    As an ex-employee, it's insane that Back to MAC is over. Used to love people bringing in their bags of old products from old collections and going through them, talking to the customer about the memories associated with each product. Super fun. I guess people can still do that but I don't understand ending the free product.

      To me its sad that consumers would stop doing it just because of the lack of product refund. Sure some will stop but I suspect they are banking on the face that people are much more environmentally conscious now and will still bring them back.

    With the L'oreal thing - I always assumed that the Paris part was where the original company/shop was based and founded - not necessarily where the products were made.
    Edit: that said there seem to be a lot of brands just slapping the name of a city like Paris or London or New York just to make their "brand" look posh. I don't think a company should be able to do that if the company isn't based there or the product isn't made there. That's when it gets misleading

      L’Oreal Paris is a separate entity. L’Oreal Paris is the parent company, L’Oreal is a subsidiary in the US. I worked for them for 2 years in HR doing budgets. Amazing company to work for btw.

      i’ve never thought their makeup was necessarily made it france bc of the paris in the name. just that the company was founded there and has their headquarters in paris. i drove past a large l’oréal building when i was in france last year, which i imagine was their HQ. like how essence is a german brand but has their products manufactured all over europe.

  • @dawnpenny5006

    Hey Jen! I actually agreed with the judge concerning L’Oreal Paris. L’Oreal was formed in 1909, in Paris, and originally sold hair dye to Paris salons. The company likely keeps the name as a nod to its heritage…they were born and its formative years were in Paris…I don’t think the fact that the word Paris is in the name should cause people to make an assumption about where products are manufactured over a 100 years later. I am sure in many industries there are company names with a location in the title and it has nothing to do with where their products are manufactured. Thanks for today’s informative show!!❤

    I REALLY wish Mac would have kept the Back to Mac program the same, with the exception of raising the return limit to 8 or 10. It was a great incentive for consumers to be rewarded for recycling. A lot of those empties are going to go in the trash now which goes in the opposite direction of what Mac is supposedly trying to do.

    • @rhyami
      @rhyami Před rokem +18

      I think they made two pretty foolish mistakes. First, in a very crowded makeup market, they did something that could disappoint or alienate some of their customers and thought that was a better idea than what they were doing. From the customers perspective, they took some thing away but did not replace it with anything comparable, and that can feel like a loss.
      Second, they failed to take into account that most of us do the thing that is easy, taking the path of least resistance. If we don’t get something for taking our empties back to the store, why should we make a trip over there when we can just throw the empties away? I think they are overestimating the dedication of people that are into environmental issues Because while people say they care, their day-to-day actions often don’t reflect that.
      I wonder if they will take the time to track return of empties to see if they are still doing something to reduce plastics from being thrown away. I tend to think they won’t because they seem to be ignoring principles in social psychology and in marketing. I hope I’m wrong about that, and I would be pleasantly surprised.

    I had the same thought about Mac just doing a “refill” system instead. So many of their packages could easily be updated to (for example) have the pan pop out, or the inside of the lipstick tube pop out and a new one put in. They could quickly train employees how to do that. Seems like a better way to reduce plastic waste. Especially since makeup “collecting” has become less popular.

    I don't know how to feel about the whole trademarking names thing.
    I agree with Jen that shade names are different than brand names and should have a higher bar for trademarking in general.
    Celebrities trademarking their children's names feels weird to me for a few reasons.
    I always worry about kids who are forced into the spotlight so the idea of trademarking their name, essentially for that purpose, before they're able to understand what they're getting into and everything that comes with being in the public eye, is not something I'm into.
    Especially toys, where there's no way they're just saving that for when she's older and can decide for herself she wants to be a business mogul, and can understand what goes into it.
    If she's interested in that as kid, I think her parents can easily introduce her to it with their own brands, it doesn't need to be her name in the public. I just worry with limited life experience she can't consent to all this because she doesn't know what she's consenting to.
    Also it's one thing with a name like North West, which is extremely unique, but where do you draw the line. Is some celebrity going to trademark the name Becky Smith in accessories, then poor Becky Smith with the small Etsy store that sells hair pins is getting sued for using her own name, a very common name?
    I think I don't like it.

    I was just in Westfield Mall in London while visiting my son. It is an amazing mall. Beauty is HUGE in London. There are so many makeup venues. Boots is a "drugstore" but has some very high end makeup. It's incredible. They were updating their makeup area to compete with Sephora which opened the week after we left. There was advertising for the store everywhere! My son, who lives five minutes from the mall, said there was a seven hour wait to get into Sephora the day it opened.

    As a lifelong resident of the Pacific Northwest, I get a wierd kind of ick thinking that it could be trademarked as a name alone when it's associated with so many places and existing brands, but I'm not a Kardashian fan so it's also that 🤓🙃

Like I couldn't just file to trademark "Lucy" with absolutely no business or product attached and have it granted 😅 It doesn't work like that. It’s ridiculous to think something is manufactured in a place, just because the company has a location in its name. So many companies (mine included) use city/state/country in the name because of where it was founded, not to mention many other reasons.
    If you want to know where something is manufactured, read the packaging info.

    • @lucyjane3803
      @lucyjane3803 Před rokem +1

      Trademarks don't work like that though, you can't just speculatively trademark something with no proof that it is associated with a recognised brand. It isn't super smart, its having more money than sense to make filings that will be rejected. I don't know where this weird idea is coming from that you need to trademark things immediately to start a brand/business, you don't. Trademark law is very complicated and generally exists to protect large brands from small imitators and for most businesses will be completely unnecessary.

But, there are better products on the market, composition wise.

    The interesting part about naming your brand with your name is Jaclyns situation now. What if she doesn't like the new direction that the new owner proposes? Can she break the licensing agreement easily or they could sell some awful crap under her name, and he has no say in it? I have heard about cases like that before. And even if she breaks the licensing agreemend I doubt that it would be easy to establish her own brand under the exact same name. And on the other hand we had KVD brand, it was her name so it wasn't easy to sell it after she got herself involved into controversy. I think giving your brand your exact name isn't the best idea. Unless you are well established, decades of experience and being public person and you run your own brand, no one else has say in it, and you would never want to sell it (but who can predict that).
