    In 2006 the "leaders" here in NJ used eminent domain to close the Pennsauken Mart so a minor league hockey rink could be built. Eight years later the giant lot is still empty. Disgraceful!

    And now that horrific hotel is toast, all these years later. I walked through it last May, before it closed, and it was cheesy, run-down and poorly maintained. Good riddance.

      j.denino57 Another thing, Atlantic City is 80% minority with a per capita income of around $23,000. The state of NJ should have improved the surrounding neighborhood. There is a beautiful beach right there, I could never understand why the state did not encourage more economic activity in A.C. there are other beach towns,where the housing market is very high such as in Point Pleasant or Long Beach Island, NJ.

    This is something that right, left, and moderate middle all really ought to agree on.
    Whatever you think of eminent domain when legitimately applied (and I understand there are some sound arguments against it -- though I'd point out that it's right there in the Constitution), we should all be able to agree that ABUSE of the eminent domain process for private profit is an obscenity -- unprincipled, unAmerican, and indefensible.
    If anyone can show me where I'm wrong on this, I'd appreciate it.
    But if not, can we agree this is something we should all be condemning (as it were)?

    He did exactly the same in Scotland regarding his golf course. He wanted four nearby homes demolished, because in his words "they were ugly". Not nice for his rich golfing chums to see while they were playing golf. He offered them loads of money but they refused, so he tried the same trick, but the home owners fought him and won! He described one man's home as "a mess" and said "he lives like a pig! He's a selfish bullying bastard!

      Not according to the USSC in the Keto decision. It is entirely Constitutional for cities to take private property for development, public or private.

      @@CH-pv2rz First of all, it is Kelo not Keto. Second, what happened with the land that was taken for "development" in Kelo's case? Nothing. That land now sits empty. Pfizer, for whom the land was taken and given, closed the facility in New London as soon as the tax breaks given by city were expired. The city went over heels to appease the company, but as soon as the tax breaks expired they left. This is just like Robinhood but in reverse- you take from the poor and give it to the rich. This is why Eminent Domain, atleast for private use, needs to end.

      Look where it got them. Trump was right and the crappy house in front of his hundred million dollar investment was a slap in the face and the beginning of the end of the Atlantic City dream. No wonder Trump pulled out without paying anyone. The courts brought it on themselves by not appreciating the major investment he made in their community and voted against him.

    The takings clause of the fifth amendment says that the taking must be for public use. There is no mention of public benefit or private gain anywhere in the takings clause. That means that the taking can only be for direct public use and for no other reason. Dire military need in wartime is public use. A park is public use. A public school is public use. A highway is public use. A railroad is public use. Malls, apartment complexes, company headquarters, and other private development is never public use, even if there is the potential for public gain or benefit. The framers of our constitution chose their words carefully and meant literally what they said. If the framers had meant public gain or public benefit, they would have said public gain or public benefit and not public use.
    Our courts, including the SCOTUS, have done an excellent job twisting the letter and meaning of the constitution around to suit the demands of the wealthy and the corrupt. It is time we straighten these bad decisions by reversing them to suit the original intent and meaning of the founders and the constitution they wrote to protect us from this sort of tyranny. Eminent domain was never meant to be used to force transfer of title of land from one private owner to another just to satisfy the greed and unwillingness of a developer to pay a private owner what the current owner wants for their property. Under Kelo, Trump would have won. This must be forced to never happen again.

      that is so so so so far from the truth, no HE LOST in the supreme court, but he fought her over and over up through the system, trying to make her run out of money, he did not respect her at all, he was quite ugly in his remarks about her, and praised other millionaires who won their cases, and stole ppl's houses. IN THE END SHE WON HER FREEDOM TO CHOOSE, TO LIVE THEIR AS LONG AS SHE WANTED, AS IT SHOULD BE IN AMERICA, END OF STORY. Except the fact she lost a huge amount of money having to defend her right of freedom for something the law was clearly written, that law NEVER pertained to some rich prick who wanted to build a parking lot of a casino.

    He says that eminent domain is a necessary thing. Necessary for who? For you, Mister Trump? For him to say that the house is terrible looking is, to my way of thinking, an attempt to justify his wanting to remove it from the landscape and replace it with a limousine parking lot. In his eyes, "Beauty is in the eye of the beholder." and to him, the house was ugly looking. Thankfully he lost his case. This was just another example of his narcissism and putting profits ahead of property what he calls "The Greater Good."

"Back in New London, where the Kelo case originated, the condemned property-on which fifteen homes once stood-remains empty, used only by feral cats. The economic development project for which the homes were taken was a dubious proposition to begin with, and eventually fell apart. Despite a variety of proposals since then, the City of New London still has not been able to find a productive use for the land."
      This is the state of affairs in 2020. The court got it wrong back then. That was why 45 states enacted Eminent Domain reform laws after the judgment. Eminent domain is abuse of power. Period.

    Donald Trump was right when he said that cities have the right to condemn for the greater good of a city, but this was attempted for his greater good, not Atlantic City. He spoke of that women's house as being terrible looking, he only says that because he wanted that property so that he could build a limousine parking lot for his casino across the street. This was all done for his benefit, not for Atlantic City. Kudos to Vera Coking.

She was not going to allow someone bully her into selling a home she bought and paid for and grew old in with her late husband. Her and her husband planned on buying that house growing old in THAT house and retiring in it. The old American dream you know. But I guess the American dream should include "until someone richer and more powerful comes along" She also moved into an old age care facility due to her age and medical problems. she stayed as long as she possibly could to finish up her American dream in her house.

