 and just about back home when I was running near a house (opposite side of the steeet) and all of a sudden a doberman ran out of its yard and squared up with me about 5 or 6ft away barking with its ears back. I yelled at the dog a couple times. After about 5 seconds, I made the decision to give it a little spurt of mace to the face. The dog backed off and started rubbing its nose. That's when I saw a few tweens in the dob's yard. One girl yelled over "sorry about that" then yelled the dog's name. I said "no problem" and started running again. I heard another kid ask "what's wrong with the dog?" I got my ass out of there as fast as I could.
Since then, I have ran near that house again a few times. That dob has remember me and hasn't come near me again. Lol
Great story
I hate it when ppl leave there dogs running lose.

Did you call the cops afterwards?
@@musicman1eanda No there was on sight security that got involved
Glad you're okay. People can be crazy....
@@Ammotax Glad that worked out okay. I hear a lot about how people who don't call the cops get in trouble.
I had to pepper spray an aggressive dog in a park that was loose and the owner was nowhere around. Minutes later I ran into the owner farther down the trail and I apologized to them. They were in denial their dog could ever be aggressive and they ran down the trail looking for their dog. Weeks later I ran into the same person on the trail. This time their dog was on a leash and not aggressive, but the owner certainly was because when they touched their dog after it was pepper sprayed a few weeks earlier they were foolish enough to wipe their eyes or touch their face and that made them suffer the affects of the pepper spray. The lesson learned is that you shouldn't assume your dog acts the same when you're not around and keeping them on a leash means you and your dog likely won't suffer the affects of pepper spray like this person.
Gotta watch out for those Chihuahuas, amiright? You did the right thing.
@@harpsitardo It was a 100+ pound German Shepherd.
My neighbor has multiple pitbulls that he refuses to control. He told exactly the same lie that dog owner told you (It can't be my dogs... blah blah blah), but in court to a judge. The second time we went, he didn't bother to show up because I have since installed security cameras so his lies wouldn't work against video evidence. Prior to that, I started carrying bear spray while out and about in the yard because most frequently there would be a child running after one of his dogs and I thought it better to not pull a gun on them. He told the police that I was spraying bear spray around the property with the intentional goal of baiting his dogs into attacking me (which is a dumb strategy in every possible way). He also doesn't know I saw that body cam footage in court...
You're giving people more credit than they are due. Most of these people are just s-bags that simply do not care about anyone but themselves.
Having a pepper spray may actually help you if you are involved in a self defense shooting because you had considered non-lethal force in your day to day activities.
On the other hand, having a spray and not using it during a self defense shooting may work against you. Prosecution will come up with hundreds of scenarios where you could have de escalated the situation but chose not to use it 😂
@Shadow__133 which is also why you never talk to police. They then have to prove beyond a reasonable doubt that you acted illegally. A half decent lawyer is going to have an easy job getting you off.

The POM I was carrying expired this last week, so I ordered a new one and used the old one to do some testing. I did a simple test of effective range (the advertised 10 feet is good, coverage drops really fast past that). I also sprayed some on a tissue and dabbed the corner of my eye. That eye was ineffective for the next 20 minutes despite almost constant flushing. If POM at its expiration date works like that, I am comfortable carrying it.

As much as I love the gun videos and mail room of course, these lawyer perspective videos have become my favorite. I'd like to see you do videos on other less than lethal stuff, like less than lethal shotgun rounds, batons and tasers. Keep up the great video content!
I was in an argument on Twitter with a woman who teaches elderly women how to shoot. She was saying things like “A lot of elderly can’t handle a 3lb trigger”. In my eyes(I also teach firearms use, but for mil/LE, as well as civs), if you can’t pull a 3lb trigger, you’re kinda dangerous with a gun. I don’t want someone struggling to pull a trigger, and jerk the shot, hitting a bystander. I said Pepperspray would be better. And that it can be used in more places, in a wider variety of situations, is cheaper, and that it probably gets used more often than guns for self defense.
She lied and said I believe only cops and mil should have guns. People called me dumb. The fact is that being the victim of a violent crime is rare(depending on where you live), and that Pepperspray will be appropriate for a wider variety of situations that civilians find themselves in. Multiple armed men breaking into your home is at the bottom of the list of things that could happen. A homeless man bugging you for money, and getting belligerent is more likely to happen. An off leash dog charging you is more likely to happen. I have had a lot of students go on to use force in defensive situations. The amount of them who used spray was drastically higher than those who used their gun.
I know it’s romantic for some reason to talk about the most extreme cases of potential violence, but that’s just not all that likely. Someone road raging at you and pounding on your window is more likely than dozens of gang members trying to rob with machine guns. And for those who cannot legally carry a gun, or operate them safely(such as the elderly), they’re fantastic.
Not sure about pepper spray, however I do know for sure that bear spray made a drunk man stop in his tracks and rethink harming me. The camera footage from my home system had the police laughing as well
Upload it? I wanna laugh too.
The perp rather be with the bear now 😂
The problem with using bear spray is they often have the “Not for use on humans” clause printed on the label and a demon.. I mean prosecutor will use that.

