  • The plaintiff rented a room in the defendant’s house. She says there was a gas leak in the apartment, which could have killed her because she used a portable heater. She claims she inhaled toxic fumes, so she moved out. The plaintiff is suing for a rent refund. The defendant thinks the plaintiff is just exaggerating. She’s countersuing for unpaid rent.

    Too many landlords want 2024 priced rent with 1980 type apartments. Upgrade your shit and then upgrade the rent.

      the united states has some of the most poorly maintained housing in the Western world! There are many reasons for this:
      We have people that want to get rich being landlords. We have tenants that destroy rentals, We have rent control, We have extremely high labor costs, so maintenance is expensive, We have very old, un-improved housing stock. We have laws that let tenants live for months rent free, as evictions are processed.

    Even if it WASN’T the law, how could anyone, in good conscience, rent a space to someone knowing that the heat on THEIR OWN side of the unit works, but the heat on the tenant’s side does not? The fact that she stated that so matter-of-factly, along with the whole: *”It wasn’t sparking on her side”* comment shows what a slumlord she truly is.

    What gave credibility to the case of the plaintiff is the fact she moved out of that place very quickly after the gas issue. The defendant should never be allowed to rent again.

    'They tagged units I knew didn't work when I moved in." So they don't count as something that has to be fixed? And a tagged stove doesn't have to be fixed because it wasn't connected? And the tenants have to make do with space heaters?
    I think the defendant bought the place strictly to make money off it, with no intent to maintain it.

      Actually in California there no law saying it have to provide heating, it kinda up to the judge to decide which most would but it not 100% some part I know you don't because it get so warm even at night you don't need heat

    If you are in a rental situation where you feel the need to withhold rent, get a bank savings account and pay the rent to the account on time every time. Then, if you go to court, you can show the judge you have it secured in trust. It goes a long way with the judge.
    Been there done that.

    So the narrator for the defendant called the plaintiff "a total drama queen who is greatly exaggerating the electrical issues in the be house, which were minor according to her electrician "... That was an incredibly reasonable plaintiff, and the electrician she hired wrote in his own words that this was a problem. Wow, the defendant showed really poorly simply because the plaintiff was so incredibly reasonable.

    That landlord is just a horrible person!
    Doesn’t even care one bit about the lack of safety in the rented spaces!!
    There could have been a fire at any given moment because of the bad shape of the electrical system PLUS there was a gas leak on top of that!!
    She should be criminally charged for endangering the tenants!!

    She is incorrect about the outlet being ungrounded causing the heating receptacle. That sounds exactly like the circuit was daisy chained through the receptacles instead of being pig tailed properly.

    No it doesn't mean that the outlet is ungrounded, and no that doesn't mean that being ungrounded could cause a fire. . That said, constant headaches, and fatigue would be a sign of CO poisoning.