      Tom, the press is relentlessly trying to destroy Trump now. Just the way they relentlessly tried to get Obama elected. I'm against that bias either way. ...No American should be flippant about eminent domain and it has led to some heartbreaking scenarios. However, the US is in trouble now with Obama and Democrats giving Iran billions of dollars in the recent nuclear arms deal. Eminent domain is of little importance if you don't even have a planet to live on which could occur if Iran continues to pursue destruction of the US and Israel. I don't see anyone else speaking out against that deal as strikingly as he....so this issue is small peanuts in comparison to some of the other pressing matters on the table.....
      such as how Obama doubled the National debt, decreased the military strength of the US, and how there is a breakdown of communities because of increased racial tensions ...by the way, please look at any city or state run by Dems exclusively in the past years and tell me how they're looking....San Francisco? Chicago? Baltimore? Philadelphia? New Orleans? not good.

However, when Obama said he had just visited "57 states with two more to go" the media gave him a pass.     My city is growing into a metropolis. I fear emminent domain may befall my neighborhoood since our University is growing. Perhaps investing in the pulic education of IT may help so we can learn from home and prevent relocating families. Maybe hold classes in buildings that are not being used such as a Church . Since they tend to be used only a couple days a week for their sermons. Save our gardens. Save our planet.

The supreme court has been clear that the government can take any property or likewise give permission to any private entity to do so without reason provided the property is paid with fair market value which essentially is based on your property taxes.

    It's just as well that he lost his case against Vera Coking since his Atlantic City casino went other, so he lost twice over. Trump is good at deflecting attention away from the central issue by focussing on something irrelevant such as mentioning living in a city where you cannot build schools, churches, roads, highways, and have access to hospitals. He's a deceitful man whether he chooses to admit it or not.

      IDK why commenters keep saying it has to be public benefit, that's literally not true. The Supreme Court has been clear that property can be seized for ANY purpose the government chooses. The only requirement is that the government has to pay the fair market value (which essentially is tax related value the property owner previously reported).
      This is the problem when people don't know the law, they get outraged that the law is enforced. The complexity of the law is to blame however.

    This comment is coming years after the post. Sorry. I just saw it. Eminent domain is crazy in some aspects. I agree that it is necessary at times, but this wasn't one of them. I'm a conservative, but I can't stand some asshole trying to take a person's lifelong home for limousine parking. Trump has always been an ass and always will be, but I am still glad we didn't get Hillary.

    In reading more on this, I see she wanted 5 million from Trump and Trump refused, as the property was so bad it could be condemned, and was likely worth under $100,000. But it was worth a lot more to Trump. I would have thought 5 million to Trump would have been peanuts. Surprised he wanted to seize it cheaper and get all that bad publicity.

      RJ Walker Trump offered her 1/4 of what another investor had offered her 15 years prior. The house was worth at least $1,000,000 in 1978 and Trump offered her $251,000 in 1993. Trump offered far below market value. Either way, taking someone's property by force is theft.

    I know and understand that we have rights to own our home. This Lady should not have had to sell.
    but When building cities neighborhoods and busniess parks and such, If you understand how inflation works and how western countires need to see growth even to remain the same, I see what Trump meant by a necessary evil.
    Most wont, but that kind of thing happens everywhere. when you have a neighborhood or bussniness park with this odd old home smack dab in the middle, the city planners always look to uograde over time which change neighborhoods and areas vastly. They were trying to offer her money, was it a good deal? idk, but this all is a reality, I think people need to learn to work together.

    There is no separation of power. There is State (legislative branch, executive branch, judicial branch) vs everyone else. Anyone who thinks that judges are independent is delusional.
    The point is that she justly acquired the property and such right should be absolute, not up to the State to decide whether she can keep it.

    How about considering rephrasing your choice of words. The last photo you showed at the end of this video proves Trump was right and why that building needed to either be moved or torn down. Trump was trying to help the city grow and prosper but the way you are presenting it as Trump being the bad guy was used to win the case throwing Trump under the bus. When the reality was seeing that house in the middle of a commercial area is one of the reasons Atlantic City failed.

      395PRS While I understand the Donald is like a Mountain Dew in a cooler full of Pepsi and Coke, all of them will rot your teeth and are bad for you in the long run. While my personal life may not be the cleanest, I'm not running for the highest office in the nation and I never tried to pose as a republican while using government to steal someone's home, that's not how conservatives behave. Conservative is someone who conserves the use of government. Also, generally speaking, while balls do certainly help, they are not necessarily required to be an effective leader. While I don't know who to tell you to support (we're f**ked either way), I can tell you to prepare yourself and your family for very tough days to come, we have already passed the event horizon, it really is too late to fix this thing. This country has become just like a computer riddled with malware, spam and viruses. To manually remove them would take unwavering, unrelenting focus for generations upon generations, that ain't gonna happen. We are at the point where the system is so clogged ctrl+alt+del won't even work anymore. We need a leader who isn't afraid to tell the people to prepare while he holds down the power button for 4 seconds, restarts this thing, formats the hard drive, and re-installs the constitution/bill of rights, version 1.1 (I would have said version 1.0, but that kinda included slavery.)

He was trying to build another building for his own private business dealings. He isn't just a bully who doesn't respect property. He is also extremely dishonest.
