Australian Bass Fishing (NSW) | KAREN THREATENS to CALL POLICE on FISHERMEN

- Elijah and I take a trek in one of NSW most remote rivers in search for big numbers of wild Australian Bass! As we enter through a PUBLIC place we venture down the river for kms and kms walking through the river bed enjoying our day whilst having a few laughs and enjoying the fishing then we stubble across a lady who we thought was going to be really nice at first but told us we were trespassing and had to leave otherwise she was calling the police which is completely incorrect. We were in fact standing in the river bed at the time of approach (the bed is that any section which covered OR left bare with the increase of flows other than at times of flood) Directly from section 38 of the fisheries act. I hope this helps a lot of fishermen who do have encounters like this regularly. We need to take a stance in situations like this and continue moving on with our day. We decided not to let her know before hand that we would be going through this way because 1. Too early in the morning to be knocking on someones door and 2. We walk kms and km which would mean knocking on at least 4-6 doors…

Outstanding session guys. And outstanding standing up for your rights to be on public land - which is what the riverbed essentially is. Amazes me how people think they can take ownership of things they have no right to. It's getting worse all the time. The DPI in NSW have an access office online you can report land owners to and they do contact them. I did one last year and the DPI actually rang me to update me. Great vid, too. Cheers PP

@@markvicary3974 Hey Mark, Dpi put out a heap of information a while ago including the brochures/posters . You can search the act on their website or alternatively contact t them for the information. If you are wanting the poster itself a Google image search will produce.

The NSW Government should crack down on fences, jetties, wharves etc designed to stop people's access to the foreshore or riverbank. I'm over these fascist farmers claiming ownership of public lands.
Fascist indeed. Any significant waterway should also have publicly accessible easement on either side as well. Privately owned beaches and river banks should not be a thing.

Best thing to do is to always give your local land holders a call to give them the heads up, even though you may be within your rights to fish. 98% of the time they wont have any issue and youll find most will give you pointers on good spots or any hazards on the banks! Anyways great video, good river fishing 😁
How do you find their phone numbers and if they say no, then you can still go anyway, right ?
I’ve been bass fishing for 11 years and the one lure that has never let me down is the rolling crank. It’s a great lure and you should definitely use it. Great video by the way.

This looks like it was taken in the Paterson River at Lostock? I grew up at Lostock.
If it's the woman I think it is, who bought the property a few years ago from Sydney, she's done this before - in that instance she forced a local autistic teenager, who didn't know his rights, to walk out of her property in the middle of the waterway.
After his mother told me, I searched out the information you two used and provided that to her to give to her son.
I work in environmental assessments, so I know waterways are Crown land - meaning they aren't owned by the people whose property borders it. Most people don't know that.
So long as you access via the waterways (i.e. don't go through private property), you have a right to be there - fishing or otherwise.
Along the Paterson River, it's quite easy to do, you can access the river from the bridge below the Lostock Dam, without ever needing to enter private property.
Most people who act like this aren't true locals, they're people with money who have bought in recent years.
It is funny they put the fencing all the way into the river in this video, or maybe the flood washed the land off.

You blokes are outstanding. When confronted poised, polite and erudite. Having the confidence to know that you were within your rights and clearly, calmly and confidently put your point of view won the day. A long time ago I was faced a similar situation. Unfortunately I didn’t have the presence that you both displayed even though I knew I was within my rights. That encounter affected me so much that I gave up fishing some favourite streams. It is unfair that landholders can block access to rivers and streams and prevent fisher folk from accessing them treating them as their own private domain. Rivers and streams belong to all of us !

That’s unfortunate about your situation, sometimes it effects others more and it effected me a fair bit when I ran into that other farmer last year but I eventually got over it and realised there isn’t anything they can do but yell at you and threaten you. But yes your right it is very unfair they treat fisherman like this because it plays on your mind for the rest of the day and kills the mood.
You don't even need to put your point of view across, if you are not doing anything wrong, just keep fishing, stop arguing with the idiots. Ignore morons.
I had a raging farmer abusing me this at the Murray river ... chasing trout ! They are nuts mate ! Its funny how they think the river beyond's to them ! Fisheries stock the rivers and lakes not for the farmers and land owners to sell the experience to fisherman for a quick buck ! Good on you lads.