@@JamesReeves I'd be interested in that video also. My sister was attacked by some crazy bitch in a road rage incident and the lady sprayed my sister(as she sat in her vehicle) with pepper spray. The kicker was that my sister had just had nasal reconstructive surgery and was therefore significantly more sensitive to the spray than she would have been normally. Funny thing is the lady would have never been caught but she drove home and called the cops and tried to claim my sister came up to her car and sprayed my sister as she sat in her own vehicle rather than the crazy bitch going to my sisters car and spraying my sister as she sat in her car. My sister was simultaneously talking to the police who quickly realized they were talking to both parties of this fight. They looked at my sisters car and saw that the interior was covered in pepper spray and they did indeed arrest the woman because she lied to them and she was the aggressor. Eventually she was convicted of a misdemeanor assault charge and got a couple days in jail.
I'm guessing it wouldn't be legal to shoot in the situation my sister found herself in but I don't know? The lady attacked her and had chased her down prior to that.
@JamesReeves would like a video on this as well
Yes, because it will immobilize you and cause you to be blinded, no if it is for them to escape and they are running/ escaping to de escalate
Probably would be dependent on who eas the initial aggressor.
have used OC spray more than once & i've heard the stories of "it didn't affect him, he just fought right through it!!" i've never seen anyone fight through it after a good hit in the face. if you miss, or don't hit the target zone then of course it's ineffective. i've been OC'd & tazed in training & both are a very shitty day.
I've witnessed multiple episodes of "cops" where they act like it's an enjoyable mist on a hot day. Seriously multiple times. There's a reason they use tasers now
And I had a friend in law enforcement who literally had to get sprayed and "fight through it" against a punching bag just to graduate. Not sure how "no one" can fight through it if every officer who graduates does. Maybe I'm missing something here?
@@StinkyGringo I had to do the same thing & no it doesn't kill you but a good hit in the face renders you combat ineffective. yes in academy we took a full blast to the face & strike a punching bag with our batons, this was training & no one trying to seriously hurt us. after we jumped around wildly in pain swinging our batons our instructor would guide us away where we'd continue to dance around in pain. LEO for 29 years, now retired. Actual use of OC numbers of times. All successful. Don’t understand why police seem to have abandoned it for less effective Tasers. Note: Only answer to gun or knife is a gun, not OC.
I carried batons and PR24s in uniform, but was never issued OC until I took a plainclothes investigator position and never had to use it. In uniform, we were first require to train and “qualify” with out expandable PR24s on a quarterly basis, although the progrwm had been made up by an independent contractor and rather Monadnock and a lot of the PR24’s better qualities were watered down. I understood that as I had previously been certified as a Monadnock instructor. Nevertheless, if I was doing it all over again, I’d still prefer a stick to a taser. And I never ever heard of anyone mistaking a pistol for a baton.

You should do a video on pepper ball guns. I’ve seen these advertised in the past few years as a non lethal alternative to a gun. The idea is that it functions as pepper spray and a gun, giving non lethal performance with some range
I've seen them used and they seem to be less effective unless you get a good hit. What I worry about with some of them is potential agg assault vibes, too. "I though he was pointing a gun at me!" - even if it's not really a a gun, this could result in an agg assault charge.
Some of those pepper ball guns can also use same size rubber balls too. It won’t have a bean bag round effect but have some deterrent effect.

It's always easy to sit and talk about these issues, but when confronted with life or death decisions, thinking goes out the window. I really appreciate these videos with your real-world experience. It pays to remind people that the law is a fickle mistress and you should err on the side of "not trying to kill." As people will most likely be clutching their pearls in the stands while you give a self defense testimony. You mentioned in a previous video about punisher logos and blinged out guns. You should seem as impartial as possible. It's hard to walk that wire between having your gun ready to use, understanding that "use" probably means kill in all honesty, and really trying not to kill the person if at all possible.
Merits of this expertly-crafted and very informative video aside, this has to be the best use of AI images yet. Bravo, Jameothy.

