      Giving a homeless person a meal is not against the law.
      Giving a homeless person a safe place to sleep the night is not against the law.
      When police try to make a case against you because you fed somebody who was hungry and you gave somebody who had no shelter for the night a safe place to lay their head in safety.
      For kidnapping or any other violation for law breaking is just wrong.

      They didn't go because they weren't told to leave. Police consider a request to be deniable.
      First 'tell' them to leave (don't ask them), then, when they don't leave, order them to get off your property and tell them that they are trespassing.
      ARE trespassing!
      Not 'will be' trespassing or 'could be' trespassing - ARE trespassing!

      And she did not listen. I am curious if I did this (said LEAVE) and they didnt listen to ME, can I just go back inside my house and lock the door or will they come back with a warrent for my arrest for "not cooperating" ? Because I would have already told them to leave and of course I would have a body cam on me with evidence of them refusing to listen to me. This a hypothetical situation but they like to pop in on my own property and bang on my door over&over for about 10 or 20min just to harrass me because they know I do not even answer my door. They have been doing this (randomly) for three years now. Im literally trying to prepare for a divorce because (and there are other reasons too) my husband refused to move during these last three years and knows full well I have ptsd and anxiety from them doing this.

      Legally after you have trespassed them and they have refused to leave you would be able to initiate a citizens arrest. No warrant, no exigent circumstances, asked to leave and refusing, they are committing the crime of trespass at that point. You can inform them you are making a citizens arrest, legally use reasonable force to detain them if they try to leave and call the cops on themselves. In practice though it would be pretty risky, and you need to be confident that you have evidence in order otherwise you risk being found guilty of a false arrest.
      Telling police to get off your property when they have no search warrant for the property or arrest warranty for someone known to live there or exigent circumstances, is perfectly legal.

      @@ms.anonymousinformer242 ask if you are being detained before you go in the house. If they say, "no" you are good. If they say, "yes" assert your 5th amendment right to remain silent and request an attorney. You have to actually verbalize this, and then they must stop questioning you.

      or they want to step away and speak to you alone without a 3rd party. i'm not a cop and i can bring people aside for a private conversation and not do it because i think they are weak... just saying, simply because this cop is doing that, doesn't mean every cop is doing that. what about the cop that asks you to step aside to tell you that they agree with you and are on your side against a 3rd party? i've had that happen, feels good knowing you have a good cop, or atleast one that is corrupt in your favor. you generalize too much. i'm ACAB sometimes but that's just cuz i'm anti-authoritarian not because i believe for a second that every single one of them is bad or corrupt. my favorite cop videos are cops turning in other cops, and not for 'office drama' reasons.

      the young man did not listen at all he hung around to long and did not listen to I believe was his mother otherwise he would of went inside straight away, if I was his dad and did that I would have got between him and the cops and told them immediately to leave and then when they were gone the son would have been given a lecture and told straight up if you do not want to listen and do as you are told then find some where else to live because he was putting them all in danger the police are not your friends and if you trust them more than me or your mother then you have rocks in your head. but you were right with the mother.

    The man chased after the youngster in order to interrogate her in order to fish for information to arrest the woman. The copper expressing her desire to befriend the homeowner is a huge fishing trip in order to trick her into admitting un-undetstandable behavior that could be construed as a crime. We may never know how beautifully the woman handled herself. Hats off toher.

      Actually your wrong. She IS INTERFERING WITH CUSTODY. the parent who has custody showed officers the court order. The child was suppose to be back at a certain time. If the child is not returned she could be charged with kidnapping. She's smart by letting the child go. . This will make her look very bad in court. Also could lose her visitation to supervised visits. And that usually is 1 hour a week. When u don't follow a family court order..it will most likely end bad for you.

    The officers should have been arrested immediately after they refused to leave when told to, and she could have made that happen. "Leave my property now. You're still not gone. I'm calling the police and having you trespassed." End of discussion.

    Children have the legal right to remain silent. Coercive interrogations can often lead to false confessions. The officers should have left the property upon request.

    The officer is definitely phishing for a case.. that’s the only reason she keeps trying to get him to go with her. 16 is not a grown adult, it is a child and this officer needs to understand that you do not confront CHILDREN without the consent of their parents. They should also know that once someone tells you to leave their property and you stay, you are trespassing

    Good on her for sticking up for herself and her family and friends. Her advice to not talk to police is very very important unless you initiate the encounter but even then be really careful with your information and be prepared for them to arrest you. If you call for police ask for a supervisor immediately at first contact just after you get names and badge numbers.

Not sure if this state’s laws but often adult presence is required when they suspect something and yes they can lie if they do or not.     in Washington state a few years back I heard a story about a man that went outside late in the night to investigate a car that had pulled onto his private property. The home owner was legally armed and not banishing his firearm as he had had multiple things stolen. well, it turned out to be a deputy Sherriff in an unmarked car and after some heated words the deputy shot the home/landowner dead on the spot and got away with it in the end

      Also, remember that they're trained to lie and minimize the consequences of talking to them until they actually arrest you. You have the right to remain silent at all times, but they're counting on you not knowing that until they get you to say something they can use against you. It's much easier to lie to you one on one, too. They want you separated from anybody else who can point out inconsistencies in what they're telling you.

    The best thing she did was staying calm and not cursing. Police in my country are considered our friends not the enemy. America with all it's guns, you would think that the cops have some of the best training in the world!...But no! On average Police training is 20 weeks, that's far too inadequate! They need more in-depth psychological evaluations, screenings, better pay and no quotas!

    LOVE IT. The only words we should say to cops who are fishing is, "I don't answer questions, you are free to leave".
    Telling cops, "You are free to leave", is a riot.
    You would think by now, every city, every county, every state, would have had extensive education classes for the police. Evidently they don't care about the huge law suits that result from violating peoples rights. I have seen law suits in the 100,000's, even one for 1.5 million. I wonder what the tax payers think when they learn their real estate taxes are going up due to the law suits. Lawyers should buy a huge ad in the paper informing the people how the cops are responsible for the rising taxes.
