      Hello there. I'm trying to find out some things about this free claming land thing. I looked up this land that I found. But it say registration to the council. I know this land hasn't been use pass 2 or 3 years. Can I still try claiming the land. See I not 100%.

      @@christopherburnmccrossan2023 Hi you can but the council are the worst because if they do come out they will know it's their land and take you straight to court.
      They claim lots of land themselves and are just hypocrites and if there is land around and they can claim it they will.
      I saw this guy using the land for over 15 years for his horses then the council went to the railway and claimed the land. But the guy was just thick as shit and would let me help him claim it so the council claimed it and just let him keep his horses on there.
      I hate the council when it comes to claiming land. Even if you managed to claim it they would never let you do anything with it. So I would look for another piece if I was you.

      I seen one of the video's you made and it made me think. I saw some similar lands. What can I do if I see a gate with a lock on can I still claim it still and take the lock off.

      @@christopherburnmccrossan2023 Hi Just take a look at the lock is it old or new..? You will tell if it has been opened a lot, if it's old and you will see if it hasn't. The lock maybe 50-year-old.
      But you will tell if anyone has been in the field through the land near the gate and tracks for vehicles.
      But make sure the land does have any other entrances as they may use another way.
      But you need to be looking for land that's just overgrown and a mess with maybe crap tipped in there and you should be able to tell if its unkept etc.
      Don't try to claim a nice cut field, but you can try and claim anything it's just that if their2 owner is local you will probably be thrown off.
      Me I would print out 50 Keep Out No Trespasser sign put my mobile number from £10 so if it rings you no it's about the land and if they ask why is it on there just because they own the land and can prove it, just say that a guy rented you it and now you've lost £100 quid for rent or something then the guy or women will feel bad for you loosing out, but it's up to you to say something to the owner if they turn up...?

      Go for it mate a guy over the road from me has done it and been there years with him and his family, people would be shocked just the actual amount of land out there that is unclaimed or unregistered and even if it is registered you can still claim it. the simple reason this law was brought out in the first place. `if it's not being used then someone else should be able to use it and it should not just be left to turn into a shit hole.     Great video mate. I actually think every person should have the right to own a bit of land to call there own and live on and maybe grow some food on. After all the Queens and Kings of the world all got where they are by taking land and things as their own at some point. They weren't born owning pieces of land automatically, they just went out and claimed a spot somewhere didn't they. Why shouldn't every human have the same right ? As long as it's not owned already, like you say. And as long as it's not bothering anyone else. Thanks for sharing your experience and advice mate.

    I found a bit yesterday with an old house that’s falling down. Paid for the land search £3 and a couple bought it 10 years ago but have done nothing with it. I looked them up on Facebook and they now live abroad.

    Could you explain a little bit more about that please? I've got a small plot I've been taking care for for just under 5 years. And i can't see anything about temporary claims on the land register website.

    You can't be prosecuted for trespassing in the UK because it's not a criminal offence.
    I would be worried about an angry farmer plus his mates turning up.

    It is good advice if the property is abandoned but it does feel like stealing if it is was owned by a family.

      The land was stolen from the people at one time and 50% is owned by just a few families and they get paid huge amounts of our tax payments just for owning it.
      I wish I was given thousands of acres and be the duke of Nottingham.
      You have to look at why adverse possession was created so that land and property that is no longer used does not go to waste.
      I mean if a family is homeless and starving and there was an old farmhouse that they could occupy and grow food should they not be able to occupy it and be able to feed their families from the land.
      If someone had no family or moved to Australia 50 years ago and probably paid peanuts for the land or just doesn't even know they own it. Then why should it go to the crown they have enough land as it is.
      If the owner turns up then they can claim it back probably in a better condition than what they left it. If they cared about it wouldn't just be left to go to ruin.
      I think everyone has the right to live in. abandoned property or grow food on abandoned land like I say if the owner turns up and can prove it's theirs then they get it back. Unless you have already claimed it that is.
      Have you typed in CZcams abandoned farms or homes in the UK and seen what has just been left to fall into a wreck..? You will be surprised I drive past a beautiful Georgian home every other day and it's just getting worse.
      It would make a stunning home but there is a farm near it and the farmer won't give any info on it...? So don't know who owns it I might check the owner out on the Land registry. But don't look at it as stealing a look at it as borrowing it and if no one turns up then it's yours.
      All land was stolen at some point in time, but I don't look at it like stealing.