Love all of your videos!
Guns are a intrinsically a legal snafu, even if everything you did was perfectly in line. It’s still going to be a situation where you need to interact with the police and will need a lawyer. Pepper spray really doesn’t have any of that legal weight to it, especially if it is used in a brief street encounter with a thief. The fact that pepper spray literally cannot kill someone, and cannot inflict permanent damage, is huge. It is truly non-lethal, no matter what kind of mental gymnastics someone might attempt to say otherwise. OC spray is intrinsically less harmful and potentially damaging than going hands on with someone and therefore i would say is likely also legally safer in many instances. More importantly it is just more safe to maintain distance and not be within touching distance. A big reason why OC is better than a contact taser ie “stun-gun” which while also non-lethal really are terrible for self defense use. They are compliance tools at best and honestly are most effective at subduing someone you already are overpowering and want to detain, in a civilian context this is called kidnapping. The police style barb shooting taser pistols are a pretty effective tool when they get a good contact but run much more risk of causing harm and subsequent legal repercussions.
I immediately assumed that using aerosol Brut would have been deemed " cruel and unusual "
Great, informative video. When are we seeing the pepper spray equivalent of a PEN15 build (macehole?)?
So I’m 6’3 250 and strong. Am I better off using pepper spray than fist? How many times have I heard the argument look how big that guy is. I feel like I have a lesser chance of really hurting someone with pepper spray then breaking a jaw. Any thoughts on this?
Possibly. Good point.
If you break an orbital bone, or they have a glass jaw, etc., it can be a felony. Empty the OC and it's still a misdemeanor.
Bad idea. Using fists is gonna get you in more trouble than using spray. It’s also not as effective. Spray has over a 90% chance of ending the threat. A punch to the face is basically a 50/50. Both legally and practically, you’re better going with spray.
You are under ZERO obligation to engage in physical contact with an aggressor as a level of force. Even the largest and strongest of big cats stays clear of the honey badger, because they can still inflict serious damage despite their underwhelming size. A weaker smaller human has the same potential.
In my opinion Blake was clearly violating the “rules of the road” when he asked for $20….
It is critically important that you receive training before using pepper spray. As someone who’s been sprayed multiple times in the line of my employment, I can tell you that it is extremely rare where the person who applied the spray didn’t have it land on him or her as well. The spray can be just as disorientating to the person who sprays as the person who has hit. If you have a firearm on you and you are this orientated or taken out of the fight by your own spray, you can actually be putting yourself in more danger of having your firearm taken and used against you.I would never think to doubt James’s legal judgment, but you really really ought to have proper training for any aspect of self-defense
it depends on your state ... in Maryland, it IS classified as a deadly weapon, and if someone uses it on your offensively, you CAN counter with deadly force against them. So you have to use it ONLY in situations where force was imminent, and not just in an argument.
So that what dreads locks are for. Great 👍

Depending on the state, pepper, spray can be carried. However, tear gas cannot. And if you're a felon, you are not allowed to protect yourself with pepper spray cause you will go to jail which is a bunch of b.S i'm going through it now. Some dude trying to run me off the road called the cops because I bear sprayed him. He couldn't handle the fact that he fooked around and found out but I'm defending myself and video shows him attacking me!! 115000 bail!! I'm in California
Pepper spray doesn't always work on people. I have witnessed this twice. Once at a local baseball game, everyone started screaming about a naked guy in the parking lot. I went to see what was going on like almost every one else. There was this huge white guy, about six and a half feet tall and ripped. Naked walking around yelling jibberish. The first cop arrived yelled at him to get down etc. The naked guy didn't even seem aware of the cop. The cop gave him a short burst of pepper spray which had zero effect, then a long burst head to toe. Still zero effect. A few minutes later a couple more cops came and taser him. The taser dropped him instantly. The dude didn't resist and was taken away in an ambulance. Second time one of my former neighbors who was a violent drunk decided to rage on me in my parking lot after i got off work. The dude was so drunk he could barely walk. I emptied a small can of Saber CS pepper spray on him. It had no effect on him at all. Eventually he got tired of chasing me around the apartment parking lot and went back to his apartment. The neighbors were starting to come out to see what was going on as well. Pepper spray is a great tool, but dont put to much trust in it.
Pepper Spray is mostly useless if you do not hit the eyes, nose, or mouth area of a human or animal... if you spray somewhere else on the body it will not take immediate effect. I was sprayed in the eye and mouth before by a dumb bouncer who falsely assumed I was the attacker when it was one of his drunk bar guest who randomly attacked me and my friends, and yes the pepper spray took effect immediately on my eyes by blinding my vision and burned my respiratory system which are the two main area of impact to seek for when using pepper spray.