I encountered a Karen just like this when I was about 10 fishing with my dad, I still get anxiety to this day when walking riverbanks waiting for a farmer to come raging out at me even when I know the law. Also encountered a lot of farm fences that go into the water which is BS. Surprised she didn’t try to say its a public liability issue Ibe heard that before
Yes indeed. It is not actually the river BED that you can traverse. It is the COURSE. And that means within the BANK at it's uppermost level.

Well done boys. It always baffles me that Australia has such a huge land mass, you could be anywhere even remote and you will see a farmers fence. Some of the best rivers are within the confines of those fences. Don't know why they need such huge lands, they have nothing growing, I don't see any cattle, it's just barren land that they own. Such a waste to see lovely waterways trapped inside those fences, I'm not particularly keen to get into arguments with farmers but I do believe if farmers are not using huge lands then they should be a bit more accommodating to fishermen.

I had a flick the other week caught 40 bass in 3 hours but I was using a chatterbait average size was 30cm to tip and the largest was 48cm

I have a friend that has a property on the Ovens River, Victoria, with a fishing shack that his grandfather built in the 30’s. It’s now in crown land.( 50m from riverbank ) People can use the shelter no problem but touching his camping equipment and fishing stuff is a different issue. I guess we are trusting people to do the right thing..

Not suggesting that you do what I have done however it might lessen the intensity of another similar situation. Present yourself to the local police and inform them of your daily plan. They are helpful and onside immediately. Simply because you took the time to introduce yourself. The upside of this is that when the disgruntled landowner threatens you with police you are not an unknown to them. Best to pre-empt by being proactive rather than on the reactive backfoot. Hope you never have that type of problem again. Enjoy the waterways that belong to all Australians.

Walking the banks or in the creek on private property is a no go unless you have permission. You can access at public launch point in a kayak and fish in the creek or river put soon as you step out if you are on private property you are trespassing without permission. I have checked this with my mate at Fisheries and there is no crown land or any of the sort of thing up here. If you wanna fish a creek buy a box of beer and go door knocking, it’s how I’ve got some of my access. Some has come from meeting the right people and some came from joining my local stocking group.

Double check that legislation. The DPI summary isn't the law. Looks like your on private land in a number of those shots. Your fine where you were when the lady approached you but I doubt you got there without crossing private property. Doesn't matter what the river looks like in flood the legislation talks about regular and normal flow of the stream where vegetation doesn't grow. Your doing the right thing according to the DPI and she's entitled to think it's hers as the land survey would consider the middle of the river her property and they would pay rates on that land. Should be clearer really to prevent these situations.
Cheers for your opinion Kent but how would you know we crossed private property? You do realise we would swim through situations where it’s too deep when there is steep banks on the edge. No matter what I don’t think we could have prevented that situation it was always going to happen as she thought we couldn’t be there at all.

Land owners are getting fed up, only takes one or 2 bogans and it ruins it for the rest of us.
I've been chased off a creek by a owner with a very bad temper and supposed stashed gun.
Always practice the law and a bit of practicality by camoflauge and better not to be seen.

Yes that is correct. We entered through public access. If people are buying properties on the river I believe they should understand this law a lot better but I can understand if they have trouble in the past but that isn’t our fault
@@wellplayedfishing7809 I have property on the Macleay river and the only access is by boat and yes it's council land along the river but land owners still class it as there land it's the same situation as you at home someone you don't know is in your front yard wouldn't you want to know who they were and what they wanted but it depends on where you were if that creek run's through her property then that's different because you are on her property especially if it runs through the middle of her property and your in the middle of it I would call that an intrution when the creek or river runs at the front or back of the property that's fine but going through private property is not a good idea.
@@wellplayedfishing7809 There are some really good bass creeks here but I wouldn't even attempt it because it's all private property but that's why they such good spots because no one has access gives the fish a chance to grow get big and fat.

@@peterehsman8831 unfortunately this statement is incorrect as the law has changed many years ago but any river in nsw doesn’t matter if it happens to go through someone’s property is classified as public land. I’ve spoken to fisheries to clarify this cause I was a little unsure but as long as you access through a public area like a bridge/ causeway or if you have Permission from the property owner it’s all okay 👍🏽