    you can't be arrested for trespass, only aggravated trespass. Trespass alone is just a civil offence so the police can't get involved. 6:23

      I have no idea mate you have a better chance of driving around an area that you know and look for unkept land. Also just because the land is registered does not mean you cannot claim it. But I can't tell you were to look because I'm hundreds of miles away, but you will have the best chance looking around your local area and in places that are out the way and not normally noticed etc

      @@ryankeeling2406 No worries just keep looking and look around the edges of old farms, places that cant be farmed with a tractor and around electric pylons etc. Check out my video where I have a quick ride around my town and find about 3 - 4 places in an hour or so that could be potential claims. Even type in abandoned farms and buildings into youtube you will be surprised what people just leave and go. They could have moved to Australia and have no family for all you know or anyone knows. Just be wary asking locals about the land. If you find some and they ask you just don't talk to them unless someone walks up to you with deeds in their hand don't believe a word they say. Just play deaf and dumb sort of thing

    Seems like it would be a great idea to befriend the neighbours of the land that one claims, but what do you tell them about how you acquired the land? I imagine a lot of eyebrows would raise if you tell them you just showed up on it.

      Hi, thanks for the comment.
      I would just put my paper on and see what happens.
      If you get a call on your £10 phone which I advise to buy if trying this and say that you were left that piece or one close to it. Then the person can they show you see their deeds and where their land is, so you can see where yours is. You never know they might have their eyes on it..?
      Also, you could say that an aunty left you it you never knew you had. Research the area and see who owned land in that area not so hard to do online nowadays.
      A little underhanded but only a white lie, but you will be forgiven with all the free eggs you give them and vegetables and become an asset to the community.
      Or you could choose to say nothing they might live half a mile up the road why should you care you've just bagged the free land not them.
      And if the land is just left it will only go to the crown anyway. So if you see your chance take it.
      No matter what comes at you. Thanks Again

      It's just getting lucky finding a bit that is unregistered and forgotten or even registered and maybe the owner has emergrated. But people claim land all the time and its mainly farmers who do it on a big scale to be honnest

      @@PoloABD Mate a guy messaged me with a photo of just over 2 acers of ruff land overgrown etc between 2 farmers' fields. He spoke to both farmers and both didn't own it or new who owned it. So he has put signs up etc and been several months and no one called. It wasn't registered so he has started work on it and will probably claim it been as the farmers don't care about it. But there is also lots of bits close to electric pylons if you want to live close to one that is but it is out there just got to keep looking and go for it once you find a bit, land is claimed by farmers and home owners all the time mate

      @@thesmallfarmerlife what do you think if the land has a public right of way (disused, but with Road surface still showing) which runs across one whole side of the land?
      There is farm land to one side and housing estate the other side (with a solid fence between the housing and the right of way).

    I have recently taken over a garage that had been empty and untouched for around 20 years but as soon as I painted it 🎨 🖌 💅 and made it nice and done it up, a guy came around saying it is his and showing me the land registry documents, I have since put up a section 144 legal notice up on it and a sign saying trespassers will be prosecuted, he has had the police around but I've explained to them that they have no power and neither does he to force entry as it's a civil matter, what is the correct way to go about this? And what is the correct section notice I should have on the garage 🤔?

      If you watch the whole video you will see how to find the owner of the land. You don't need a postcode and if the land is not registered then you will have to ask locals etc

    So a bit confused to what my response would be when I get a phone call ! do I tell them they need to show me proof of land ownership or does it go to court. Obviously I don’t want to get in trouble ,but once I have secured an area and get that phone call telling me it’s there land what would be my next steps to say?

      Just tell them someone rented you it and if they have the deeds as you want to know where your money has gone and if you have been ripped off. If they can prove they own it then you can say I can tell the police the owners showed me the deeds etc. Be creative come on its not hard to tell a white lie here and there..?

    Hi mate, fantastic video! This is something I’ve been looking at doing for a few years now and I’ve been looking for land that I think is suitable and I think I’ve got a few bits to try. But my question is when do you actually put in for adverse possession? At the start or after the 10 years?

      Hi, after but you want to keep all records of anything you do to the land. You see people just put horses or rent the land out to people with horses and just keep recipes of the rent. That's enough to say you have kept the land in good condition, obviously repair fencing if needed etc but only with stock fencing. I think you can put in a claim halfway through so that no one else can try to claim while you are in possession I cannot remember what they call it, but I will find out.

