      @Akh Cho I suppose you could take that point of view. But I'm on the side of the police here. There's no way of telling how this person would have behaved in a situation not involving police, but he's clearly drunk and enjoys being provocative. This is the UK and there's a camera, so he knows that he won't get hurt. If he was in a position to provoke a vulnerable individual he probably would, "for the laugh" The problem with having a laugh on the street when you're drunk is that people often get badly hurt from what initially starts out as a bit of fun. You could be right, maybe this guy would shake your hand and walk away. My judgement tells me that the police did the public a service by getting him off the street til he sobers up.

      Things like this are ridiculous. The guy was drunk and merry. Something similar happened to me. I was carrying a bottle of vodka to a party. It had been opened previously but I was not drinking from it. They tried to confiscate my drink and give me a notice to leave the area. I refused and they took my alcohol and threatened me with arrest. Thankfully my friend was recoding and I got their badge numbers. I sent them a letter saying that if they didn't reimburse me for my vodka then I would take them to court for battery and theft. Their legal team got in touch and settled out of court.

    See how the police try to stack the charges against him? There's no mention of "drunk and disorderly" before or during the arrest.
    He is warned for open container, littering and one swear word (for which he was warned and he apologised and accepted the warning and said he wouldn't swear again).
    There is no LAW which states a police officer can demand your name and address as he was NOT told her was getting a fine for the open container or littering.
    Only in the voiceover at the end do you hear that the other charges were dropped and they new tried a new one "drunk and disorderly". I see nothing in the video apart from at the police station AFTER his arrest where he is disorderly.
    Fair play to the young man for standing his ground, refusing the caution and forcing the police to take him to court. I would be certain he beat the case.

      Actually he swore at the officer which was then a Section 5 Public Order offence. The officer required his name and address to fine him however the gentleman took the capital P and didn't. So he was nicked to ascertain those details. He later refused the charges/fine so he had to stand up in front of a magistrate and explain his reasons why not.

      The latter is illegal. The former is in certain circumstances. There would have to be a control area in place (likely in a town centre) and the officers would have to prove not only that he had open alcohol but he was being a nuisance (on the basis of his general demeanour, open and shut). Overall, offences like ‘breach of the peace’ give coppers blanket powers to take people down the station… even if they are never actually brought before a magistrate.

      Legally, they cannot. The two "crime" he were arrested for don't exist. Firstly is public drinking, which is not illegal in England and Wales. While some areas may restrict public drinking, the police can only "advise" people to stop drinking, though can arrest if they are bring disorderly.
      Public disorder is the second "crime" that they suggest is committed in two ways. The first being his drinking, the second being swearing at the police. For the first, the guy was seemingly minding his own business so there is no just there. For the second, laws only apply if there is reason to believe harassment and/or harm is intended, using a swear as a filler is not harassment. While "baldy" could be interpreted as such, it takes a very brittle person to actually be offended by someone.
      Additionally, as the police arrested him without telling him his crime (despite being asked to do so), he had no need to give him his name. And the only crime he could actually cite would be calling him "Baldy", but as he never does so, every action taken was illegal.

      Don't think it was illegal. I was arrested for a similar incident and as long as they inform you why you were arrested and read your rights back at the station it's legal. I think they often do it when the person getting arrested is slaughtered lol

      He got arrested for not picking up his litter which he had a chance to. Police can use discretion and that lad was taking the piss big time. So because he committed a crime of dropping litter, they asked for his name. He refused so got arrested.

He committed a “relevant offence” (as in, any offence that a police officer has the power to require you to provide your name and address), in this instance, a bylaw offence of littering. When the officer required him to provide his details, he refused to, and swore (technically an offence on its own, under section 5 public order act 1988, but in this instance, committing this offence is instead used as evidence that he was drunk and disorderly in a public place, which carries a heavier fine, so they arrested him.)
      If he’d given them his name and address, he would be issued a fixed penalty of £50-£80 (depending on when this was filmed), and that would be the end of it. Because he decided to act like a twat, he got arrested, spent the night in the cells, and was given a Penalty notice for disorder of £80-£100 (again, depending on when this was filmed), and because he refused to accept the fine, he is being taken to court, where his fine is SIGNIFICANTLY higher than either of the fines he could have taken.
      Act like a dick, get treated like a dick🤷🏻‍♂️

      @@AshleySef08 if you’ve been acting in an anti social manner (littering could possibly count, swearing definitely does, being drunk and disorderly also counts), you have to provide your details to an officer if they require you to under Section 50 Police Reform Act 2002, and if you don’t, they can and will arrest you, to take you to custody where they can confirm who you are.

      Then he was charged later with drunk and disorderly which wasn't why he was placed in the van.
