For viewers of the show it served a major role in orienting them to which universe they were seeing and when the episode was set, and was a nice contrast to the appearance of both the original World Trade Center towers still standing in the alternate universe in 2009.

To be fair, the Empire State Building crashed only killed 13, took place in 1940 and the building didn't fall. Meanwhile, the OG WTC were attacked in 2001, both Towers collapsed and took the lives of almost 2,600 people. In fact, the attacks were just 23 years ago, and it's still fresh in people's minds

That is fair use and totally fine. However, in a disaster movie where the entire point of it is destruction-porn, depicting the OWTC being destroyed is problematic because that would be the entire point of it being in there. So it's no longer fair use because the filmmaker is using the OWTC to increase the value of their movie. And since that is no longer fair use they need to get the permission of the OWTC's creators to depict it in the movie. They don't want to see it destroyed so they tell the filmmaker they can only include it in the movie as long as it remains unscathed. Thus we get a OWTC that remains standing while the rest of Manhattan turns to shit.