      @@NBUHIT Yeah try to find an old home that's been abandoned like farmhouse you will be shocked how many out there, there is. Just do a CZcams search and you'll see mansions just left some are mint con editions some not so much.

      Yes if someone owns it but hasnt registered the land after 1990 then they may own it with no deeds or electronic deeds but may have the old paper deeds and see someone on their land so they block the entrance

    Thanks for the info.
    I heard about adverse possession a few months back but after seeing this video i went out tonight looking around my local rural villages.
    I was going off the unregistered map and think i might have struck lucky straight away.
    It was getting dark so need to go back and maybe talk to the residents next to the wood.
    Silly question but if the checks come back clear how do you actually decide if the wood is suitable for you and worth the hard work tidying it as its in quite a mess?

      If you do all the right searches make sure to spend time on the land registry website to check that its really unregistered and also check the land around it see if that is registered. Now I'm not saying purchase all the deeds to the surrounding land, but if it was me and the fact they only cost £3 each I would purchase the whole lot there maybe only 5 so £15 investment before you spend any real time or money on it or in I. People complain that they cost £3 but those deeds of the surrounding land will give piece of. mind and you will know who the neighbours are and if they will give you trouble or not. Its like buying a small coffee to understand who landowners next to the land you want to claim are. It's a no brainer but again its up to you. Now if you are not really going to spend the little money for those deeds are you really going to spend any money on the land as you will have to to stke a cor it sol to speak. The more time and money spent on the and the better your claim even if there is an owner as remember that even if it is not registered does not mean it is not owned they may just have owned the land for way before it was mandatory to register all land sales etc in 1990

      I completely agree, i have no issues at all with spending that kind of money as it will be my time I'm wasting in the end otherwise.
      After watching you and some others i think i have a basic understanding that unregistered land could still be owned even if it looked abandoned including what the sales act of 1990 means.
      Its a U shaped plot with clearly seperate worked farmland around the outside of the U with 2 posh houses with large seperate gardens to one side (and a flat open un worked? field in the middle part of the U shape) facing the lane.
      Luckily 1 or 2 of the back boundaries should be south facing as i wouldn't want a woodland that is grim in winter.
      Its easy to see why lots of people abandon woodlands though as theres not alot you can do with them apart from enjoy them if you can keep them maintained and safe.

Plus you can do a lot with woodland if you really put the effort in and even a small woodland could be a nice place for a small woodsman cabin to enjoy weekends or all year its up to you really.     What would happen if you claimed land and then someone else came after a couple years and claimed land for themself, moved your stuff out and their stuff in etc etc?
    Since this is a civil matter how could you handle this and keep the land?

      Hi for starters I'm sure they would have to know you are claiming it and to move all your stuff out or off the land in a time that you weren't there would be really hard. So if you caught them you would call the police as you would still have no trespassers signs up. But I have never heard of that happening or read about it happening

Just wondering I'm really interested in buying land and at the minute I don't really have the money upfront for it 🤔 so was thinking about this video (adverse possession) can I realy just walk up to unused land and stake my claim if for example it is overgrown and unused . Also I have dogs if I was to clean up the land fence it off is there going to be any problems with building kennels on the land and also training protection dogs .       Well you have to go through the motions first and stick your signs up etc. But yes you can, my friend did it and was on the land for a year till he tried to get electric on it and it was the national grids land but if he would have been off-grid he would have had it because they never knew they owned it till he put in for electric.
      But there is 17% of UK land that nobody knows who it belongs to so that's around 6 million acres or so that you could claim easy but you can still claim land that is owned as long as you can keep hold of it for 10 years. Possession is 9 tenths of the law and it is on your side, for the very reason adverse possession exists which is so that land is not left to just be a dump...!

      @@kallumflowers9318 Yep just keep it to yourself and only if someone claims to be the owner would you say prove it. Because I rented it off someone or something like that and then gets you out of the sticky situation and if they ask who just say you put add-in gumtree of Facebook and someone contacted you and then pretend to go through your messages and say must have had too many messages since then.

      It just means it hasn't been registered it might not have changed hands after 1990 but still could belong to a farmer whos has deeds of the old kind. But it means it unregistered with land registry.
      Just look around the place is there a farm close buy..? If so check to see if they have deeds or other properties near it and if they do and that doesn't then it could be a good chance for a claim...?