It would be nice if the cases were linked or attached to a video like this.
Mace seems great for the woman, no one wants to hit a woman.. but sometimes ya gotta do something if there being violent.
Sidelight question to this subject: have we seen any cases/charges brought involving things like the Byrna launchers? With those types of LTL devices seeming to grow in popularity, I am curious if they are "riskier" or more likely to cause legal issues than just standard pepper spray.
11:40 I remember seeing that on the news. What a fool they made out of him 😂
Only you can make this funny thanks for the info
It definitely depends on where you live. Last month in Charlotte a food delivery guy entered the yard of actress Angie Harmon to deliver a food order. He shot and killed her 30 pound dog and claimed self defense. CMPD took the report and left with no arrest or anything. She’s now taking it to civil court against the company he worked for.
I agree that the niche for pepper spray on the "force spectrum" or whatever tactinerds call it is really narrow. Angry dog is probably the best example, because the risk of serious injury is fairly high, running away will contribute to the dog's instincts, but the risks are not quite serious enough to warrant firearm use.
Called local shop on this topic if you didn’t have to use an actual firearm, say someone trying to mug you and had distance. They were dead set use of lethal force is much more legal where non-lethal would land you in prison for sure. Ended up with more questions than answers.
I spoke with a bunch of cops about this. He said they almost never charge people for pepper spray if they get attacked first.
I just kept getting distracted by the tiny collar on the shirt 😂

In my case, using OC or even a TASER is safer for the person attacking me as well as me because when unarmed I have to inflict injuries sufficient to make my attacker quit. OC is more likely to stop the assault without inflicting permanent injury than if I kick a knee hard enough to dislocate the knee cap.
the ai art is the best add on to this channel lol
I am not trying to argue what situation may fit the narrow area between no force and legal use of deadly force, but in the state of South Dakota you must match the use of force you are being threatened by. It is an escalating scale so to speak. So while determining what that situation is may be difficult, it doesn't mean that the law doesn't demand it of you. I hope that was clear. I always recommend that if you carry a gun you also have a less lethal option as well.
Like all self defense cases, it depends on who you use the OC against. In Denver, a man sprayed an Antifa who punched him. The Antifa gunned him down in response and wasn’t charged.
Do you have a news link? I would like to research this one. Thanks
@@robertalonzo5725 the shooters name was Matt Dolhoff, hopefully that doesn’t get censored
James I’d love to hear your take on accessories/ parts. Everyone and their cousin says “don’t change your trigger on your edc cause the court will say you wanted to kill someone” but I’ve never seen a case where this was actually presented as an argument. Cheers!
I use pepper spray hardcore! I've ran into situations where I had pulled my gun thinking I had seen a weapon in hand but I pulled back gained distance holstering it and pulling the spray. As with everything train with it. Very useful
After 24 years in Federal Law Enforcement using pepper spray was always a gamble. I'd say it was affective most times but other times it had zero affect on others. To be honest, the times we had to use it on multiple individuals to control rioters or larger numbers of people we were hesitant. The more you deploy pepper spray the more in affects everyone around you including your self. As for myself I never could wrap my head around how it had zero affect on some people. When I was hit with during training it dropped my 229 lbs ass like nothing. That's after I found out I was allergic to it also!!!!
A friend of mine and I where fishing a bridge and a lady jogging by, jogged by, stoped, turned around and said something, My friend turned to see what she said and she tried to pepper spray him!
I veiw cruelty to animals worse than murder 1.
when i was working armed security, we were NOT allowed to carry pepper spray and a firearm, idk if it was a security company rule or the law.
But do you EDC pepper spray in the same manner as your primary weapon?
I carry pepper spray everywhere I go, my primary concern originally was wild animals and the dogs in the neighborhood, however I also carry it for giving a spicy snack to people if they ask for it really nicely. It was probably about 2 months ago an unleashed black lab that I had never seen in the neighborhood rushed me and my miniature poodle down. I was not particularly happy with the effect the pepper spray had, I somehow managed to draw it quickly enough since I use a holster, however the dog didn't stop coming at us from being sprayed the first time. I had to keep moving laterally while I reached down to spray the dog up close to make sure I wouldn't miss, the whole situation was super sketch, the dog seemed to be slowed down and deterred for a moment before trying to come at another angle. However it wasn't until after about 8 or so sprays that the dog retreated, some woman showed up and I told her to wash her dogs face off, she seemed calm, but I was worried if her husband was home if he would come after me. The whole walk home I was paranoid about being chased after. luckily that didn't occur. I do think though that if that dog was interested in biting me it could have, I believe it was after my dog instead, either just to smell them, or potentially to bite them, I'll never know.
Was your spray near expiration date?
@@graywind4326 nope I checked that, I think it's just that even though dogs are very sensitive to pepper spray, it was also highly excited and determined I think it was just pushing through the pain for about 3 seconds, that's about how long the incident lasted, probably.
Next video why james now carries the byrna as his edc. Dont you do it james