    I've found a piece of land, fenced off and looks a state. Have seen it for the last 6 years unused. I've put a sign on it however I've recently noticed that it has a padlock and chain on the gate. If I am looking to take adverse possession what can I do about the lock or am I better off walking away?

      If the lock has been put on after you placed the sign on then just walk away as this happens a lot. Owners sometimes don't register and could be just down the road they see the sign and think well Ill just put a lock on to keep people out as it will cost more to register. Or you could try and ask locals if they know the owner if so are they local etc..?

      @@thesmallfarmerlife the lock has been on the gate for as long as I've been looking into it. I know it is registered but it's unused, just didn't know if I can break the lock off or just walk away :)

      So it would be acceptable for me to bolt cutter the chain off and put my own on there? I've had my notice up for 2 weeks now, no calls, no messages no one has even been there, the chain is so old and covered in cobwebs too

      @@dannymartin7306 They could still say criminal damage if the true owners turn up, but if you say well I was renting the land off a guy who pops in now and then to collect so no specific date or anything and that he must have changed the locks as I never and he came me the keys. You have to take chances on these things or claiming land would never happen if a rusty old lock stopped you, that rusty old lock me be the only thing between you and that land...?

      Say what you want I could tell you what to say and I know what I would say, but I would say I just rented it off someone and if they say it is their land. Then print of a piece of paper saying you have paid a deposit and can they show you the deeds they own it if they do move on. Or just move to a new piece of land you have found and if no one calls then that's good but don't expect the first piece of land you find to be yours. It will take time and persistence to get a piece of land for free otherwise everyone will do it

      You don't have to live on the land you just have to use it. If it needs fencing repaired you have to do it and clear anything that would be classed as crap from the area. Then just rent it out for horses or something keep the recipes and then you can claim it or rent it out as allotments. But you have to do something with the land but don't have to live on it.

      And on that map you showed is it the red areas that are unregistered was thinking might be worth driving round having a look at them then any unused ones paying to check the land register as a sort of double check is it worth putting up signs before checking the land register

      It means you own the land outright. But it could be that you own it by Freehold but it has a 999 year lease to. The best title you can have is Title Absolute

      Mmmm how is this stealing..? It's not illegal to claim land or property and it states it all on the governments land registry website. Also, my view of this is who said they could have all the land for themselves in the first place. That the poor get nothing unless your in debt to the rich who took the land in the first place. There are 60 million acres in the UK and 10% of people own 90% of it and 1% own half of it, they didn't purchase it that's for sure so if there are bits of land going unused then why not claim it. It's. not illegal to do so. Stealing is taking all the land and keeping it for themselves while giving none to the people who work it.

      That's your opinion, but the law of adverse possession exists for a reason,. So that land untended to, can be used by the people from which the land belongs to. Not to mention, do you not think that it was immoral for the few families and cronies of the crown?
      To take land from our ancestors and dish it out to the few while the many got nothing...? Most of that land taken from the people our ancestors and given to those families is still in those families hands, who get paid millions of taxpayers money every year for just owning it.
      Some families own hundreds of thousands of acres. Is that not immoral..? Also, once they took the land from the common man and women who owned it, they then turned around, rented it back to them and also made them pay taxes on the land they once owned, not the new landowner. So it all depends on which way you look at it, really.

      But, there is no way that you can know that what you're taking is from a source like that. It can just as easily belong to a small family and have nothing to do with Royalty or old aristocracy. If you're just putting up those signs on various land then claiming when nobody says anything, you're just taking land. Its not targeted at a specific demographic

      It's not sneaky or immoral. You have to do it in a way the owner can find out, if they bother to check.
      Adverse possession works on exactly the same principle as the land became someone's property in the first place: Physical possession.
      This has always been how land first goes from wild nature to someone's property, and it's also how we always settled arguments over who should own it next. In the old days you physically possessed land by killing anyone who challenged you about it. Eventually we got a little bit more civilized, so now we prove physical control with evidence instead of violence.
      The land owner has plenty of time to object and ask you to leave until that time has passed. If you haven't noticed that someone has taken over your land for 12 years you very obviously have no physical possession of it.

      So someone has some pasture that doesn't need maintenence and they're saving their money for cattle, when they get the cattle they go to use the land and some slippery prick has taken the land from under their nose just because "ThEy DiDnT StOp mE" .. whatever mate. You just do whatever you think is right and wrong.
